R-2009-099 16th Ave and Washington Ave Intersection Improvements Project Contract Supplement No. 1; PLSA
A RESOLUTION RESOLUTION. NO. R-2009-99 authorizing the City Manager to execute a supplemental agreement with PLSA Engineering and Surveying, for surveying services to clearly mark and stake the existing and proposed right of way boundaries for the 16th Avenue and Washington Avenue Intersection Improvement Project. WHEREAS, in April 2008 the City of Yakima selected PLSA Engineering and Surveying from its consultant roster for surveying services required for the 16th Avenue and Washington Avenue Intersection Improvements project; and WHEREAS, additional surveying services are needed to clearly mark and stake the existing and proposed right of way boundaries, as described in the Scope of Work Description included in the Supplemental Agreement; and WHEREAS, it is requested that the City Manager have the authority to execute a supplemental agreement for additional surveying services needed to aid in the acquisition of right of way for the 16th Avenue and Washington Avenue Intersection Improvements project; and WHEREAS, the City Council deems it to be in the best interest of the City of Yakima to authorize the City Manager to execute a supplemental agreement with PLSA Engineering and Surveying, that will add the task of clearly marking and staking the existing and proposed right of way boundaries to the Scope of Work of the professional services agreement entered into as a result of Resolution No. R-2008-57, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute a supplemental agreement with PLSA Engineering and Surveying that will add the task of clearly marking and staking the existing and proposed right of way boundaries to the Scope of Work of the professional services agreement entered into as a result of Resolution No, R-2008-57.. The total additional compensation authorized by said supplemental agreement shall not exceed $2,200. The form of said supplemental agreement shall be reviewed and approved by the City Attorney or his designee. ADOPTED BY THE CITY COUNCIL this 7th day of Jul „2009. The Surveyor is responsible to reestablish points at no additional cost during that term. The Department of Community and Economic Development - Engineering Division desires to Supplement the agreement entered into with PLSA Engineering & Surveying and executed on 4/1/2008 and identified as Agreement No. R-2008-57 All provisions in the basic agreement remain in effect except as expressly modified by this supplement. The changes to the agreement are described as follows: 1 Section 1, SCOPE OF SERVICES, is hereby changed to read: Establish survey points on both the existing road Right -of -Way and the proposed Right -of -Way. Clearly mark Right -of -Way with a combination of survey stakes, hubs and/or paint in a fashion that will ensure that said survey marks will remain viable for a term of 60 days. The Surveyor is responsible to reestablish points at no additional cost during that term. As set forth in the attached Exhibit A, and by this reference made a part of this supplement. 2 Section 2, TERM, is amended to change the number of calendar days for completion of the work to read. The work shall be completed within Twenty (20) calendar days following the execution of the contract. 3 Section 3, CONSIDERATION, shall be amended as follows: The City shall pay the Surveyor for services rendered not to exceed two thousand two hundred ($2,200) dollars. PLSA will establish survey points at angle points and at 100 -foot intervals along existing and proposed right of way lines where additional right of way will be required to be obtained from adjacent land owners. Our estimated "not to exceed" fee for the described services is $2.200. We are prepared to provide these services upon your authorization and complete them within a mutually agreeable time frame. SUBMITTED BY: William Cook, Director CED CONTACT PERSON/TELEPHONE: Doug Mayo, City Engineer — 576-6678 SUMMARY EXPLANATION: The city has a consultant agreement with PLSA Engineering and Surveying under which they provide the City with surveying services for the 16th Avenue and Washington Avenue Intersection project. At this time, staff requests authorization to execute Supplement No. 1 of this agreement, which would increase the scope of services to include clearly marking and staking the existing and proposed right of way boundaries. This supplement would not extend the length of the agreement, and would be at a not to exceed cost of $2,200. The purpose of staking the existing and proposed right of way lines is to aid the Appraiser in determining the value of the property to be purchased, and to aid in negotiations with the land owners so that they will be able to clearly see the land to be acquired.
