AN ORDINANCE amending the 2014 budget for the City of Yakima; and making
appropriations of $1,102,000 within the 001 — General Fund, for
expenditure during 2014 to provide for the purchase of four
properties with the intent to partner with the Department of Ecology
for pollution remediation and resell.
WHEREAS, by separate Resolution, the City is entering into a purchase agreement with
Tiger Oil for four properties with a set price of $1,100,000 plus an estimated $2,000 for related -
closing costs, and
WHEREAS, the amount of $1,102,000 must be appropriated within the 001 - General
Fund for expenditure during 2014 to provide for the purchase of four properties with the intent ,
to partner with the Department of Ecology for pollution remediation and resell, and

WHEREAS, at the time of the adoption of the 2014 budget it could not reasonably have
been foreseen that the appropriation provided for by this ordinance would be required; and the
City Council declares that an emergency exists of the type contemplated by RCW 35.33.091
and that it is in the best interests of the City to make the appropriation herein provided, now,
therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1: The amount of $1,102,000 is hereby appropriated from the Unappropriated
Fund Balance in the 001 — General Fund Account 2256100 titled Land in the Code
Administration Department as a 2014 appropriation.
Section 2: This ordinance is one making an appropriation and shall take effect
immediately upon its passage, approval and publication as provided by law and by the City
Charter.

ITEM TITLE: Special Meeting: Ordinance (second reading) amending the
2014 budget and making an appropriation from
unappropriated Fund Balance within the General Fund (Tiger
Oil Properties)

SUMMARY EXPLANATION:
At the Council's regular meeting on February 18, 2014, the City Council conducted a "first
reading" of an ordinance amending the 2014 Budget to make appropriation of funds to purchase
the four properties owned by Tiger Oil Corporation. The City Council also adopted a resolution
authorizing the City Manager to execute the Purchase and Sale Agreement for such properties.
Execution of the Purchase and Sale Agreement was made contingent on approval of the
Appropriation Ordinance.
We had originally anticipated that the Second Reading of the ordinance could occur during the
March 4, 2014 regular Council meeting, but the March 4 meeting was canceled and
rescheduled to March 11, 2014 because several Council members were scheduled to be absent
on March 4. In order to expedite the purchase and sale of the Tiger Oil properties, staff is
requesting that the Second Reading of the Appropriation Ordinance occur at a Special Meeting
called for that purpose on February 25, 2014. This is the time currently set to conduct a Council
Workshop study session. The Special Meeting item will be limited to the Second Reading and
adoption of the Appropriation Ordinance, and Council can then proceed to its workshop items.
Conducting the Second Reading on February 25, 2014, and adoption of the Ordinance, will
allow us to schedule the closing of the purchase and sale at escrow with Valley Title, perhaps
as soon as February 27 or 28. If the Second Reading is delayed until March 11, 2014, the
closing cannot be conducted until after that date.
