The City Commission met in regular. session, Mayor Stratton and Commissioners Clark and
Traub present on roll call:.
Loved by Stratton, seconded by Clark that the minutes of the regular meeting of Tuesday,
October I.4th,- '1930.be approved as read: carried, Stratton, Clark and Traub voting aye
on roll call:
Tvoved by Traub; - seconded by-Clark that this being the•time for the hearing on Resolution
No. B -1159 for constructing a cement sidewalk on the east side of South 9th Avenue from
',lest Walnut Street to 'test Spruce Street, 6 feet in width, and therebeing no protests '.in
writing or otherwise to said improvement or any part thereof, it is ordered that the or-
dinance creating a local improvement district be laid on the table for one week; carried
Stratton, Clark and Traub voting aye on roll call.
=loved by Traub, seconded by Clark that the City Engineer having reported the completion
of the improvement in Local Improvement District No. 489, by the Contractor, J. Ma De
Blasio, in the sum of $810.00, said work is hereby accepted and the City Engineer au-
tlior.ized to prepare an assessment roll for said district and the City Clerk authorized
to.give notice of hearing on said roll for Monday,,November 17th, 1930 at 9 o'clock ArK,:

RESOLUTION NO. B -1161, A RESOLUTION authorizing the sale of Tract 3, Fairchild's Acre
Tracts, according to the official plat thereof now on file and of record -in t-he office
of the Auditor of Yakima County,'Washington, to A. N. CAREY:
WITREAS, the City of Yakima is the owner of the following de-
scribed real property situated in Yakima, Yakima County, Washington, to -wit:
Tract 3, Fairchild's Acre Tracts, according to
the official plat thereof now on file-and of
record in the office of the Auditor of Yakima
County., Washington,
by, reason of a deed. therefor issued by the County Treasurer of the County of Yakima,
State of Vlashington,, to said City of Yakima, on sale of said property for delinquent
taxes•, and
WHEREAS, it appears to be for the best interests of -said. City of
Yakima to sell said premises to A. N. CAREY upon.the terms and conditions' hereinafter
set forth,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CObMIISSION OF THE CITY
OF YAKIMA, ffASHINGTON:
That' said- avove described premises be and they are hereby author-
ized. to be sold. to A. N. CAREY for the total sum of Four Hundred. Eighty -seven and 21/100
($487-121) Dollars, payable as follows: The sum of Eighty -seven and 21/100 ($87.21) Dol-
lars in cash upon the execution of the contract herein authorized and the balance of
Four.Hundred. and 00 /100 ($400.00) Dollars payable in semi - annual installments as follows:

The purchaser under said. contract shall also agre.e to pay all assess-
ments against said premises falling due under any Local Improvement District or Districts
hereafter created or arising from levies hereafter placed. against said premises, and the
Mayor and City Clerk of said City are hereby authorized and directed to enter into a con-
tract in duplicate with said, purchaser*und.er the terms hereinabove set forth.
Said agreement to be entered into shall also contain suitable pro-
visions requiring any buildings upon said premises to be insured at the expense of the
second party in a solvent insurance company satisfactory to said first party as its in-
terests may appear and shall contain a provision that incase of destruction of-or dam-
age to any buildings or improvements on said, premises such damage or loss shall be the
loss of second party and shall not be a ground for recission of said contract; and said
contract shall also contain a suitable provision providing for f orfeiture. thereof upon
failure of second party to make any payment of principal, interest, taxes or assessments
therein provided for when same shall become due or delinquent, notice of such forfeiture
to be for 30 days and service thereof to@be by servingisame personally upon second; par-
ty or by mailing to him at Yakima, Washington; and a, further provision shall be placed
therein that upon final payment of said principal and interest and taxes and assessments
the first party shall convey said. premises to second party by a good and sufficient suit
Claim Deed conveying all the interest said City of Yakima has now in said premises; and
the further provision shall be contained in sai4=119'ontained in said contract against the
assignment of second party, without the consent of�first party had and obtained.
