Moved by Riley, seconded by Clark that the minutes of the regular meeting of Monday, August 28th, 1939 and adjourned meeting thereof be approved as read: carried, :Riley and 'Clark voting aye on roll call, W-, shburn absent. RESOLUTION NO. C -429, WHEREAS, there has been submitted to the City Commission of the City of Yakima, a budget covering the detailed estimate of all expenditures proposed to be made by the City of Yakima for the ensuing fiscal year and a statement of the probable revenue from sources other than taxation for the ensuing fiscal year, in the manner and form prescribed by law; and WHEREAS, the same has been considered by the City Commission in detail and such revisions and additions made as has been deemed advisable: NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF YAKIMA: That the aforesaid budget be and the same is hereby adopted and approved as the budget for the City of Yakima for the ensuing fiscal year and the City Clerk is hereby directed to give notice that said budget has been completed.and placed'on.file, and a copy thereof will be furnished any taxpayer who will call at the office of the City Clerk therefor, and that the City Commission of the City of 'Yakima will meet on the first Monday in October, 1939, at the offices of the City Commission in said City at the hour of 9 o'clock A. M., for the purpose of fixing the final bud- get 'and making. the tax levies and notifying any taxpayer that he. may appear 'at said meeting and be heard for or against any part of said budget, and said notice shall 'be ` published once each week for two consecutive weeks immediately following the adoption of said preliminary budget. C -434, BE IT RESOLVED BY THE CITY'OF YAKIMA, WASHINGTON: That it is its intention to construct a water system to serve all of the lots and tracts of land within the following described district: Beginning at the intersection of Twentieth Ave- nue South with Nob Hill Boulevard; thence westerly along Nob Hill Boulevard to a point 166 feet west of the center line of Twenty -fifth Avenue South; thence northerly and parallel with Twenty -fifth Avenue South to a point 100 feet south of Tieton Drive; thence westerly and para- llel with Tieton Drive to the west line of the .East Half of the Northeast Quarter of the North- west Quarter of Section 26, Township 13 North, Range 18 E.W.M., thence northerly along said west line to Tieton Drive; thence easterly along Tieton Drive to Twentieth Avenue South; thence southerly Along Twentieth Avenue South to the southerly right of way line of the Natchez and Cowychee Ditch; thence westerly along said right.of way line to the alley in Block 13 of the Subdivision of Tracts 13 and 14 of Chase Hill Residence Tracts; thence southerly along said alley to Bonnie Doon Avenue; thence easterly along Bonnie Doon Avenue to Twentieth Avenue South; thence southerly along Twentieth Avenue South to the point of be- ginning;_ said improvement to consist of the acquiring of right of way easements, and the in- stallation of the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use, and to be constructed'in full ac= cordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improve- ment are hereby notified to appear and present such objection, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima., Yakima County, Washington, at the hour of ten o'clock A. M., on Monday, the 2nd day of October, 1939; which time and place are hereby fixed for the hearing on all matters relating to the said proposed improvement, or objections thereto, and for determining the method of payment therefor; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. WHEREAS, the City of Yakima is now the owner of Bonds Nos. D -55- 59-- 59 -60 -67 -and 69-, par value of $500.00 each and Bonds Nos. M- 167 - 169- -179-- 179- 19-0 -1.9-2- 19-5 =18-6 -19-9 -190- 191 - 192 -203- 204 - 205 -206- 207 -209-- 209 - 210 - 211 -212- 213 - 214 -215- 230 -157 and 123, par value $1,000.00 each. The total aggregate par value of the above bonds being $1,000.00. Said bonds having been issued by the Tacoma Masonic Corporation, bearing 5 °o interest and being First Mortgage bonds on property of the Tacoma Masonic Corpora- tion in the City of Tacoma, Washington, and WHEREAS.; it is necessary that the terms . of said bonds be' modified to enable the said Tacoma Masonic Corporation to retire them. NOW, THEREFORE, it is deemed to the best interests to the City of Yakima to consent to such modification and the Mayor and City Clerk are hereby authorized to execute said Consent Agreement to the end-that said Modification Agree- ment may be carried out.
