Moved by Riley, seconded by Washburn that the minutes of the regular meeting of Monday, October 3rd, 1938 and adjourned meetings thereof be approved as read: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark, seconded by Washburn that the claim of Fred Rasciner in the sum of $200.00 for damages-alleged to have been sustained by reason of employees of the Eity Water-Dept,.-digging a trench and ditch adjacent to claimant °s property and throwing all of the debris and- dirt- therefrom on said claimant's property; destroying flower beds, shrub-s--and-ledges and preventing said claimant from ingress and egress on his property, be.and the same is hereby denied; carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark, seconded by Washburn that this being the time for receiving bids for furnishing material to construct.a sewer system on East Washington Street, Local Improve ment District No. 536, the following contracts were awarded: Yakima Cement Products on concrete pipe $2,270.00; $292.50 on wye branches and $912.00 on Concrete Blobks; A. B. Fosseen &-Co. on-Siphons 252.00; Modern Foundry on rings and covers $384.00; carried, Riley, Washburn and Clark voting:aye on roll call. Moved by Washburn, seconded by Clark that this being the time for the hearing on the assessment-roll in- Local Improvement District No. 531 providing for an irrigation system at "Johnson's Corner" and there being no objections in writing or otherwise to said asse.ssment roll or any part thereof; it is ordered that the ordinance confirming said assessment roll and every part thereof be passed as-finally read: carried, Riley, Washburn and Clark voting aye on roll call. ORDINANCE N0. B -345, entitled., "AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 531, as created and established by Ordtnance'No. B - ,X06 of the ordinances of the City of Yakima, ", was introduced by Clark and read by the City Clerk. Moved by Washburn, seconded by..Riley.that Ordinance No. B -345 be passed,to its second rea.ding.and read by title only: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Washburn,,-.seconded by Riley that Ord .ihance No. B -345 be passed to its third reading and read in full: carried, Riley, Washburn and Clark voting aye-on roll call. B -346, entitled "AN ORDINANCE fiking the time of delirigiieney of-install- ments of assessments levied for the payment of the coot of the improvement in'Local, Improvement District No. 532, and providing for the issuance of bonds with•coupons .`. attached for the payment of the unpaid portion thereof ", was introduced by Washburn and read by the City Clerk. Moved-by Clark, seconded by Riley that Ordinance No. B -346 be passed to its second reading and read by title only: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark, seconded by Riley that Ordinance No. B -346 be passed to its third reading and read in full: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark, seconded by Riley that Ordinance No.'B -346 be passed as finally read: carried, Riley, Washburn and Clark voting aye on roll call. RESOLUTION NO. C -357, BE IT RESOLVED BY THE CITY OF YAKIMA, WASHINGTON: That it is its intention to improve Thirteenth Avenue South from West Walnut Street to Division Street; West Walnut Street from Twelfth Avenue South'to'Fourteenth Avenue South, and West Spruce Street from Twelfth Avenue South to, Fourteenth Avenue South by the construction of concrete curbs and gutters. The district to be assessed is described as follows: Beginning at the intersection of the alley In Block 4, Highland Addition with Division Street; thence north along said alley to the south line of Lot 13, Block 4 of said Addition; thence westerly along said south line to Fourteenth Avenue South; thence northerly along Fourteenth Avenue South: to the north line of the south half of the north half of the northeast quarter of the south- west quarter of the southwest quarter of Section 24, Township 13 North, Range 18 E.W.M.; thence easterly along said north line to Twelfth Avenue South; thence southerly along Twelfth Avenue South to the south line of Lot 4, Block 3, Highland Addition; thence westerly along said south line to the alley in said Block 3; thence southerly along said alley to Division Street;-thence-westerly along Division Street to the point of beginning; said improvement to be constructed in full accordance with the plans and specifica- tions to be prepared by the City Engineer and filed with the :City Clerk. a 1 1 All persons who may desire to object to said proposed improvement are hereby.notified to appear and present such objection, if any, at.a meeting of the City Commission to be held-at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of ten o'clock A. M., on Monday, the 31st day of Oeto- ber,-193-8, which time and place are.hereby fixed for the hearing on all matters relat- ing to said proposed improvement or objections thereot, and for determining the method of payment therefor; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement. shall be distributed as follows: The labor and a portion of the.materials shall be furnished by the Works Progress.Administration, and the balance of the cost and expense, including engineering, inspection, advertising, publication of notices and all other expenses incident there- to shall be levied and assessed against the property included in the district, as is legally and.properly assessable therefor as provided by law ans as above described; and the City Engineer is- hereby directed to submit to the City Commission at or,prior to the date fixed herein for said hearing, all.of the data and other.information re- quired by law to be -by him submitted.
