Moved by Riley, seconded by Washburn that the minutes of the regular meeting of Monday, June 6th, 1938 and adjourned meetings thereof be approved as read: carried, Riley, Washburn and Clark voting aye on roll call. C -335, BE IT RESOLVED BY THE CITY COMMISSION OF-THE CITY OF YAKIMA: That it is its intention to construct an irrigation system to serve all the lots, blocks and parcels of land included within the real estate herein- after described, said improvement to consist of the acquiring of right of way ease- ments, and the completion of the necessary mains, laterals, service connections and other appurtenances for the purpose of delivering water for irrigation purposes to each lot and tract of land within the proposed district. All persons who may desire to object to said proposed improvement are hereby norified to appear and present such objection, if any, at a meeting of the City Commission to be held at its -office-in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of ten o'clock A. M., on Tuesday, the 5th day of July, 1938, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of pay- ment therefor; and the City Clerk is hereby idrected to give due notice of said hearing 19 P June 13, 1938 and of the intention to make the aforesaid improvement. The cost and expense of said improvement shall be distributed as follows: Approximately the sum of $15,648.00 Dollars to be taken care of by the Works Progress Administration, and the balance thereof to be borne by and assessed against all of the property legally and properly assessable therefor as provided. by law and as above described; and the City Engineer is hereby directed to submit to the City Com- mission, at or prior to the date fixed herein for said hearing, all of the data and other information :required by la.w to be by him submitted. C -336, A RESOLUTION authorizinf the sale of Lot 25, Block 1, Bungalow Addition to North 'fakima (now Yakima), according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington. WHEREAS, the City of Yakima is the owner of the following de- scribed real property situated in Yakima, Yakima County, Washington, to -wit: Lot 25, -Block 1, Bungalow Addition to North Yakima ( now Yakima) , according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington by reason of deed therefor issued by the Treasurer of Yakima County, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for delinquent taxes, and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to ALFRED KILTAU and MARJORIE KILTAU, hsuband and wife, upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That said above described premises be and they are hereby author- ized to be sold to ALFRED KILTAU and MAJORIE KILTAU, husband and wife, for the total sum of Two Hundred Twenty -Five and No /100 ($225.00) Dollars,-payable as follows: the sum of Ten and No /100 ($10.00) each week for four weeks beginning June 13, 1938 and $5.00 the fifth week,-making a total of $45.00 as a down payment on the contract here- in authorized and 'the balance of One Hundred Eighty and No /100 ($180.00) Dollars in. monthly payments of Five and No /100 ($5.00) Dollars, beginning August 10, 1938, and continuing until the entire amount has been paid. All deferred payments to bear inter- est at the rate of six per cent per annum payable monthly with principal payments. . The purchaser under-said contract shall also agree to pay all assessments against said premises falling due under any Local Improvement District or Districts hereafter created or arising from levies hereafter placed against said prem- ises, and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purch aser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable provisions requiring any buildings upon said premises to be insured at the expense of the second parties. in a solvent insurance company satisfactory to first party as its interest may appear and shall contain a provision that in case of destruction of or damage to any buildings or ixprovements on said premises such damage or loss shall be the loss of second parties and 'shall not be a ground for rescission of said contract; and said contract. shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfeiture to be for 30 darts and service thereof to be by serving same person- ally upon second parties or by mailing to them at Yakima, Washington, and a further provision shall be placed therein that upon final payment of said principal and interest and taxes and assessments the first party shall convey said premises to second parties by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima has now in said premises; and the further provision shall be contained In said contract against the assignment of second parties without the consent of first party had and obtained. C -337, A RESOLUTION authorizing the sale of the northerly 50 feet of the southerly 100 feet of Block 92, Original Town of North Yakima (now Yakima), all lines being parallel with block lines, according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington. Also, described as unrecorded Lot 10, Block 92, Original Town of North Yakima (now Yakima). F11 D P WHEREAS, the City of Yakima is the owner of the following described real property situated in Yakima, Yakima County, Washington, to-wit:. The northerly 50 feet of the southerly 100 feet of the westerly 140 feet of Block 92, Original Town of North Yakima ( now Yakima) all lines being parallel with block lines, according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington. C =338, A RESOLUTION authorizing execution and delivery of Deed for purpose of clearing title to Lot 1, Block 21, Tennant & Miles' Modern Addition to North Yakima (now Yakima) according to the official plat thereof noe on file and of record in the office of the Auditor of Yakima County, Washington. WHEREAS the City of Yakima heretofore included the above described property in various local improvement foreclosure sales, and pursuant to one of such sales. took a Deed to such property;, and _ WHEREAS the said local improvement_.- assessments for which said foreclosure was had, had been previously cancelled by a.County Treasurer's tax sale; so that ,the inclusion of said 'property in the foreclosure of said local improvement gssessments was by inadvertence and mistake; and WHEREAS it is necessary and proper that the City of Yakima execute a Quit Claim Deed to said property in favor of F. S. Kohls, the true owner thereof, for the purpose of removing a cloud against said title by reason of said local improve- ment foreclosure sale; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That the Mayor and City Clerk of said City of Yakima are hereby authorized to execute and deliver unto said F. S. Kohls a good and sufficient Quit Claim Deed to the.property hereinabove described for the purposes hereinabove set forth. Moved by Washburn, seconded by Clark that this being..the time for awarding contracts by the City Water Dept. for.the purchase of pipe, Valves, etc., the following awards were made: Rensselaer Valve Co. on Items 6 to 12, 618.00; Pacific State-s Cast Iron Pipe Co. on Items 1 to 5, $10,959. 30; Items 13 to 21, $128.96.and Pacific Waterworks Supply Co. on Items 27 to 32 $876.x+0: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark, seconded.by Washburn that the City Engineer having reported the com- pletion of the irrigation system in Leaming's Addition, Local Improvement District No. 528, by the Contractor, in the sum of $9,018.10, said improvement is hereby accepted and the City Engineer authorized to prepare an assessment roll for said district and the City Clerk is hereby instructed to give notice of hearing on said roll for Monday, July 11th, 1938 at 10 o'clock A. M.: carried, Riley, Washburn and Clark voting aye on roll call. B -315, entitled, "AN ORDINANCE fixing the time of delinquency of install- ments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 527, and providing for the issuance of bonds with coupons attached_ for the payment of the unpaid portion thereof ", was introduced by Riley and read by the City Clerk.
