Moved by Riley, seconded-by Washburn that the following payrolls be allowed and the City Clerk authorized to issue warrants as follows: Street Mtse. $1,579.90; Construction $975.39; Parks $45:1.50; Cemetery $165.00; Cemetery Care $426 -.00; Sanitation - $719.51: carried, Riley, Washburn and Clark voting aye on roll call. RESOLUTION NO. C -313, WHEREAS, it is the desire of the City of Yakima that the director of highways paint traffic lines along the center line of PSH No. 3 and 5 within the corporate limits of the City of Yakima, now, therefore, BE IT RESOLVED, that the City does hereby acknowledge that it will not satisfactorily accomplish and will delay and be unable to paint said traffic lines on such City streets and waives notice of, the director of highways thereof; BE IT FURTHER RESOLVED, that questing and permitted to paint said traffic lines five ($125.00) Dollars,-an amount not in excess of or reasonable anticipated to accrue to the City of during the next fiscal year, such painting of traf the amount so credited, or to be credited; and the director to the amount the amount of Yakima in the fie lines cost of highways is re- of One Hundred Twenty - money now credited motor vehicle :fund to be charged against BE IT FURTHER RESOLVED, that upon statement of the cost of such painting of traffic lines and journal voucher therefor, approved by the City of Yakima., for all labor, equipment, materials, supplies and engineering, the State Auditor is authorized and directed to reserve and credit to the department of highways in payment for such painting of traffic lines- any funds credited or to be credited to the City of Yakima in the motor vehicle fund not to exceed the above specified sum; all in accor- dance with the provisions of Chapter 157, Session Laws of 1937. Moved by Clark, seconded by Washburn that Resolution No. C -333 be adopted as read: carried, Riley, Washburn and Clark voting aye on roll call. RESOLUTION NO. 0-334, WHEREAS, the City Commission of the City of'Yakima., on this- d ay and date duly assembled, for the purpose of transacting city business, all Commissioners of said city being present and concurring in this resolution; and WHEREAS, among other matters coming before said City Commission is the question of entering into a contract to secure electric lighting service for lighting the streets of said city, in part by new equipment to be installed and owned by the electric service company to replace the present arc lighting equipment iuhich no longer adequate for the needs of said city; and WHEREAS, Pacific Power & Light Company, a. corporation, is and for many years has been engaged in furnishing electric service within the City of Yakima, as a public utility subject to regulation as to its rates, regulations and service by the duly constituted regulatory authorities of the State of Washington, and is the only person or corporation so engaged or in a position to furnish the city with the- street lighting service required,by it; and WHEREAS a form of proposed contract with said Pacific Power & Light Company to furnish such service to the City for a term of ten years has been submitted to said City Commission, and has be said City Commission been submitted to and approved as to form by the City Attorney oaf said city, and a copy 'thereof, as so approved by the City Attorney, has been placed on file with the City Clerk and is identified by such, reference; and WHEREAS, skid City Commission has duly considered such proposed contract, and all the terms and conditions thereof, and has determined that the needs and interests of said city will be served by entering into such contract with Pacific Power & Light Company; and WHEREAS, such proposed contract is now ready for execution on the part of the said city, and the City Commission deems it necessary in the interests of said city that the work of replacing the present street are lighting system hereto- fore owned and operated by Pacific Power & Light Company shall be begun immediately and the new lighting equipment installed and placed in operation in accordance with the terms and provisions o ;f said proposed contract; now, therefore, BE IT RESOLVED by the City Commission of the City of Yakima., Washington, that It is necessary for the public peace and safety of the City of Yakima and the residents and inhabitants thereof that immediate provision be made by contract with the said Pacific Power & 'Light Company in the form hereinabove referred to for lighting the streets of said city for the term of ten (10) years from and after June 6th, 1935; and BE IT FURTHER RESOLVED that the form of contract hereinabove referred to be and the same hereby is approved and that E. B. Riley, Mayor of the City of Yakima, and Pearl Benjamin, City Clerk, be and they are hereby instructed and di- rected to execute such contract for and on behalf of said city, in fuplicate, and that the City Clerk a.ttgch the seal of the City of Yakima to said contract and deliver one executed,copy thereof to Pacific Power & Light Company., ['I 1 1 PASSED BY THE CITY COMiISSION this 6th day of June, 1938, by the following vote and roll call: Riley, Yes; Washburn, Yes; Clark, Yes. Moved by Clark, seconded by Riley that this being the time for the hearing on the assessment roll in Local Improvement District No. 522, providing for the construction of a sewer in Walker Addition, and there being no protests in writing or otherwise to said assessment roll, or any part thereof; it is ordered that the ordinance confirming said assessment roll and every part thereof be passed as finally read: carried, Riley, Washburn and Clark voting aye on roll call. ORDINANCE NO. B -311, entitled, "AN ORDINANCE confirming the assessment roll covering Local Improvement District No, 522, as created and established by Ordinance No. B -254 of the Ordinances of the City of Yakima ", was introduced by Washburn and read by the City Clerk. Moved by Clark, seconded by Riley that Ordinance No. B -311 be passed to its second reading and read by title only: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark, seconded by Riley that Ordinande No. B -311 be passed to its third reading and read in full: carried., Riley, Washburn and Clark voting aye on roll call. B -312, entitled, "AN ORDINANCE amending Section 18 of Ordinance No. A- 1.92 passed and approved by the City Commission on the 28th day of August, 1915, entitled "AN ORDINANCE relating to local improvements in the City of North Yakima, and repealing all ordinances and parts of ordinances in conflict herewith, and declaring an emergency" was introduced by Riley and read by the City Clerk. Moved by Clark, seconded by Washburn that Ordinance No: B -312 be passed to its second reading and read by title only: carried, Riley, Washburn and Clark voting aye on roll call. ORDINANCE NO. B -313, entitled, "AN ORDINANCE providing for the improvement of property In the City of Yakima, Washington, by constructing a municipal water system to supply various lots and tracts of land with water for domestic use; establishing a local im- provement district, providing for a method of payment therefor and creating a special fund ", was introduced by Clark and read by the City Clerk. Moved by Washburn, seconded by Riley that Ordinance No. B -313 be passed to .its second reading and read by title only: carried, Riley, Washburn and Clark voting aye on roll call.
