Moved by Riley, seconded by Washburn that the minutes of the regular meeting of Monday, April'25th, 193.8 and adjourned meetings thereof be approved as read: carried., Riley, Washburn and Clark voting aye on roll call. Moved by Washburn, seconded by Riley that the following payrolls be allowed and the City Clerk authorized to issue warrants as follows: Irrigation x$174.90; Water Dept. $506.5.5: carried, Riley, Washburn and. Clark voting aye on roll call. nESOLUTION NO. 0-326, A RESOLUTION authorizing the sale of the following described real estate: Beginning.1.67.5 feet west and 558.4 feet north of the southeast corner of the East 1/2 of the Southwest. 1/4 of the Southeast 1/4 of the South- east 1/4 of Section 23,'Township 13 North, Range 18, E. W. M:-, thence west 142.5 feet, thence north 72 feet, thence east 142.5 feet, thence south 72 feet to beginning. . WHEREAS, the City of Yakima is the owner -of the following de- scribed real estate situated in Yakima County, State of Washington, to-wit: Beginning 167.5 feet west and 588.4 feet north of the southeast corner of the East 1/2 of the Southwest 1/4 of the Southeast 1%4 of the South- east 1/4 of Section 23, Township'13 North, Range ' 18, E. W. C =327, BE IT RESOLVED BY THE CITY OF YAKIMA, WASHINGTON: That it is its intention to improve Twenty -fifth Avenue North from Summitview Avenue to Lincoln Avenue by grading and widening the existing six inch one course pavement to a width of 24 feet, and by constructing the necessary curbs and walks and by doing all such other work in connection therewith as may be necessary. That the district to be served by and assessed for the above described improvement is described as follows, to -wit: Beginning at the intersection of the east line of Twenty -fifth Avenue North with the north line of Summitview Avenue; thence easterly along said north line a. distance of 140.5 feet; thence northerly parallel with Twenty -fifth Avenue North to the south line of Lincoln Avenue; thence westerly along said south line to a point 140.5 feet west of the west line of Twenty -fifth Avenue North; thence southerly parallel with said west line to the north.line of Summitview Avenue; thence easterly along said north line to point of beginning; the above improvement to be-constructed in fullaccordance with the plans and specifi- cations to be prepared by the City Engineer and filed with the City Clerk. All persons who may desir.e to object to said proposed improvement are hereby notified to appear and present such objection, if any, at a meeting of the City Commission to be held at its 'office kin the. City Hall.-in the City of Yakima, Yaakima County, Washington, at the hour of ten o'clock A. M., on Monday, the 23rd day of May, 1938, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of Cl May 2. 1938 payment -therefor; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. All costa and expenses in connection with the construction of said improvement including engineering, inspection, advertising, publication of notices and all other expenses incident thereto shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other in- formation required by law to be -by him submitted. B -302,- entitled, 'SAN ORDINANCE fixing the time of delinquency of Install- ments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 52 -1, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof ", was introduced by Riley and read by the City Clerk. Moved by Clark, - seconded by Washburn that Ordinance No. B -302 be passed to its second reading and read by title only: carried, Riley, Washburn end Clark voting aye on roll call. Moved by Riley, seconded by Washburn that this being the time for receiving bids for paving West Yakima Avenue from Grandview Avenue,to Hillcrest Avenue in Local Improve- ment District No. 526, the following were received: J. B. Covello $12,370.00; H. J. Adler Construction Company $11,723.00; J. M. DeBlasio $10,823.72; Thomas Dingle $9,938.55; Ma.cri Bros. $11,579.65: it is ordered that the final award of the contract be made at 11 :30 A. Cable, in the sum of $2,893.15 for constructing a Care Taker's House at Oak Flats for the Water Department is hereby accepted as the lowest and best bid for .doing said work and the Mayor and City Clerk are.hereb,y instructed to enter into a contract on behalf of the City of Yakima with said contractor upon his filing the proper bond as required by law: car- ried, Riley, Washburn and Clark voting aye on roll call. Moved by Washburn, seconded by Clark that the bond of Thos. Dingle in the sum of $9,938.55 for paving West Yakima Avenue from Grandview Avenue to Hillcrest Avenue in Local Improvement District No. 526 is hereby approved and placed on file with the City Clerk: carried, Riley, Washburn and Clark voting aye on roll call. C -327A, WHEREAS, the City of Yakima is now engaged in an extensive oil- ing and gravelling program for our city streets, necesitating the purchase of large quantities of crushed rock, and WHEREAS, Fred G. Redmon has agreed to furnish the City of Yakima a complete crushing plant installed upon property now owned by-the City of Yakima at a. price of $8,750.00, NOW, THEREFORE, BE IT RESOLVED that the City- of Yakima purchase said crushing plant for said $8,750.00, payable as follows: $3,750.00 on or before October 15, 1938 and the balance of $5,000.00 to be made in two equal payments, $2,500.00 on or before September 1, 1939 and $2,500.00 on or before.September 1, 1940. The City of Yakima shall furnish Fred.. G. Redmon crushed rock from the bunker or stock pile at said crushing plant at a price of sixty -five cents per cubic .yard and such punccases of crushed rock at .this price before September 1, 1939 may be ,deducted by the City of Yakima. from ":the payments due on said plant. An emergency exists requiring the immediate acquisition of this plant and this declaration is made for the purpose of complying with Section 6 of Arti- cle 6 of the City Charter.
