Moved by Clark, seconded by Washburn that this being the time for the hearing on
Resolution No. C -310 for the construction of an irrigation system in property'-located
in Leaming's Addition and other property in the City of Yakima and there being insuf-
ficient protest by the Property owners in said district against said improvement or
any part thereof; it is hereby ordered that the ordinance creating a local improvement
district be passed as finally read: carried, Riley, Washburn and Clark voting aye on
roll call.

Leaming's Addition, L.I.D. No. 528; said bids to be received on- Monday, April 4th,

ORDINANCE NO. B -291, entitled, "AN-ORDINANCE providing for the improvement of property
In the City of Yakima, Washington, by constructing the necessary pipe lines and appur-
tenances and acquiring the necessary water and water rights to supply various lots and
tracts of land with water for irrigation purposes;.establishing a local improvement
district, providing for the method of payment therefor and creating a. speciallfund",
was introduced by Washburn and read by the City Clerk.

property:

northeast corner of the Northwest 1/4 of Section 30,
Township 13 North, Range.19, E. W. M., thence south
24o 18' east a distance of 50 feet to the true point
of beginning; thence south 240 18' east 217.42 feet;

and conditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COIUMISSION OF THE
CITY OF YAKILIA, WASHINGTON:
That said above described premises be and they are hereby author-
ized to be sold to INLAND STATE LUMBER CO., INC., a" corporation, for the total sum of
Twenty -one Hundred and No /100 ($2100.00) Dollars, payable as follows: the sum of One
Hundred Ninety -four and No /100 ($194.00) Dollars in cash upon the execution of the con-
tract herein authorized and the balance of Nineteen Hundred Six and No /100 ($1906.00)
Dollars in monthly payments of Forty and No /100 ($40.00) Dollars, beginning April 1,
1938, and continuing until the entire amount has been paid. All deferred payments to
bear interest at the rate of six per cent per annum payable monthly with principal pay-
ments.
The purchaser under said contract shall also agree to pay all
assessments against said premises'f alling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said prem-
ises, and the Mayor and City Clerk of said City are hereby authorized and directed to
enter into a contract in du0licate with said purchaser under the terms hereinabove set
forth.
Said agreement to be entered into shall also contain suitable
provisions requiring any buildings upon said premises to be insured at the expense
of the second parties in a solvent insurance company satisfactory to first party as
its interest may appear and shall containea provision that in case of destruction of
or damage to any buildings or improvements on said premises such.da.mage or loss shall
b e the-loss of second parties and shall not be a. ground for rescission of said con-
tract; and said contract shall also contain a suitable provision providing for for-
feiture thereof.upon failure of second party to make any payment of principal, interest,
taxes or assessments therein provided for when same shall become due or delinquent,
notice of such forfeiture to be for 30 days and service thereof to be by serving same
personally upon second parties or by mailing to them at Ya,kima., Washington, and a fur-
ther provision shall be placed therein that upon final payment of said principal and
interest and taxes and assessments the first party shall. convey said premises to sec-
ond parties by a good and sufficient Quit Claim Deed conveying all the interest said
City of Yakima. has now in said premises; and thefUrther provision shall be contained
in said contract against the assignment of second parties without the consent of first-
party had and obtained.

of the construction of a, sidewalk on the east side of North 4th Street from "F" Street
to North Avenue, L.I.D. No. 525, in the sum of $1,218.22; said improvement is hereby
accepted and the City Engineer authorized to prepare an assessment roll therefor and
the City Clerk directed to give notice of.heari.ng on said roll for Monday, April 18th,
1938 at 10 o'clock A. M: carried, Riley, Washburn and Clark voting aye on roll call.
