Moved by Riley, seconded by Washburn that the minutes of the regular meeting of Monday, January 3rd, 1938 and adjourned meeting thereof be approved as read: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark, seconded by Washburn that this being the time for the hearing on the assessment roll for Local Improvement District No. 517 for the construction of a .sewer in Block 128, and there being no protests in writing or otherwise to said assessment roll or any part thereof; it is ordered that the ordinance confirming said assessment roll and every part thereof be passed as finally read: carried, Riley, Washburn and Clark voting aye on roll call'; ORDINANCE NO. B -268, entitled, "AN ORDINANCE confirming the assessment roll covering Local Improvement :District No. 517, as created and established by Ordinance No. B -248 of the ordinances of.the City of Yakima ", was introduced by Clark and read by the City Clerk. Moved by Washburn, seconded by Riley that Ordinance No. B -268 be passed to its second reading and read by title only: carried, Riley, Washburn and Clark voting aye on roll call. C -302, BE IT RESOLVED BY THE CITY COMMIS INGTON: B -268 be passed to its third Clark voting aye on roll cell. B -268 be passed as finally roll call. BION OF THE CITY OF YAKIMA, WASH- That it is its intention to construct an irrigation system to serve all the lots, blocks and parcels of land included within the real estate herein- after described, said improvement to consist of acquiring of right of way ea.semetts, and the completion of the necessary mains, laterals, service connections and other ap- purtenances for the purpose of delivering water for irrigation purposes to each lot and tract of land within the proposed district. That the district to be served by and assessed for the above de- scribed improvement is described as follows, to -wit: Beginning at the intersection of 28th Avenue North with West Yakima Avenue; thence northerly along 28th Avenue North to Summitview Avenue; thence easterly along Summitview Avenue to 27th Avenue North; thence northerly along 27th Avenue North to Lincoln Avenue; thence-westerly along Lincoln Avenue to 28th Avenue North; thence southerly along 28th Avenue North to Summit - view Avenue; thence westerly along Summitview Avenue to 30th Avenue North; thence southerly along 30th Avenue North to Barge Street; thence westerly along Barge Street to the northwest corner of Lot 10 Grandview - Yakima Avenue Home Tracts; thence southerly along the west line of Lots 10, 11 and 12 to the northeast corner of Lot 15 of said addition; thence westerly to Grandview Avenue; thence southerly to West Yakima Avenue; thence easterly along West Yakima Avenue to the point of beginning. Said district includes Lots 10 to 23 of Grandview - Yakima Avenue Home Tracts, Lots 1 to 25 of Block 1 Highland Home Tracts, Lots 1 to 10, inclusive, of 30th Avenue Addition, Lots 1 to 9, inclusive of Schmidt Orchard Co. Addition, and Lots 1 to 40 of Hamberg's Addition, all in the City of Yakima., Washington; the above irrigation'system to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed Improve- ment are hereby notified to appear and present such objection, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of-ten o'clock A. M., on Monday, the 31st day of January, 1938, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment therefor; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement shall be borne by and assessed against all of the property legally and properly assessable therefor as pro- vided by law and as above described; and the City Engineer is hereby directed to sub- mit to the City Commission at or prior to the date fixed herein for said hearing, all of the d.a.ta and other information required by law to be by him submitted. Moved by Clark, seconded by Washburn that Resolution No. C -302 be adopted as read: January 10, 1936 carried, Riley, Washburn and Clark voting aye on roll call. RESOLUTION NO. C•303, A RESOLUTION, authorizing the execution of an agreement between the OREGON - WASHINGTON RAILROAD & NAVIGATION COMPANY, an Oregon corporation, and the City of Yakima, a Municipal corporation of the.State of Washingtin, granting to the City of Yakima the right to attach eye bolts to the Northerly wall of said Railroad Company's office building, located oh the Southwesterly corner of Yakima and First Avenue South in the City of Yakima, for the purpose of suspending automatic traffic signals thereto. WHEREAS, the City of Yakima, did on April 10,. 1928 enter into an agreement with said Oregon - Washington Railroad. & Navigation Company, wherein the said Railroad Company granted to the City-of Yakima the right to attach eye bolts to the Northerly wall of said Railroad Company's office building located on the South- westerly corner of Yakima and First Avenue South in the City of Yakima for the purpose of suspending automatic traffic signals thereto; WHEREAS, said agreement expired on.December 31, 1937, and WHEREAS, it is necessary that a. new agreement be executed between the parties covering the period from December 31, 1937, to and including December 31, 1942;. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF YAKIMA: That the Mayor and.City Clerk of said City of Yakima, are here- by authorized to execute said agreement on behalf of the City of Yakima and deliver copies thereof to the said Oregon - Washington Railroad & NAvigation Company. Moved by Clark, seconded by Washburn that the City Engineer having reported the com- pletion of the construction of a domestic water system in Local Improvement District No. 524 by the contractor in the sum of $2,06g.96, said improvement is hereby accepted and the City Engineer authorized to prepare an assessment roll for said district and the City Clerk directed to give notice of hearing on said roll for Monday, February 7th, 1938 at 10 o'clock A.
