Moved by Temple, seconded by Washburn that the minutes of the regular meeting of Monday, October 7th, 1935 and adjourned meetings thereof be approved as read: carried, Temple, Washburn and Clark voting aye on roll call. RESOLUTION NO. 0-158, A RESOLUTION authorizing the sale of Beginning at a point 30' souih.and 252.43' west of the North 4 corner of Section 30 Township 13 North, Faa.nge 19 east, W. M. thence S 240 19' E 50' thence southwesterly at right angles to the west lin of. South Second Street a distance of 140' thence N 24° 18.' W and parallel to said Street to the south line of Pacific Avenue, thence East along said south line to the point of beginning, to M. H. Grochow and Anna Grochow, husband and wife. WHEREAS, the City of Yakima is the owner of the following describ= ed real property situated in Yakima, Yakima County, Washington, to -wit: Beginning at point 30' south and 252.43' west of the North I corner of Section 30, Township 13 North, Range 19, E. W. M. thence S 240 18' E 501, thence southwesterly at right angles to the west line of South Second Street a distance of 140' thence N 246 18' W and parallel to the said Street to the south line of Pacific Avenue, thence East along said south line to the point of beginning. WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to M. H. Grochow and Anna Grochow, husband and wife, upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That said above described premises be and they are hereby author- ized to be sold to M. H; Grochow and Anna Grochow, husband and wife, for the total sum of Seven Hundred and No /100 Dollars, payable as follows: the'sum of One Hundred Fifty and No /100 Dollars in cash upon the execution of the contract herein authorized and the balance of Five Hundred Fifty Dollars in annual payments of One Hundred Eighty -:five Dollars, beginning October 10, 1936, and continuing until the entire amount has been paid. All deferred payments to bear interest at the rate of six per cent per annum payable monthly with principal payments. The purchaser under said contract shall also agree to pay all assessments against said premises falling due under any Local Improvement District or Districts hereafter created or arising from levies hereafter placed against said premise and the Mayor and City .Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable provisions requiring any buildings upon said premises to-be insured at the expense of. the second parties in a solvent insurance company satisfactory to first party as its interest may appear and shall contain a provision that in case of destruction of or damage to any buildings or improvements on said premises such damage or loss shall be the loss of second parties and shall not be a ground for rescission of said contract; and said contract shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make any payment of principal, interest, taxes of assessments therein provided for when same shall become due or delinquent, notice of such forfeiture to be for 30 days and service thereof to be by serving same personall upon second parties or by mailing to them at Yakima, Washington, and a further provision shall be placed therein that upon final payment.of said principal and interest and taxes and assessments the first party shall convey said premises to second parties by a good and sufficient Quit Claire Deed conveying all the interest said City of Yakima has now in said premises; and the further provision shall be contained in said contract against the assignment of second parties.without the consent of first party had and obtained. C -159, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That it is its intention to improve that ceitain property herein- after described, by constructing pipe sewers with the necessary wye branches, manholes, flush tanks and water connections-therefor, located as follows: Beginning at the existing trunk sewer on East Beech Street at the alley just east of South Naches Avenue; thence northwesterly along said alley to East C Street; thence southwesterly along East C Street and West C Street to First Avenue North. The district to be served by and assessed-for-the above described II improvement is described as follows, to -wit: Beginning at the intersection of South Naches Avenue with East Beech Street; thence north- westerly along South Naches Avenue and North F, 1.94 Naches Avenue to East C Street; .thence north - easterly along East C Street to North Sixth Street; thence southeasterly along North Sixth Street and South Sixth Street to East Beech Street; thence southwesterly along East Beech Street to the point of.beginning; the above described sewers to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improvement are hereby notified to appear and.present such objection, if any, at a meeting of the_ City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington., at the hour of nine o'clock A.'M., on Monday, the 4th day of Novem- ber, 1935, * which time and place are hereby fixed for the hearing of all matters relat- ing to said proposed improvement or objections thereto, and for determining the method of payment therefor; and the City Clerk is hereby directed to give due notice of said hearing and of the intention'to make the aforesaid improvement. C -160, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That it is its intention to improve that certain property herein- after described, by constructing pipe sewers with the necessary wye branches, manholes, flush tanks and water connections therefor, located as follows: Beginning on Lincoln Avenue at a point 140.5 feet west of the west line of Twenty Fourth Avenue North, said point being the terminus of the sewer heretofore constructed on Lincoln Avenue; thence west along Lincoln Avenue to the west line of the east half of the west half of the southeast quarter of the northwest quarter of Section 23, Township 13 North, Range 18, E. W. M., thence south along said subdivision line 200.8 feet; thence west parallel with Lincoln Avenue 331. feet, more or less, to the west line of the southeast quarter of the north- west quarter of Section 23; Township 13 North, Range 18, E. W. M.; thence southwesterly to a point on the west line of the east half of the east half of the southwest quarter of the-north- west quarter of Section 23, Township 13 North, Range 18, E. W. M., 690 feet north of the north line of Summitview Avenue; thence south along said subdivision to Summitview Avenue; Also beginning at a point on Summitview Avenue 25 feet west of the west line of 28th Avenue North; thence west along Summitview Avenue to the east line of Thirtieth Avenue Addition; thence south along said east line to Barge Street; Also beginning at a point on Barge Street 25 feet west of the west line of.28th Avenue North; thence west along Barge Street,to a point 25 feet east of the east line-of Grandview Avenue; Also beginning at the intersection of Barge Street and 30th Avenue North; thence south along 30th Avenue to a point midway between Barge Street and West Yakima Avenue; Also beginning.at a point on the west line of. 28th Avenue North midway between Barge Street and West Yakima Avenue; thence west parallel with West Yakima Avenue to a point 25 feet east of. the east line of Grandview Avenue; - Also beginning at a point on the east line of Thirtieth Avenue Addition 303 feet south of Summitview Avenue; thence east parallel with Summitview Avenue to a point 25 feet west of the west line of 28th Avenue North; Also beginning at a point on Lincoln Avenue 140 feet west of the west line of 26th Avenue North; thence south parallel with 26th Avenue North to Summitview Avenue. 1 The cost and expense of said improvement shall be borne by and assessed against all of the property legally and properly assessable therefor as pro- vided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by'him submitted. M., on Monday, the 4th day of No- vember, 1935, which time and place are hereby fixed for the hearing of all matters re- lating to said proposed improvement or objections thereto, and for determining the method of payment therefor; and the.City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. C -161, BE .IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That it is its intention to improve the alley in Block Four (4) of Inglewood Addition, and said alley.extended northerly from Bonnie Doon Avenue to a point 457 feet north of the same, by grading and paving the same with a one course portland cement concrete pavement twenty feet in width, and by doing all such other work as may be necessary in connection therewith, all in accordance with the plans and' specifications therefor, to be prepared by the City Engineer and filed with the- City Clerk. The district to be served by and assessed for the above described improvement is the territory directly contiguous to said alley improvement. All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objection, if'any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of two o'clock P. M., on Monday, the 4th day of Novem- ber, 1935, which time and place are hereby fixed for the hearingof all matters relating to said, proposed improvement or objections thereto, and for determining the method of payment therefor;.and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement.
