The City Commission met in regular session, Mayor Mogren and Commissioners White and
Clark present on roll call.
Moved by Mogren, seconded by White that the minutes of t.he.regular meeting of Monday,
April 17, 1944 be approved as read: carried, Mogren, White and Clark voting aye on
roll call..
Moved by Mogren, seconded by White that the Mayor and City Clerk are hereby authorized
to give notice in writing to Lyle Tomlinson and Viola. I. Tomlinson husband and Wife for
cancellation and forfeiture of Real Estate contract for the following described propert
to wit: Begining 27' east and 115 feet South of the Northwest corner of Northeast
Quarter of Northwest Quarter of Northeast Quarter, Section 24, Township 13 North, Range
18, E. W. M., thence east 10 feet, south 5$ feet, west 105 feet, north 58 feet to
beginning. (City Tract 194 -b): carried, Mogren, White and Clark voting aye on roll cal
RESOLUTION NO. C -608, A RESOLUTION authorizing the sale of Lot 32, Lincoln Addition to
North Yakima. (now Yakima.),.
WHEREAS, the City of Yakima is the owner of the following descri
ed real property situated in Yakima., Yakima County, Wa.shington,•to wit:
Lot 32, Lincoln Addition to North. Yakima (now Yakima),
according to the official plat thereof now on file and of record in the office of the
Auditor of Yakima County, Washington, by reason of a deed therefor issued by' the
Treasurer of Yakima. County, County of Yakima, State of Washington, to said City of
Yakima, on sale of said property for delinquent taxes, and
WHEREAS, it appears to be for the best interest of said City of
Yakima to sell said premises to Fred L. Mc Neill and Vera. G. McNeill, husband and wife
upon the terms and conditions hereinafter set forth.
NOW,THEREFORE, BE IT RESOLVED BY THE.CITY COMMISSION OF THE CITY
OF YAKIMA, WASHINGTON:
That said above described premises be and they are hereby author -
ized to be sold to Fred L. McNeill and Vera G. Mc Neill, husband and wife for the total
sum of One Hundred Twenty -five and no /100 ($125.00 Dollars, payable as follows: the
sum of Twenty -five and no /100 ($25.00) Dollars in cash upon the execution of the con =.
tract herein authorized and the balance of One Hundred and no /100 ($100.00) Dollars in
monthly payments of five and no /100 ($5.00) Dollars, beginning May a4, 1944, and con-
tinuing until the entire amount has been paid. All deferred.nayments to bear interest
at the rate of six per cent per annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said
premises, and the Mayor and City Clerk of said City are hereby authorized and _directed
to enter into a.contract in duplicate with said purchaser*under' the terms hereinabove
set forth.
Said agreement to.be entered into shall also contain suitable
provisions requiring any buildings upon said premises to be insured at the expense of
the second parties in a solvent insurance company satisfactory to first party as its
interest may appear and. shall contain a provision that in case of destruction of or
damage to any buildings or improvements on said premises such damage or lose shall be
the loss of second parties and shall not be a. ground for rescission of said contract;
and said contract shall also contain a suitable provision providing for forfeiture ther -
of upon failure of second party to make any payment of principal, interest, taxes or
assessments therein nrovided.for wheh same shall become due or delinq_uent,.notice of
su,dh forfeiture to be for 30 days and service thereof to be by serving same personally
upon second parties or by mailing to them at Yakima, Washington, and a further provisio
shall_ be placed therein that upon final payment of said principal and interest and. tax-
es a_rd. assessments the first party shall convey said.1nremises to second parties by a

600 feet southeasterly from the intersection with the south line
or Pacific Avenue, thence northeasterly 285.3 feet to UYesterly
line of South Second Street, thence south 24°18' east 89.12 feet,
thence south 126.82 feet, thence west 257.82 feet to east line
of south First Street, thence northwesterly along east line of
south First Street 98.7 feet to beginning, all in Section 30,
Township 13 North, Range 19, E.W.M. (Tract 220 j- k -1 -s)
by reason of a, deed issued by the Treasurer of the City of Yakima, County of Yakima,

That said above described premises be and they are hereby author-
ized to be sold to Fred Noel a.n•'unmarried man, for the total sum of Ninety —eight
Hundred and no /100 ($9800.00 Dollars, and the Mayor, A. W. Mogren, is hereby author-
ized to execute a deed to said premises, and the City Clerk, Pearl Benjamin, is hereby
authorized and directed to attest the same for and on behalf of the said City of
Yakima.
ADOPTED BY THE CITY COMMISSION, signed and approved, this 24th
day of April, 1944.
