The City Commission met in regular session, Mayor Mogren and Commissioner Clark
present on roll call, Commissioner White absent.
Moved by Mogren, seconded by Clark that the minutes of the regular meetd.ng of Monday,
October. 4, 1943 be approved as read:ea.rried., Mogren, and Clark voting aye on roll
call, White absent.
ORDINANCE NO, B -596, entitled, 10AN ORDINANCE providing for the vacation of that
portion of South First Avenue from the south line of Walnut Street to the North
line of Pine Street, and providing for the time of closing thereof", was intro-
duced by Mogren and read by the City Clerk.
Moved by Clark, seconded by Mogren that Ordinance No. B -596 be passed to its second
reading and read by title only: carried, Mogren and Clark, voting aye on roll call,
_ White absent.
Moved by Clark, seconded by Mogren that Ordinance No. B -596 be passed to its third

Moved by Mogren, seconded by Clark that Gladys H. Richter be appointed to the office
of Deputy City Treasurer to succeed Mary 0. Campbell, resigned; said. appointment to

Commission: carried, Mogren and Clark voting aye on roll call, White absent.
Moved.by Mogren, seconded by Clark that Jeanne Quist be appointed to the office of
cashier in the City Treasurer's Office; said appointment to take effect, October 11th,
1943, and to continue during the pleasure of the City Commission: carried, Mogren
and Clark voting aye on roll tail, White Absent.
Moved by Mogren, seconded by Clark that we do now adjourn to Meet Wednesday, October

RESOLUTION NO. 0-582, A HESOLUTION authorizing the sale of the east 57.5 feet of
`the west 580 feet of the south 90 feet of the north 120 feet; and the east 57.5 feet
of the west 522.5 feet of the south 90 feet of the north 120.feet; and the ea.st.57
feet of the west 301 feet of the south 90 feet of the north 120 feet; and the east 57
feet of the west 244 feet of the south 90 feet of the north 120 feet; and the east
57 feet of the west 187 feet of the south 90 feet of the north 120 feet; all in the
Northwest 1/4 of the Southwest 1/4 of Section 24, Township 13 North, Range 18, E.W.M.
WHEREAS, The City of Yakima is the owner of the following
described real property situated in Yakima, Yakima County, Washington, to -wit:

Auditor of Yakima. County, Washington, by reason of a deed therefor issued by the
Treasurer of the City of Yakima, County of Yakima, State of Washington, to said City
of Yakima, on sale of said property for delinquent assessments, and
WHEREAS, it-appears to be for the best interest of said City of
Yakima to sell said premises to Harold C. Lamb, Lorena R. Lamb, H. Clark Lamb, and
Arleen Lamb, co- partners, doing business as Lamb Fruit Co. upon, -the terms and condi-
tions herinafter set forth.
NOW, THEREFORE, BE-.IT RESOLVED BY THE,CITY COMMISSION OF THE
CITY OF YAKIMA, WASHINGTON:
That said above described premises be and they are hereby
authorized to be sold to Harold C. Lamb, Lorena R. Lamb, H. Clark Lamb, and Arleen
Lamb, co- partners, doing business as Lamb Fruit Co. for the total sum of Fifteen
Hundred and no/ 100----= i.$1500.00) - - - -- dollars, payable as-follows: the sum of Three
Hundred and no /100 - - - -- ($300.00) - - - -- dollars in cash upon the execution of -the
_contract herein authorized and the balance of Twelve Hundred and no /100 --- ($1200.00) --
dollars in monthly payments of Thirty -five and. no /100 - - - -- ($35.00)--- -- dollars, begin -
ing November 15, 1943, and continuing until the entire amount has been paid. All de-
ferred payments to bear interest at the rate of six per cent per annum payable monthly
with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies .hereafter placed against said

visions requiring any buildings upon said premises to be insured at the expense of the
second parties in a. solvent insurance company satisfactory to first part as its interest
may appear and shall contain a provision that in case of destruction of or damage to
any buildings or improvements or. said premises such damage or loss shall be the Loss
of second parties and shall not be a ground for rescission of said contract; and said
contract shall also contain a. suitable provision, providing for forfeiture thereof up-
on failure of second party to make any payment of principal, interest, taxes or assess-
ments therein provided for when same shall becomedue or delinquent, notice of such for -.
feiture to be for 30 days and service therof to be. by serving same personally upon
second parties or by mailing to them at Yakima, Wa.shin� ton, and a further provision_
shall be placed therein that upon final payment of said principal and interest-and. ta.x-
es and assessments the first party shall convey said premises to second parties by a
good and sufficient Quit Claim Deed conveying all the interest said City,of Yakima has
now in said premises;.and. the further provision shall be contained in said contract
against the assignment of second parties without the consent of first party had and.

theNortheast 1/14. Section 24, Township 13 North, R.a.rge1&, E.W.M., thence east 105 feet,
south 58 feet, west 105 feet, north 58 feet to beginning. (City Tract 194-b)
WHEREAS, The City of Yakima is the owner of the following des-
cribed real property situated in Yakima., YakimaCCount,y,� Washington, to -Tait:
Peginning 27 feet east and 115 feet south of the northwest
corner of the Northeast 1/4 of the'Northwest 1/4 of the
Northeast 1/14 of Section 24, Township 13 North, Range 19
E.W.M., thence east 105 feet, south 59 feet, west 105 feet,

That said above described premise be end they are hereby author -
ized to be sold to Lyle Tomlinson and Viola I. Tomlinson, husband and wife, for the
total sum of Two Hundred Twenty and no /100 (9220.00) Dollars, payable as follows: the
sum of Forty -four and no /100 (14 -4.00) dollars in cash upon the execution of the con-
tract herein authorized and the balance of One Hundred Siventy - six and no /100 ($176.00)
dollars in monthly payments of Five and no /100 ($5.00) dollars, beginning November 15,
1943, and continuing until the entire amount has been paid.. All deferred payments to
bear interest at the rate of six_ per cent per annum payable monthly with principal pay-

ORDINANCE N0: B -597 entitled, "AN ORDINANCE amending Section 10 of Ordinance No.
B - ?96, entitled: "IN ORDINANCE defining milk•and cream and certain products; milk
producer, pasteurization, etc., prohibiting the sale of-adulterated and misbra.nded
milk and milk products, providing for the qualification of the City Milk Inspector
and his deputies, if any, requiring permits and licenses for sale of milk and milk
products, rPgu.la.ting the inspection_ of dairy farms and milk plants, the examination,
grading, labeling, pla.carding, pasteurization, re- grading, distribution and. sale and
denaturing of milk products, providing for the publishing of milk grades, regulating
the construction of future dairies and milk plants and providing a, penalty for viola-
tion hereof and repealing Ordinance No. A- 153, was introduced by Mogren and read by
the City Clerk.
