The Citv Commission met in regular session, Mayor Mogren and Commissioners White and
Clark present on roll call.
Moved by Mogren,.seconded by White that the minutes of the regular meeting of Monday,
February 8, 1943 be approved as read: carried, Mogren, White and Clark voting aye on
roll call.
Moved by White, seconded by Mogren that the following claims be allowed and the City
Clerk authorized to issue warrants as follows: C. E. $41,734.40; City Street $2434.80;
Parks $4.98; Irrigation $2144.45; Cemetery $89/18;F. R;. & P. $187.67; Parking Meter
$41.30; Water $2093.97; Cemetery Trust $35,000.00.: carried, Mogren, White and Clark
voting aye on roll call.
Moved by White, seconded by Mogren that the following payrolls be allowed and the City
Clerk authorized to issue warrants as follows: Sanitation Dept. $985.13; City Street
$1172.49;.Water Dept. $72.10; Irrigation $123.23: carried, Mogren, White and Clark
voting aye on roll call.
Moved by Clark, seconded by White that this -being the'time for receiving bids for the
City Printing for the year 1943, and the bid of -the Republic Publishing Company being
the only bid submitted; it is hereby ordered that said bid in the sum of 55 cents per
column inch be accepted and the Mayor and City Clerk are hereby authorized to enter
into an agreement with the Republic Publishing Company for doing said work: carried,
Mogren, White and Clark voting aye on roll -call.
RESOLUTION NO. C -560, RESOLUTION authorizing and directing temorary transfer and loan
from the Cemetery Trust Fund of the City of Yakima.to the Current.Expense Fund of the
City of Yakima, and providing for rate fo interest thereon and repayment thereof.
WHEREAS, the Current Expense Fund of the City of Yakima has be-
come temporarily depleted and there are outstanding interest- bearing warrants against
the same and said Current Expense Fund is temporarily in need of funds; and
WHEREAS, the Cemetery Trust Fund of the City of Yamima has surplu
funds therein for investment and which funds are not needed at.the present time by said
fund, and it is desirous that said funds be invested at interest; and
WHEREAS, the said . Currest Expense Fund of the City of Yakima- -
has sources of revenue and income which will enable it to seasonably repay a loan in
the amount hereinafter authorized from the Cemetery Trust Fund, with interest, and it
is to the best interests of the City of Yakima that a"temporary transfer and loan be
made from said Cemetery Trust Fund to the said Current Expense Fund, and thus save the
City of Yakima the payment of interest on outstanding warrants and at the same time
invest a part of its Cemetery Trust Fund monies at interest,
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City
of Yakima that there be and there is hereby temporarily loaned and transferred from
the Cemetery Trust Fund of the City of Yakima to the Current Expense Fund of the City
of Yakima the sum of $35,000.00, and that said transfer and loan be made forthwith,
the same to bear interest at the rate of two per cent (2 %) per annum from the date of
such transfer and loan.
BE IT FURTHER RESOLVED by the City Commission of the City of
Yakima that said transfer and loan herein authorized, together with interest thereon,
be repaid by the Current Expense Fund as rapidly and as soon as funds accumulate in
said Current Expense Fund and become available for.that purpose.

day of February, 1943-

RESOLUTION NO. C -561, A. RESOLUTION authoriiin :the sale of West:21/2 of Lots 7 and' g,
Block 175,,�The Home Addition "to North Yakima know Yakima).
WHEREAS, the City of Yakima is the owner of the following de-
scribed real property situated in Yakima, Yakima County, Washington, to -wit:
West 1/2 of Lots 7 and 9, Block 175, The Home
Addition to North Yakima (now Yakima),
according to the official plat thereof now on file and of record in the office of the
Auditor of Yakima County, Washington, by reason of a deed therefor issued by the Treas-
urer of Yakima County, County of Yakima, State of Washington, to said City of Yakima,
on sale of said property for delinquent taxes, and
WHEREAS, it appears to be for the best interest of said City of
Yakima to sell said premises to Stacy Lyons and Isla.L,yons, husband and wife, upon
the terms and conditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA, WASHINGTON:
That said above described premises be and they are hereby author-
ized to be sold to Stacy Lyons and Isla Lyons, husband and wife, for the total sum of
Two Hundred Twent and No /100 ($220.00) Dollars, payable as follows: the sum of Forty -
four and No /100 (44.00) Dollars in cash upon the execution of the contract herein
authorized and the balance of One Hundred Seventy -six and No /100 ($176.00) Dollars in
monthly payments of Five and No /100 ($5.00) Dollars, beginning March 17, 1943, and

continuing until the entire amount has been paid: All deferred payments to bear in-
terest at the rate of six per cent per annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said prem-
ises, and the Mayor and City Clerk of said.City are hereby authorized and .directed to
enter into a contract in duplicate with said purchaser under the terms hereinabove set
forth..
Said agreement to be entered into shall also contain suitable
provisions requiring any buildings upon said premises,to be insured at the expense of
the second parties in a. solvent insurance company satisfactory to first party as its
interest may appear end shall contain a provision that in case of destruction of or
damage to any buildings or improvements(on said premises such damage or loss whall be
the loss of second parties and shall not be aground for rescission of said contract;
and said contract shall also contain a suitable provision providing for forfeiture
thereof upon failure of second party to make any payment of principal, interest, taxes
or assessments therein provided for when some shall become due or delinquent, notice
of such forfeiture to be for 30 days and service thereof to be by serving same per-
sonally upon 'second parties or by mailing t -o them at Yakima, Washington, and a further
provision shall be placed therein that upon final payment of said principal and inter-
est and taxes and assessments the first party shall,convey said premises to second
parties by a good and sufficient Quit Claim Deed conveying all the interest said City
of Yakima has now in-said premises;'and the further provision shall be contained in
said contract against the assignment of second parties without the consent of first
party had an obtained.
