' Move(9 by Riley, seconded by Washburn that the minutes of the regular meeting of Mon- day, December 30, 1940 and adjourned meeting thereof be approved as read: carried, Riley, Washburn and Clark voting aye on roll call. RESOLUTION NO. C -491, A RESOLUTION complaining and protesting against the action of the Department of Public Service of Washington in passing on all occupational, franchis and similar municipal charges, as specified in its.supplemental order of December 17, 1940, issued in cause No. FH7229, entitled "The Department of Public Service of Wash- ington v. Pacific Telephone & Telegraph Co. ", and requesting a re- hearing and revoca- tion of effective date of supplemental order`.. WHEREAS, the City of Yakima, and its City Commission, believe that the supplemental order issued by the Department of Public Service of the State of Washington, on December 17, 1940, in cause No. FH7229, entitled "The Department of Public Service of Washington v. Pacific Telephone & Telegraph Co. ", authorizing the Pacific Telephone & Telegraph Co., to pass on all occupational, franchise and similar municipal charges, is contrary to law, and is unfair and unreasonable; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF YAKIMA: That on behalf of the citizens of Yakima, it protests and compaains against the action of the Department of Public Service of Washington in passing on all occupational, franchise and similar municipal charges as specified in its supplemental order of December 17, 1040, and requests said department to grant a re- hearing of said supplemental order and to revoke the effective date thereof, in order that complainant and others inter- ested may be heard thereon, and upon such hearing to revoke said order in that regard. Moved by Washburn; seconded by Riley that Ordinance No. B -496 be passed to its third reading and read in full: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Riley, seconded by Clark that we do now adjourn: carried, Riley, Washburn and Clark voting aye on roll call. BE IT FURTHER RESOLVED that the City Attorney of the City of Yakima be, and he is hereby authorized and directed to prosecute the complaint and re- quest herein made and to appearat such hearings as may be granted pursuant . thereto, and to cause review of said order if same be not revoked. BE IT FURTHER RESOLVED that the City Clerk forthwith transmit by mail a. certified copy of this resolution to the Department of Public Service of _May Washington. Moved by Clark, seconded by Washburn that this bean the time for the hearing on the assessment roll in Local Improvement District No. 596, and there being no objections in writing or otherwise to said assessment, or any part thereof; it is ordered that the ordinance confirming said assessment roll and every part thereof, be passed as finally read: carried, Riley, Washburn and Clark voting aye on roll call. ORDINANCE NO. B -496, entitled, "AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 566, as created and established by Ordinance No. B -451 of the ordinances of the City of Yakima ", was introduced by Clark and read by the City Clerk. Moved by Washburn, seconded by Riley that Ordinance No. B -496 be passed to its second reading and read by title only: carried, Riley, Washburn and Clark voting.aye on roll call.
