HomeMy WebLinkAbout12/07/1964 Business Meeting1 1 1 f' 611 DECEMBER 7, 1964 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lambert, and Lynch, City Manager Smith and Citv Attorney Andrews present on roll call: Robinson absent on roll call and until 3:20 P.M. after which time he was present for the balance of the meeting. (Councilman Wray Brown appointed 11/30/64 will be formally seated as a member of the Council on December 14, 1964) Councilman Brazier gave the invocation. The minutes of the regular meeting of November 30, 1964 having been read and certified accurate by two councilmen and no one present wishing said minutes read publicly, Mayor Larson declared them approved as recorded. In accordance with action taken by the "ity Council on November 30, 1964 and a Board of Review hearing having been held on December 1, 1964 on Petition No. 294 as filed by Lester 0. Beaver and others praying for the annexation of certain property in the Tri -Skool Addition and there being no protests in writing or otherwise, it was MOVED by Brazier, seconded by Kurbitz that Ordinance No. 595 providing for said annexation and zoning said property as R -2, Two- Family Zone, be passed as read: carried, Brazier, Kurbitz, Lambert Larson and Lynch voting aye on roll call. Robinson absent. Mr. Howard Hettinger, Attorney representing Lester 0. Beaver, Petitioner, in- dicated that while his client had req.tested that certain lots be zoned R -1 and the balance zoned R -2, but if the City Council is happy with R -2, Two - Family Zone as provided for in Ordinance No. 595, his client will accept and approve this zoning, R -2, Two - Family Zone. ORDINANCE NO. 595, AN-ORDINANCE-providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning the same as R -2, Two - Family Zone. This being the time fixed for the hearing on Resolution No. D -751 being a resolution of intention to improve certain-'property by constructing a domestic water:-system for Grant Street between 18th and 20th Avenues ; arid- there" being no protests in writing or otherwise, it was MOVED by Brazier, seconded by.Lynch that Ordinance No. 596 providing for said improvement and creating L.I.D. No. 931, be passed as read: carried, Brazier, Kurbitz, Lamberts Larson, and Lynch voting aye on roll call. Robinson absent. Mr. Wayne Nott a petitioner was present and asked questions regarding the cost of the system but did not protest the estimated cost as submitted to him for his propert; ORDINANCE NO. 596, AN ORDINANCE providing for the improvement of certain property by constructs the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use -and fire protection; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. r This being the time fixed for the hearing on Resolution No. D -752 being a resolution of intention to improve certain property by constructing concrete .curbs and gutters and the surfacing of Walnut Street from South 40th Avenue to approximately 264 feet East and creating L.I.D. No. 932, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Robinson absent. ORDINANCE NO. 597, AN ORDINANCE providing for the improvement of.certain.property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. Petition No. 324 having been filed with the City Clerk on December 3, 1964 by Lester 0. Beaver, requesting the formation of a local improvement district for the construction of a sewer in the Tri -Skool Additio -n, it was MOVED by Lynch, seconded by Lambert that said petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson and Lynch voting aye on roll call. Robinson absent. C ouncilman Robinson present for the balance of this meeting. Moved by Brazier, seconded by Robinson. that Ordinance No. 598 annexing certain property to the City of Yakima and amending Ordinance No. 558 which amends Ordinance No. 545, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Dis- cussion indicated that this ordinance further corrects the property description of certain city owned property located at the Yakima Municipal Airport and annexed by Ordinance No. 545 and 558. ORDINANCE NO. 598$ AN ORDINANCE annexing property to the City of Yakima, and amending Section 1 of.Ordinance No. 558, passed August 17, 1964, entitled "An Ordinance annexing property to the City of Yakima, and amending Section 1 of Ordinance No. 545, passed July 27, 1964, entitled "An Ordinance annexing property to the City of Yakima; and declaring an emergency "; and declaring an emergency. Moved by Robinson, sec nded by Lynch that Ordinance No. 599 fixing the time of delinquency and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion of L.I.D..No. 903, Peach Ten and Various Others Streets & Alley Paving District, be passed as read carried, Brazier, Kurbitz, Lambert, Lynch and Robinson voting aye on roll call. ORDINANCE N0. 599, AN ORDINANCE fixing the time of delinquency of installments of assessments levies for the payment of the cost of the improvement in Local Improvement District No..903, and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. The Planning Commission reporting on Petition No. 313 as filed by Albert B. Kurbitz praying for the annexation of property located at the northeast corner of the intersection of Fruitvale B Boulevard and Wright Avenue and further recommending that said property be zoned B -3, and the Board of Review hearing having been waived since this property is less than 10 acres and less than $200,000.00 valuation, it was MOVED by Robinson, seconded by Lambert that said Petition be approved as meeting the requirements of law and that an order be prepared fixing December 21, 1964 at the hour of 8:00 P.M. as the time for a public hearing by the City Council: carried, Brazier; Kurbitz, Lambert, Lynch and Robinson voting aye on roll call. Udell and others praying for the annexation of property located- southwest of the Old Power House Road and northwest of Edgecliff Manor and further recommending that said property be zoned as R -3, Multiple Family zone, and the Annexation Review Board }hfay.ing approved said annexation, it was MOVED by Lynch, seconded by Kurbitz that said petition No. 314 as filed by Mr. Udell, r 612 DECEMBER 7 , . 1964 Mr. Baker and others, be approved as meeting the requirement of law and that the order be pre- pared fixing December 21, 1964 at the hour of 8:00 P.M. as the time for a p ublic hearing by the City Council: carried, Brazier, Kurbitz, Lambert, Lynch and Robinson voting aye on roll call. CH 2 M, Consulting Engineers for the Sewage Treatment Plant, Additions, reporting on said project and submit.tin Estimate No. 7 in the amount of $134,712.51 for payment to G. R. Leischner Construction Estimate the contractor, and the City Manager and Public Works Director recommending payment of same, it was MOVED BY Robinson, seconded by Lynch that said report dated December 1, .1964 with respect to the :progress on this project be approved and the progress estimate therein sE forth be approved and payment of same authorized: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. He also reported that plans are being made for the dedication of the Lenox Overpass, ceremonies to take place on December 17, 1964 at the hour of 2:15 P.M. at the West approach.
