BUSINESS MEETING OF THE CITY COUNCIL
2:00 P.M. - 129 NORTH 2 ND STREET - COUNCIL CHAMBERS
1. ROLL CALL
Present:
Council: Mayor Mary Place, presiding, Council Members Clarence Barnett,
Henry Beauchamp, Lynn Buchanan, Larry Mattson, John Puccinelli,
and Bernard Sims
Staff: City Manager Zais, City Attorney Paolella and City Clerk Roberts
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Invocation was given by Council Member Puccinelli, followed by the Pledge
of Allegiance led by Council Member Mattson.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER /SPECIAL
PRESENTATION
A. PROCLAMATIONS
• PROSTATE CANCER AWARENESS MONTH
• Council Member Buchanan, on behalf of the Mayor, read a proclamation
declaring September 2001 as Prostate .Cancer Awareness Month. Glenn
Rice, Assistant City Manager, accepted the proclamation.
B. SPECIAL PRESENTATION: CHRIS BORR FROM PROVIDENCE HEALTH
SYSTEM RE: YAKIMA COUNTY CHILD ABDUCTION NOTIFICATION
PLAN (Y -CAN)
Chris Borr from Providence Health introduced Sgt. Mike DePalma with the
Washington State Patrol Missing & Exploited Children's Task Force, and
Susan Wagner, the Missing Children's Clearing House Coordinator for the
State Patrol. He described the new Yakima County Child Abduction
Notification Plan (Y -CAN) that is being enthusiastically supported by all local
law enforcement agencies and all media. With their support this plan will get
information out to the public quickly to help with the recovery of abducted
children. Mr. Borr emphasized that this plan utilizes existing resources and,
therefore, carries no cost. He said the "Go Live" date will be September 13,
2001 and the Lt. Governor will be in town to make a proclamation.

C. YARD OF THE MONTH PRESENTATION
Lynn Quesenbury, Parks and Recreation Administrative Specialist, announced
the Yard -of- the -Month recipients:
Zone 1 Northwest Sherri and Darren Balan, 319 North 30 Avenue
Zone 2 Southwest David and Angie George, 810 South 34 Avenue
and Joe and Karen Murrillo, 4707 Cowden Place
Zone 4 Northeast Alice St. Hilaire, 301 North Naches Avenue
Following a video showing the yards of the month, a certificate was presented to
those winners present. Mrs. Quesenbury advised this was the last presentation
for the year. City Manager Zais complimented Mrs. Quesenbury on the work she
has done with this program.
4. CONSENT AGENDA
Mayor Place referred to the items placed on the Consent Agenda, questioning
whether there were any additions or deletions from either Council members or
citizens present. Item No. 12A was removed from the agenda, Item No. 12B was
added to, and Item No. 8 was removed from the Consent Agenda. The City Clerk
read the Consent Agenda items, including resolutions and ordinances by title.
SIMS MOVED AND BUCHANAN SECONDED TO APPROVE THE CONSENT
AGENDA AS READ. The motion carried by unanimous roll call vote.
(Subsequent paragraphs preceded by an asterisk ( *) indicate items on the
Consent Agenda handled under one motion without further discussion.)
*A. APPROVAL OF THE MINUTES OF AUGUST 21, 2001 ADJOURNED AND
BUSINESS MEETINGS
The minutes of the August 21, 2001 Adjourned and Business meetings were
approved, having been duly certified accurate by two Council members and no
one present wishing to have said minutes read publicly.
5. AUDIENCE PARTICIPATION
There was no audience participation.
CITY MANAGER'S REPORTS
6. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
EXTENSION OF AGREEMENT WITH A & A MOTORCOACH THROUGH
DECEMBER 31, 2001 FOR OPERATION OF TRANSIT ROUTE #3
Aileen Kane, 701 South 14 Avenue, expressed her opinion that this route
should be with the City and not with a private carrier. She said the services are
of a lower quality than that provided by the City of Yakima. The City Clerk read
the resolution by title only; PUCCINELLI MOVED AND BUCHANAN
SECONDED TO ADOPT THE RESOLUTION. The motion carried by a 4 -3 vote;
Buchanan, Sims and Mattson voting nay.

RESOLUTION NO. R- 2001 -124, A RESOLUTION authorizing and directing the
City Manager of the City of Yakima to extend an agreement with A & A
Motorcoach, Inc. whereby said entity shall operate City of Yakima Transit
Division Fixed -Route #3 for a period of three additional months ending midnight
December 31, 2001.

*7. CONSIDERATION OF RESOLUTION RATIFYING SUBMITTAL OF GRANT
AND AUTHORIZING EXECUTION OF GRANT AGREEMENT FOR TAXIWAY
IMPROVEMENT PROJECT AT THE AIRPORT
RESOLUTION NO. R- 2001 -125, A JOINT RESOLUTION of the City of Yakima
and Yakima County ratifying an Application for Federal Assistance and Standard
DOT Title VI Assurance, and authorizing the execution and acceptance of a
Grant Agreement for Federal Assistance and Certificate of Sponsor's Attorney
between the Federal Aviation Administration and the City of Yakima,
Washington, and the County of Yakima, Washington.
8. CONSIDERATION OF LEGISLATION RELATING TO AFSCME AND YPPA
CONTRACTS SETTLEMENT:
Lynne Kittelson, 305 North 9 Street said she was taking the liberty to speak for
the citizens of Yakima and thank the union members who gave up their raise this
year. She encouraged the citizens of Yakima to take the next step and buy
locally to increase the sales tax revenue. City Manager Zais explained that all
City employees waived their raises this year saving the city $1.5 million.
A. RESOLUTION AUTHORIZING EXECUTION OF AFSCME COLLECTIVE
BARGAINING AGREEMENT FOR 2001 -2002
The City Clerk read the resolution by title only; IT WAS MOVED BY SIMS AND
SECONDED BY BUCHANAN, TO ADOPT THE RESOLUTION. The motion
carried by unanimous roll call vote.
RESOLUTION NO. R- 2001 -126, A RESOLUTION authorizing and directing the
City Manager and City Clerk of Yakima to execute a collective bargaining
agreement for calendar years 2001 -2002 with the Washington State Council of
County and City Employees, Local 1122 of the American Federation of State,
County and Municipal Employees, AFL -CIO.
B. RESOLUTION AUTHORIZING EXECUTION OF YPPA COLLECTIVE
BARGAINING AGREEMENT FOR 2001 -2003
The City Clerk read the resolution by title only; IT WAS MOVED BY BUCHANAN
AND SECONDED BY SIMS, TO ADOPT THE RESOLUTION. The motion
carried by unanimous roll call vote.
RESOLUTION NO. R- 2001 -127, A RESOLUTION authorizing and directing the
City Manager and City Clerk of Yakima to execute a collective bargaining
agreement for calendar years 2001, 2002 and 2003 with the Yakima Police
Patrolman's Association (YPPA).

9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT RE: LEAD AGENCY STATUS FOR SALMON RECOVERY
PROJECTS
Commenting that since Yakima is the largest city that will be represented by this
Agency's Board, and has the largest wastewater treatment plan, Council Member
Puccinelli opined that Yakima should have a seat on the Board. PUCCINELLI
MOVED AND BUCHANAN SECONDED, TO ADOPT THE RESOLUTION. The
motion carried by unanimous roll call vote. PUCCINELLI MOVED AND
BEAUCHAMP SECONDED, TO SUPPORT THE MAYOR IN HER EFFORT TO
ENSURE YAKIMA HAS A REPRESENTATIVE ON THE YAKIMA BASIN
SALMON RECOVERY BOARD. The motion carried by unanimous voice vote.
PUCCINELLI MOVED AND SIMS SECONDED TO HAVE LARRYMATTSON
BE THE CITY'S REPRESENTATIVE ON THAT BOARD. The motion carried by
unanimous voice vote.
RESOLUTION NO. R- 2001 -128, A RESOLUTION authorizing the Mayor to
execute a memorandum of agreement between the City of Yakima and counties
and cities of the Yakima Basin and the Yakama Nation regarding lead entity
under Chapter 77.85 RCW.
*10. NOTICE OF INTENT TO COMMENCE ENGLEWOOD ANNEXATION (ADOPT
STANDARD MOTIONS A & B)
September 4, 2001 was set as the time given to initiate annexation proceedings
for the Englewood Annexation Area utilizing signed Outside Utility Agreements.
The annexation proposed was accepted by the City of Yakima, and the area to
be annexed will be required to assume its share of the City's existing
indebtedness, and staff was directed to file a Notice of Intent to Annex with the
Yakima County Boundary Review Board.
*11. SET DATE OF CLOSED RECORD PUBLIC HEARINGS FOR SEPTEMBER 18,
2001 FOR:
A. REZONE OF PROPERTY AT 4101 POWERHOUSE ROAD REQUESTED
BY 40 -WEST, LLC
• September 18, 2001 was set as the date of closed record public hearing on
the request for rezone of property at 4101 Powerhouse Road requested by
40 -West, LLC.
B. REZONE OF PROPERTY AT 24" AND LINCOLN AVENUE REQUESTED
BY KAMAL ABOULHOSN
September 18, 2001 was set as the date of closed record public hearing on
the request for rezone of property at 24 and Lincoln Avenue requested by
Kemal Aboulhosn.

LAWRENCE CACCHIOTTI
September 18, 2001 was set as the date of closed record public hearing on
the request for rezone of property at 1201 Ackerman Avenue requested by
Lawrence Cacchiotti.

12. CONSIDERATION OF LEGISLATION RELATING TO CONVENTION CENTER •
EXPANSION PROJECT:
A. RESOLUTION AUTHORIZING EXECUTION OF PROFESSIONAL
SERVICES AGREEMENT WITH WARDELL ARCHITECTS AND LMN
ARCHITECTS FOR PROJECT DESIGN
This item was removed from the agenda.
*B. FIRST READING OF ORDINANCE AMENDING THE 2001 BUDGET AND
APPROPRIATING FUNDS FROM THE CONVENTION CENTER CAPITAL
IMPROVEMENT FUND AND THE TOURIST PROMOTION FUND FOR THE
CONVENTION CENTER EXPANSION PROJECT (NO ACTION REQUIRED
THIS MEETING; SECOND READING SCHEDULED 9/18/01)
An Ordinance amending the 2001 170 - Tourist Promotion Operating Fund and
370 - Convention Center Capital Fund budgets appropriating funds for the
Convention Center Expansion Project was read by title only, and laid on the table
until September 18, 2001 fora second reading.
*13. CONSIDERATION OF LEGISLATION RELATING TO EMERGENCY
IRRIGATION WATER LINE REPAIR AT CHESTERLEY PARK:
A. RESOLUTION DECLARING SOLE SOURCE AND RATIFYING
EMERGENCY ACTION AND CHANGE ORDER WITH WARDELL /EVANS
AND SON FOR REPAIR WORK
RESOLUTION NO. R- 2001 -129, A RESOLUTION declaring an emergency in
that the Fruitvale Canal irrigation line needs immediate reconstruction and repair
to provide continued irrigation to the citizens of Yakima, and in order to continue
the Chesterley Park construction process without disruption, and declaring a sole
source for the reconstruction and repairs, and authorizing and ratifying the City
Manager's decision to execute all necessary documents and change orders with
Evans & Son, Inc. and Wardell Architects, and any other necessary outside
parties, to reconstruct and repair the Fruitvale Canal irrigation line without calling
for bids.

B. FIRST READING OF ORDINANCE AMENDING THE 2001 BUDGET AND
APPROPRIATING FUNDS FROM THE IRRIGATION CAPITAL BUDGET
FOR EMERGENCY IRRIGATION WATER LINE REPAIR (NO ACTION
REQUIRED THIS MEETING; SECOND READING SCHEDULED 9/18/01)
An Ordinance amending the 2001 budget for the City of Yakima; and making an
appropriation of $200,000 in the 479 — Irrigation System Improvement Fund for
expenditure during 2001 to provide for irrigation water -line repair at Chesterley
Park, having been read by title only, was laid on the table until September 18,
2001.
*14. CONSIDERATION OF ORDINANCE AMENDING THE CLASSIFICATION AND
COMPENSATION PLAN FOR CERTAIN CITY EMPLOYEES (2001 RECLASSES)
ORDINANCE NO. 2001-42, AN ORDINANCE relating to City personnel; adopting,
a classification and compensation plan for City employees to be effective
October 7, 2001, amending Subsections 2.20.100 A., 2.20.100 C., 2.20.110 C, all
of the City of Yakima Municipal Code.
*15. SECOND READING OF ORDINANCES AMENDING THE 2001 BUDGET FOR:
A. FIRE DEPARTMENT BUDGET FOR INDUSTRIAL INSURANCE
EXPENSES
An Ordinance amending the 2001 budget and appropriating funds for overtime,
unanticipated retirement cash outs, and additional industrial insurance
expenses, previously having been read by title only, was brought before the
Council for a second reading.
ORDINANCE NO. 2001-43, AN ORDINANCE amending the 2001 budget for the
City of Yakima; and making an appropriation of $155,103 in the 000 - General fund
for expenditure during 2001 to provide for Fire Department overtime,
unanticipated retirement cash outs, and an additional Industrial Insurance
premium charge.
B. REFUSE BUDGET FOR INDUSTRIAL INSURANCE EXPENSES
An Ordinance amending the 2001 budget and appropriating funds for industrial
insurance expenses, previously having been read by title only, was brought
before the Council for a second reading.
ORDINANCE NO. 2001 -44, AN ORDINANCE amending the 2001 budget for the
City of Yakima; and making an appropriation of $71,567 in the 471 — Refuse Fund
for expenditure during 2001 to provide for an additional Industrial Insurance
premium charge.
C. GENERAL FUND BUDGET FOR CODES FOR PLAN REVIEW SERVICES
AND INDUSTRIAL INSURANCE EXPENSES
An Ordinance amending the 2001 budget and appropriating funds for plan review
services and industrial insurance expenses, previously having been read by title
only, was brought before the Council for a second reading.

ORDINANCE NO. 2001 -45, AN ORDINANCE amending the 2001 budget for the .
City of Yakima; and making an appropriation within the Code Administration and
Planning Division to 1) provide for Third Party Plan Review Services and 2) fund '
an additional Industrial Insurance premium charge.
