The City Council met in regular evening session, convening at the hour of 8:00 P.M. Mayor Larson
Councilmen Brazier, Kurbitz, Lambert, Lynch, Munger and Robinson, City Manager Smith and City
Attorney Andrews present on roll call.
The invocation was given by Councilman Kurbitz.
The minutes of October 12, 1964- having been duly read and certified accurate by two councilmen
and no one present wishing to have the minutes read, Mayor Larson declared the minutes approved
as recorded.
In accordance with action taken by the Gity Council at their regular meeting of October 12, 1964,
Manager Smith recommended, that action on Petition No. 305 and 306 as filed by Robert Alderson be
discontinued indefinitely. He explained that since Mr. Harry C. Egbert has duly withdrawn his
signature from Petition No: 305 reducing the required number of signatures to less than 75% in val'
of the property to be annexed thus making it necessary to file a new Notice of Intention to
Commence Annexation Proceedings describing the reduced area. Mr. William H. Flood again protest-
ed this annexation but indicated he is in favor of the construction of sewers as requested on
Petition No. 306. All persons having been heard, it was MOVED by Robinson, seconded by Brazier
that action on Petition No.. 305 and 306 as filed by Robert Alderson and others be postponed in-
definitely: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye
by voice vote.
An ordinance anpropriatin.g the sum of $55,200.x_:0 from the unappropriated monies in the Water
Sewer Fund to the 1964 Budget for the same fund having been read in its entirety at the regular
meeting of the City Council on October 12, 1964 and having been read by title only at this meet-
ing, it was MOVED by Lambert,,seconded by Robinson that Ordinance No. 575 providing -for said
appropriation, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and
Robinson voting aye on roll call.
ORDINAI,TCE NO., 575, AN ORDINANCE appropriating the sum of $55,200 from the unappropriated monies
in 52, Water -Sewer Fund, to Account 7 -02, Part Time, Temporary, Overtime, and Special Assignment,
of the Salaries and Wages Classification and to Account 6 -50, Construction Expenditures, of the
Construction'Expenditures Classification, all of the 1964 appropriation for 52, Water -Sewer Fund.
This being the time fixed. for the hearing on the assessment roll for L.I.D. No. 903, Peach Ten
& Various Other Streets &: Alleys, it was MOVED by Munger, seconded by Lambert that Ordinance No.
confirming said assessment roll and .every part thereof, be passed as read: carried, Brazier,
Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye on roll call. Mr. Stan May filed)
in writing a written protest and protested orally the additional cost of $35-55 added to his
assessment covering the replacement of an irrigation.line that was torn out by the contractor.
Discussion of this matter indicated that -the line was an old wood stave private irrigation line
which was leaking and had to be replaced. Mr. Ray Lebens also discussed matters of construction
with Council members and the staff. Mrs. Bessie Shelton protested orally and filed a protest in
writing to the improvement of willow street indicating that it is too elaborate for this old
section of town and that it is a race track for hot- roders and requested that the staff consider
the placement of a stop sign at the end of 9th Avenue.
ORDINANCE N0. 576, AN ORDINANCE confirming the assessment roll covering Local Improvement Distric-
No. 903 as created and established by Ordinance No. 378 of the Ordinances of the City of Yakima.
This being the time fixed by Resolution No. D -737, being a resolution of intention to improve
certain property by the construction of concrete curbs and gutters and the surfacing of North 52ni
Avenue and various other streets,- it was MOVED by Lynch, seconded by Munger that Ordinance No.
577 providing for said improvement and creating L.I.D. No. 929, be passed as read: carried,
Brazier, Kurbitz, Lambert, Larson, Lynch, Munge.i_ and Robinson voting aye on roll call.
ORDINANCE NO. 577, AN ORDINANCE providing for the improvement of certain property by grading,
ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together
with necessary drainage features; establishing a Local Improvement District, providing; for the
method of payment thereof', and creating a special fund.
This being the time for the hearing on the rezoning of certain City-owned property recently
annexed to the City of Yakima by Ordinance No. 573 and contiguous to the Yakima Municipal Airport
it was MOVED by Munger, seconded by Lynch that,Ordinance No. 578 accepting the recommendation of
Planning Commission and rezoning said property from R -1, Single Family Zone to M -3, Airport
Industrial Zone, be passed "as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger
and Robinson voting aye on roll call.
ORDINANCE NO., 5781 AN ORDINANCE accepting the recommendation of the Planning Commission and re-
zoning certain property located at the Yakima Municipal Airport in the City of Yakima, Washington
from R -1, Single- Family gone, to M -3, Airport Industrial Zone.
This bein the time fixed for the hearing on the rezoning of Dr. A. J. Myers property located
between 3bth and 38 Avenues as requested and recorded in the minutes of August 17th Council
meeting, it was MOVED by Munger, seconded by Lambert that Ordinance No. 579 accepting the recom-
mendation of the Planning Commission and rezoning said property from R -1, single Family Zone to
B -2, Local Business Zone, be passed as read: carried, Brazier; Kurbitz, Lambert, Larson, Lynch,
Munger and Robinson voting aye on roll call. j
Petition No. 307 having been filed with the City Clerk on September 17, 1964 by William E. Shaw
and others requesting the rezone of property located at 1152 North 6th Avenue and adjacent grope:
it was MOVED by Munger, seconded by Lynch that said petition be referred to the City Manager and
Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson,
Lynch, Munger and Robinson voting aye by voice vote..
An appeal from the Planning Commission's decision to,deny the rezoning of property located at
414 South 30th Avenue as requested on Petition No. 299 and filed by Dr. S. J. Kovacs, Dr. G.S.
Roulston, Dr. L. E. Ghormley and John A. Frates and Mildred Frates, it was MOVED by -A*obihson,

There being no.further business to come before the Council it was MOVED by Kurbitz, seconded by
Lynch that we do now adjourn at the hour of 9:30 P.M.: carried, Brazier, Kurbitz, Lambert,
Larson, Lynch, Munger and Robinson voting aye by voice vote.
