AUGUST 31, 1964
The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lambert,
Larson, Lynch, Munger and Robinson, City Manager Smith and City Attorney Andrews present on
roll call.
Councilman Lynch gave the invocation.
The minutes of the regular meeting of August 24, 1964 were approved as read.
This being_ the time,for the '^searing on Petition No. 279 as filed by the Trinity Church. of the
Nazarene, requesting the annexation of certain property north of Englewood and east of the
Power House Road, and there being no protests in writing or otherwise, it was MOVED by Lynch,
seconded by Robinson that Ordinance No. 559 providing for said annexation and zoning; said
property as R -1, One Family Residence Zone, be passed as read: carried, Brazier, Kurbitz, Lambe
Larson, Lynch, Munger and Robinson voting aye on roll call. Pastor Paul M. Lewis was present
and spoke for the annexation. ,
ORDINANCE NO. 559, AN ORDINANCE providing for the annexation by the City of Yakima of certain
property contiguous to the City of Yakima, and zoning the same as R -1, One- Family Residence Zone.,
The Council having fixed this date for the hearing on the matter of rezoning certain property
known as the Ottiano and Mc Neil property located at 105 Pierce Avenue and 106 North 7th Avenue
as proposed and recommended by the City Planning Commission, it was MOVED by Munger,. seconded by
Lambert that an ordinance accepting the recommendation of said Planning Commission and rezoning
said property;frrom�R- 3;-'Multiple- Family Zone, to B -1, Modified Business Zone, be passed as read.
Mr. Ottiano was not present at this meeting but it was established that his property is rental
property and that he does not live on it. Mrs. Mc Neil, was present and protested the rezoning
of her property since she lives here and wishes to remodel one room. After reviewing and dis-
cussing this matter with Mrs. Mc Neil and the majority of the Council indicating; that they would
be in favor of rezoning this property, but do not believe it should be done in view of Mrs.
Mc Neil's protest, Mayor Larson called for a roll call vote on the motion to pass an ordinance
accepting the Planning Commissions recommendation and Councilman Brazier and Mayor Larson voted
Ave on roll_ call. Councilmen Kurbitz, Lambert, Lynch,.Munger and Robinson voted Nay on
roll call. The motion lost for the want of a majority vote. A formal written motion as prepared
by th-e Citv Attorney and disapproving the recommendation of the Planning Commission regardin the
same property on Pierce Avenue and North -7th Avenue and requesting the Planninol Commission to
reconsider this matter and to make a further report to the Council, was read and it was MOVED by
Robinson, seconded by Munger that said motion be passed as read: carried, Kurbitz, Lambert,
Lynch, Munger and Robinson voting ave on roll call. Brazier, and Larson' voting Nay on. roll call.
This being the time fixed for the hearing on the matter of rezoning of property at 1812 Nob Hill
Boulevard from B -2, Local Business Zone to R -3, Multiple- Family Zone as requested by Ralph E.
Bates on Petition No. 234 and recommended by the Planning Commission, it was MOVED by Munger,
seconded by Lambert that Ordinance No. 560 accepting the recommendation of the Planning
Commission and-rezoning said property, be passed as read: carried, Brazier, Kurbitz, Lambert,
Larson, Lynch, Munger and Robinson voting aye on roll call. Mrs. Charles H. Anderson, Mr. James
Hargroves and Mr. Melton spoke for this rezone in connection with the growth of our Yakima Valley
College
ORDINANCE NO. 560, AN ORDINANCE accepting the recommendation of the Planning Commission and re-
zoning certain property located at 1812 Nob Hill in the City of Yakima, Washington, from B -2,
Local Business Zone, to R -3, Multiple - Family Zone.
This being the time fixed for the hearing on the matter of rezoning of certain property located
at 811 and 813 North Front Street as requested by Gerald F. De Zarn on Petition No. 288, it was
MOVED by Munger, seconded by Robinson that Ordinance No. 561 accepting the recommendation of
the Planning Commission and rezoning said property from R -3, Multiple- Family Zone to M -1, Light
Industrial Zone, be passed as read:, carried, Kurbitz, Lambert, Larson,, Lynch, Munger and
Robinson voting aye on roll call. Councilman Brazier, abstained from voting explaining that his
employer,ovrns property in this area. Mr. De Zarn spoke for the rezone and Mr. William J. Allen
owner of the City Center Motel protested orally and also filed a written protest to the rezoning
to Light Industrial because of the possibility of a business locating here which will be noisy
and disturb his guests and those of other motels in the neighborhood.
ORDINANCE NO. 561, -AN ORDINANCE accepting the recommendation of the Planning Commission and re-
zoning certain property located at 811 and 813 North Front Street in the City of Yakima, Washing-
ton, from R -3, Multiple-Family Zone, to M -1, Light Industrial Zone.
A Notice of Intention to Commence Annexation Proceedings having been filed with the City Clerk
on August 26, 1964 by Ronald W. Poole and Wanda L. Poole, and Mr. Poole being present at this
meeting;, it was MOVED by Robinson, seconded by Munger that this date be set as the time for a
meeting with the initiating parties who have signed said notice of intention dated August 25,
1964: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting ave by
voice vote. Mr. Poole having indicated that he is shilling to assume his share of the City's
existing indebtedness, it was MOVED by Lynch, seconded by Munger that the annexation proposed by
Ronald Poole be accepted by the City of Yakima and that the area to be annexed be required to
assume its share of the ,City's existing indebtedness: carried, Brazier, Kurbitz, Lambert, Larson
Lynch, Munger and Robinson voting aye by voice vote.
Also a Notice of Intention to Commence Annexation Proceedings having been filed with the City
Clerk on August 28, 1964 by Mr.;-.:Lester_CD. Beaver, Mrs Syble M. Beaver and Mr. Joe F. Trowbridge
.for the National Bank of Commerce of Seattle and these persons being present, it was MOVED by
Munger, seconded by Lynch that this date be set as the time for a meeting with the initiating
parties who have signed said Notice, dated August 28, 1964; carried, Brazier, Kurbitz, Lambert,
Larson, Lynch, Munger and Robinson voting aye by voice vote .VMr. Howard Hettinger, attorney,
was also present and represented the National Bank of Commerce. A petition to be know as
Petition No. 294, was then filed with the Clerk of the Council and was signed by Lester 0. Beaver
Syble M. Beaver, R. B. Shepard and John F. Trowbridge for the National Bank of Commerce of
Seattle and it was MOVED by Robinson, seconded by Munger that said petition be referred to the
City Manager and the Planning Commission for study and recommendation: carried, Brazier, Kurbitz
Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote.
Moved by Munger, seconded by Robinson that Ordinance No. 562 relating to salaries and Job classi-
fication for employees of the City of Yakima, be passed as read: carried, Lambert, Larson, Lynch
Munger and Robinson voting aye on roll call. Brazier and Kurbitz voting nay on roll call.
Discussion disclosed that this ordinance adds the position of Assistant Finance Director to tthe
staff.

Moved by Robinson, seconded by Munger that Resolution No. D -727 'authorizing the acceptance of a
proposal from Gray & Osborne for Engineering services for the planning for a diversion structure
and pipe line -for water and to coordinate such work with the Washington State Highway Department
Department of Conservation, Department of Fisheries, U.S. Bureau of Reclamation, Pacific Power
& Light Comnany and others, be passed as read: carried, Brazier, Lambert, Larson, Lynch,-Munger
and Robinson - voting aye on roll call. Kurbitz voting nay on roll call indicating that he would
like to see the City Engineering staff do this job. Manager Smith and Mr. Don Gray, represent-
ing Gray and. Osborne stressed the importance of the documentation for this transaction. He also
stressed'the- importance of having the services of Mr. 0. W. Lindgren, who is employed by Gray
and Osborne and who is very familiar with this project.
RESOLUTION NO. D -727, A RESOLUTION authorizing and directing the City Manager and City Clerk to
accept a proposal from Gray & osborne for engineering services.
Moved by Munger, seconded by Lambert that Resolution. No. D -728 fixing the time for hearing on
Petition No. 283 as- filed ".by the Church- of, the- Brethern, for September 28, 1964, be passed as
read: carried Brazier, Kurbitz,'Lambert, Larson, Lynch, Munger and Robinson voting aye on roll
all. Discussion indicated that a quit claim deed has been obtained for sidewalk and that this
property will not be needed for street.
RESOLUTION NO. D -72$, A RESOLUTION fixing the time and place for hearing .on petition for vaca-
tion of a public street.
Moved by Brazier, seconded by Lambert that Resolution No. D -729 appointing Fred H. Andrews as
Acting City Manager to serve from September 1, 1964 to September 7, 1964, be passed as read:
carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye on roll call.
RESOLUTION NO. D =729, A RESOLUTION appointing Fred H. Andrews as Acting City Manager.
Manager Smith reported that the 1965 Preliminary Budget has been filed on this date with the
Mayor and Council members.
Mr. Rudy Gast, Planning Director, requested permission to execute two agreements extending water
service outside the Citv of Yakima to certain property in the vicinity of River Road and Frankli
Avenue and Peck's Canyon Road. It was MOVED by Robinson, seconded by Kurbitz that the staff be
authorized to extend water service to these two parcels conditioned upon the signing of a hook-
up agreement,agreeing to future annexation of said property when possible and waiving all objec-
tions to the formation of a local improvement district for water and sewer: Kurbitz, Larson, an
Robinson voting aye on roll call. Brazier, Lambert, Lynch and Munger voting no on roll call.
This motion lost for the want of a majority vote. Discussion of this matter indicated that the
feasibility of annexing these properties at this time has not been explored and that this
should be done before the outside hook -up is granted. Council members suggested that written
rules and an established policy for the Council to follow be worked out and further suggested
that the Planning Commission ,give some thought to this matter. All persons having been heard
on this matter, it was MOVED by Robinson; seconded by Kurbitz that the staff check out the
possibilities of annexation in these areas and that this matter be placed on the regular agenda
when this report can be made: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and
Robinson voting aye by voice vote.
Councilman Lynch called to the attention of the Council that Monday September 7, 1964, is a lega
holiday and requested that he be excused from the regular meeting to be held on September 8, 196
It was MOVED by Brazier, seconded by Munger that Councilman Lynch be excused from the next
regular meeting of the City Council: carried, Brazier, Kurbitz, Lamber, Larson, Lynch, Munger,
and Robinson voting aye by voice vote.
Councilman Munger also informed the Council that his attendance during the month of September
will be irregular and requested that he be excused from any meeting that he is unable to attend,
indicating that his firm will be moving to its new location.
Manager Smith having requested permission to send Walter Dutcher, employee of the Police Depart-
ment to San Francisco for a weeks training at the American School of Technical Intelligence, it
was MOVED by Robinson, seconded by Lynch that permission be granted for this employee to attend
said school and that his expenses be paid: carried, Brazier, Kurbitz, Lambert, Larson, Lynch,
Munger and Robinson voting a-.-e by voice vote.
Manager Smith also requested permission to send Captain Madden, of the Police Department, to the
Western State Safe Burglary School in San Diego, California and estimated his expense to be
$330.00. It was MOVED by Kurbitz, seconded by Lynch that permission be granted to send Captain
Madden to this conference and that his expenses be paid: carried, Brazier, Kurbitz, Lambert,
Larson, Lynch, Munger and Robinson voting aye by voice vote.
There being no further business to come before the Council, it was MOVED by Kurbitz, seconded
by Lynch that we do now adjourn at the hour of 5:10 P.M.: carried, Brazier, Lambert, Larson,
Lynch, Munger and Robinson voting aye by voice vote.
