July 20, 1964 8 p.m.
Ths city Council met in regular session, mayor Larson, councilman brazier, Lamberz, Lyncn, iviunger
and Robinson and City Manager Smith and. City Attorney Andrews present on roll call. Councilman
Kurbitz absent on roll call but present at 8:05 p.m.
OVED by Robinson, seconded by Lambert that Resolution No. D -718, a resolution of intention to
reate a local improvement district for the construction of Sewer, in the area of Maderal Heights,
chmidts Uplands and Buchanan addition and that date of hearing be set for August 10, 1964 at the
our of 3 p.m. be passed as rea; carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and
obinson voting aye on roll call.
ESOLUTION NO. 718, a resolution of intention to create a local improvement district and amending
esolution No. D 713
n the matter of the appeal from the Planning Commission's Decision on. Petition No. 270; -as filed
y William E. Shaw for the rezone of property located at 111, 113 and 1152 North 6th Avenue
rom R -3, Multiple Family Zone to B -2 Local Business Zone, it was MOVED by Brazier, seconded by
unger that the time of hearing on this matter be set for August 10, 1964 and that the City Clerk
ive notice of said hearing as required by law; carried, Brazier, Kurbitz, Lambert, Larson,
ynch , Munger and Robinson voting aye on roll call.
Bids having been received and opened on July 20, 1964, at 10 a.m. by the Bid Board for the Anders
Wallingford-Carriage Hill- Larson Lots Watermain and Sewer projects, and Director of Publ Works,
John Mayo having recommended the following bids be awarded:
Schedule I Domestic Watermain Line DeBlasio Bros. $9,369.36
Schedule II Sanktary Sewers Joe Earhart & Sons 29,581.24
Schedule III Storm Drain Gaasland Co. Inc. 10,569.00
it was MOVED by Robinson, seconded by Lynch that the report of Public Works Director John Mayo
Pe accepted and the bids be awarded as recommended; carried, Brazier, Kurbitz, Lambert, Larson,
Lynch, Munger & Robinson voting aye on roll call.
Mr. Bob Reesman requested that a speed limit sign be posted to indicate a 25 mile an hour speed
limit on South 5th Avenue, jutt North of Lenox for North Bound traffic. Public Works Director
ayo stated he would consider this request.
Vipith regard to the proposed water system for the City of Yakima , Councilman Kurbitz requested that
this matter

he city supply water and sewer service to Mrs. Spicer and that an agreement for utility service
utside the city limits be signedkby said Mrs. Spicer to go with the land as a deed restriction;
arson, Robinson, Kurbitz voting aye; Lynch, Lambert, Brazier voting Nay, resulting in a tie vote.
ouncilman Robinson then announced his intention to move for reconsideration-at the next regular
.eeting of the Council. The tie vote came about because Councilmen did not wish to change the
resent 11olicy regarding outside services. It was then MOVED by Lynch, seconded by Kurbitz that tY
e called a special case, and that the city supply sewer and water service to the Spicer residence

be placed on the ballot for either the September primary or November
general election
so that the
voters could state their choice. Kurbitz indicated that many people
felt that the
council is
abandoning the consideration of the dual system, and this is becoming
a real issue.
Councilman
Robinson stated that it has never come to his attention that the dual
system would be
abandoned,
and also stated that a vote by the people on this matter as it exists
now would not
ccomplish
anything. Other councilman agreed that a general advisory vote of the
people would not
be helpful.
Councilman Munger suggested to the councilthat a decision on this matter
be made as
quickly as
possible. Council stated it would like to meet again with Gray & Osborn
for further
study, and
it was decided that this meeting would be held on August 4, 1964 at 8
p.m. at City Hall.
It was also
stated by Council that a public hearing would be forthcoming.

Rose Manufacturing Co. located at 1710 South 1st Street, which is outside the.city limits and
not contiguous to it, having requested the extention of city utilities to their place of business

and the Council in subsequent discussion - having been informed by Planning Director Rudy Gast that
he had received a call from Deccio Produce inquiring abott the possibility of annexation for
this business and also McBeth Furniture in that area in order that they might-benefit from
lower insurance rates, it was suggested that before considering Rose Manufacturing Company's
request for city service, that in (auiry.be made'in this area with other businesses to- ascertain
the possibility of annexation. It was'MOVED by Brazier, seconded by Lynch that this matter be
referred to the staff for study and recommendation; carried, Brazier, Kurbitz, Lambert, Larson,
Lynch and Robinson voting aye by voice vote. Munger absent.
there being no further business to come before the meeting, it was MOVED by Kurbitz, seconded
by Brazier that we. do now adjourn at the hour of ',10 :20 P.M.
