The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lambert, Lynch
Munger and Robinson City Manager Smith and City Attorney Andrews present on roll call.
Councilman Lambert gave the invocation.
The minutes of the regular meeting of April 6, 1963 were approved as corrected.
Petition No. 261, having been filed �fTith the City Clerk on the 7th day of April, 1964 by A. J.
Lenz requesting the rezone of certain property located at 108 and 110 North 7th Avenue between
Pierce and North 7th Avenue, it was MOVED by Robinson,. seconded by Lynch that said petition be
referred to the Planning Commission for study and recommendation: carried, Brazier, Kurbitz,
Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote.
A Notice of Intention to Commence Annexation Proceedings, describing certain property located
North of Lincoln Avenue between Wright Avenue and,23rd Avenue, having been filed with the City
Clerk on April 10, 1964 by S. L. Haney, President and by other officers of Lincoln Center Inc.,
and Mayor Larson having determined that all signers of said notice were present at this meeting,
it was MOVED by Lynch,-seconded by Munger that this date, April 13, 1964 and this time, approximai
3:15 P.M., be set as the time for the meeting with the initiating parties who signed the Notice
of Intention to Commence Annexation Proceedings.dated, April 102 1964, those initiating parties
being S.L. Haney, President, V. Gene Cahoon ' Vice President, and Jack G. Cahoon, Secretary, all
officers for Lincoln Center, Inc.,:/ carried, Brazier, Kurbitz, Lamber, Larson, L,,nch, Munger and
Robinson voting aye by voice vote. v Mayor Larson then declared this meeting in secession and it
was MOVED by Robinson, seconded by Munger that the annexation proposed by S.L. Haney and the
other officers for Lincoln Center Inc., be accepted by the City of Yakima and that the area to be
annexed be required to assume it's.share of the City's existing indebtedness: carried, Brazier,
Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote../Mayor Larson then
invited signers to proceed with the completion and filing of the petition praying for said
annexation.
Moved by Munger, seconded by Lambert that Resolution No. D -679 vacating certain Public Utility
Easements as requested by School District No 7 on Petition No. 257 and 258, be passed as read:
carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye on roll call.
Discussion with Public Works Director Mayo indicated that the City has received easements at
different locations in exchange for this vacation and that this action is necessary to serve the'
Corpman property and will involve the installation of a sewer pump. Mr. Fred Velikanji, Attorney
representing Mr. Corpman, was present at this meeting.
RESOLUTION NO. D_679, A RESOLUTION vacating public utility easements in Johnson's Orxhard Home
Tracts within the City of Yakima.
Moved bj% Robinson, seconded by Munger that the resolution vacating certain public utility easement
within Weber Square Addition North of Chestnut between 39th and 40th Avenues, be passed as read.
Upon the recommendation of Manager Smith and Public Works Director Mayo it was informally agreed I
all concerned, including Mr. F. E. Velikanji, Attorney, representing clients who own property in,
this area, that this matter be continued for one week in order that the City's needs for a right c
way on Chestnut can be studied and perhaps negotiated.at this time.
Moved by Lynch, seconded by Lambert that Resolution No. D -680 designating April 20, 1964 at the
hour of 8:00 P.M., the evening, meeting of the City Council, as the time and place for a hearing
on the matter of revising the 6 year comprehensive Street Program, be passed as read: carried,
Brazier, Kurbitz, Lambert, Lynch, Munger and Robinson voting aye on roll call.
RESOLUTION NO. D =6$0, A RESOLUTION designating a time and place for a hearing on the matter of
revising the Six -Year Comprehensive Street Program for the City of Yakima.
The Planning Commission reporting on and recommending the rezoning of property at 9, 11, 13, 15,
Fair Avenue as requested by Jack A. McLeod and others on Petition No. 249, it was MOVED by
Robinson, seconded by Munger that April 27, 1964 be set as the time for a hearing by the City
Council on the matter of this rezone and that the City Clerk give notice of such hearing as re-
quired by law: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, MlIn,ger and Robinson voting

on the matter of this rezone and that the City Clerk give notice of such hearing as required by
law: carried, Brazier, Kurbita, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice
vote.
The Planning Commission also reporting on and recommending the rezoning of property located at
1009 North 10th Avenue, 1220 Fruitvale Blvd and 1007 North 9th Avenue as requested by E. F.
Velikanje and others do Petition No. 257, it was MOVED by Brazier, seconded by Munger that April
27, 1964 be set as the time for a hearing by the City Council on this matter and that the City
Clerk give notice of such hearing as required by law: carried, Brazier, Kurbitz, Lambert, Larson
Lynch, Munger and Robinson voting aye by voice vote.
The _following bids were received by a Bid Board for the 1964 Street Department Hot Mix Paving
Contract for various streets and alleys as outlined in the 1964 Street Department summer program:
Superior Asphalt & Concrete Company 58,$90.50
Yakima Asphalt Paving Company 859,509-50
Public Works Director Mayo explained that the bid of Superior Asphalt & Concrete, while it is the
lowest bid, is conditioned on an offered trade discount if payment is made by the tenth of the
month following delivery, and that since it is our custom to ti- aith�old payment] for laving work
until any defect we construction, materials, or cleanup work has een proper y rem ed) it would
be conceivable that payment for work in one month would not be made by the 10th of the following
month. He also pointed out that their bid offers .05% in the written portion of the bid but that
in computing the discount 5% was used and that there is a x$1,000.00 error in the addition on
Superior's basic bid. He further explained that discounts are encouraged in the purchase of mate
but not where construction is involved. In view of these facts, Mr. Mayo and City Manager Smith
recommended that this bid be awarded to Yakima Asphalt Paving Company and it was MOVED by Robinsoi
seconded by Lynch that this recommendation be accepted and followed: carried, Brazier, Kurbitz,

A final report on the protests received to date on L.I.D. No. 916; Lenox Avenue Arterial Street
Improvement and L.I.D. No. 917, South 16th Avenue Arterial Street Improvement recording 15.36
protest to L.I.D. No. 916 and 20.92% protest to L.I.D. No. 917 was read and discussed. No further
action was taken on this matter since they are under the required 60% protest.
The term for service of Walter S. Phillip on the Planning Commission having expired in August 1961
and Mayor Larson indicating that Mr. Phillip has ihdicated that he will continue to serve on thisll
Commission, it was MOVED by Kurbitz, seconded by Lynch that the City Council does hereby confirm
the reappointment of Mr. Walter S. Phillip to the City Planning Commission for a period of 6 year;
or until August of 1969: carried, Brazier, Eurbitz, Lambert, Larson, Lynch, Munger and Robinson
voting aye by voice vote.
There being no further business to come before the Council it was MOVED by Kurbitz, seconded by
Brazier, that we do now adjourn at the hour of 4:20 P.M: carried, Brazier,.Kurbitz, Lambert,
Larson, Lynch', Munger and Robinson voting aye by voice vote.
