HomeMy WebLinkAbout03/19/1962 Business MeetingL 1 1 -2 7 9 MARCH 19, 1962 The City Council met in regular session, -Mayor Bostic, Councilmen Barber, Lemon, Maxwell, Morrissey and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Lemon gave the invocation. Mayor Bostic welcomed our newly elected Councilman, Mr. Ed Morrissey -to'the Council table and also welcomed Mr. Al Kurbitz, Mr. Robert Lynch and Mr. Elliott Munger, newly elected Council men to this meeting and extended an invitation to them to attend the study session luncheons held with City Manager Smith on Mondays.prior to the regular Council meeting. The minutes of the regular meeting of March 12, 1962 were approved as read. In accordance with action taken by the City Council at their regular meeting of March 12, 1962 with regard to the appeal from the Planning Commissions decision on Petition No. 119 as filed by James Scrimger and others,requesting the rezoning of property at 1107 -09 -A West Yakima Avenue, the hearing on this matter was continued. There being no new evidence introduced and all persons having been heard, including Mr. James McArdle and Mr. Fred Velikanji, attorneys for the petition ers, it was MOVED by Robinson, seconded by Lemon that the City Attorney prepare a formal written motion reciting the disapproval by the City Council of the recommendation of the Planning Commission and the reasons for disapproval and referring this matter back to the Planning Commission with a request for a further report within forty days: carried, Barber, Bostic, Larso: Lemon, Maxwell, Morrisey and Robinson voting aye by voice vote. Also in accordance with action taken by the City Council at their regular meeting of March 12, 1962 on Petition No. 126 as filed by George R. Fain requesting the rezoning of property located at 412 South 12th Avenue between Division and West Spruce Streets, it was MOVED by Barber, seconded by Lemon that Ordinance No. 327 accepting the recommendation of the Planning Commission and rezoning said property from R -2, Two Family Residential Zone to B -2, Local Business Zone, be passed as read: carried, Barber, Bostic, Larson, Lemon, Maxwell, Morrissey and Robinson voting aye on roll call. ORDINANCE N0: 327, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property located at 412 South 12th Avenue; between Division and West Spruce Streets, in the City of Yakima, Washington, from R -2, Two Family Residential Zone, to B -2, Local Business Zone. Moved by Larson, seconded by Robinson that Resolution No. D -375 transferring*$375..00 in the 1962 appropriations for Domestic Water, be passed as read: carried, Barber, Bostic, Larson, Lemon, Maxwell, Morrissey and Robinson voting aye on roll call. /Discussion pointed out that this amount is needed to cover the transportation costs of scheduling interviews with engineers from Petaluma California, Anchorage Alaska and Coos Bay Oregon for the purpose of filling the position of Director of Public Utilities and Water Superintendent with the City of Yakima, said vacancy having been created by the resignation of Lloyd Belz in January of 1962. RESOLUTION NO. D -375, A RESOLUTION transferring the sum of $375.00 within the 1962 appropriation for 52.8 - Domestic Water. WHEREAS, a surplus exists in Account 7 -01, Salaries and Wages, Director of Public Utilities and Water Superintendent, of the Salaries classification of the 1962 approprii ation for 52.8 - Domestic Water, and WHEREAS, it is necessary that additional moneys be transferred to Account 7 -99, Miscellaneous, of the Maintenance & Operation classification of the 1962 appropriation for 52.8 - Domestic Water, to allow payment of round trip transportation costs of applicants to be interviewed for the position of Director of Public Utilities and Water Superintendent, and WHEREAS, at the time of the adoption of the 1962 Budget, it could not have reasonable been foreseen that'the above additional expenditure would be required, and the City finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfer, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now, there- fore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the sum of $375.00 is hereby transferred from Account 7 -01; Salaries and Wages, Director of Public Utilities and Water superintendent, of the Salaries classification, to Account 7 -99, Miscellaneous, of the Maintenance & Operation classification, both within the 1962 appropriation for 52.$ - Domestic Water. Section 2. The Director of Finance of the City of Yakima is hereby author -, ized and directed to make the aforesaid transfer. ATTEST: J. A. Committee having filed their report with the City Council, Mayor Bostic called on Mr. Elliott Munger,/�ThRnked the staff for their help and cooperation and asked that the 15 man committee recommended in said report be appointed as soon as possible to further this stud It was then MOVED by Maxwell, seconded by Barber that this report be received with thanks and filed for further consideration: carried, Barber, Bostic, Larson, Lemon, Maxwell, Morrissey and Robinson voting aye by voice vote. Councilman Maxwell suggested that the Mayor send letters of appreciation to those persons who worked on this committee. A vacancy having been created on the Civil Service Commission for Fire and Police by the death of Harold Glenn, it was MOVED by Robinson, seconded by Maxwell that Dr. Roderick G. Mc Intosh be appointed to fill the-unexpired term of Mr. Glenn, or until January 1, 1965: carried, Barber, Bostic, Larson, Lemon, Maxwell, Morrisey and Robinson voting aye by voice vote.- The City Council discussed the matter of the Clear Zone project with Mr. Fred Velikanji, Attorney for Mr. Sam Christoff, whose property is needed for this project, and Mr. Christoffs son and daughter who suggested a-safety lighting device controlled from the tower to prolong the need to relocate 16th Avenue. Manager Smith also reported on this project stating that Mr. Warren Eccles negotiator for the City of Yakima, has not been too successful in obtaining the necessary propert . r 280 MARCH-!% 1962 needed and recommended that the Council fix next Friday, March 23, 1962 as the final date for negotiating with Mr. Eccles and that the City Attorney be instructed to prepare the necessary legislation to start condemnation proceedings to obtain the necessary land for a clear zone at the Yakima Municipal Airport. All persons having been heard on this matter, it was MOVED by Robinson, seconded by Larson that the City Council concurr with the.Manager's recommendations and that Friday, March 23, 1962 be and is hereby fixed as the last day for negotiating,--with the City's appointed negotiator, Mr. Warren Eccles and that the City Attorney be and is hereby in- structed to prepare the necessary legislation to start condemnation.proceedings.to obtain the land for a Clear Zone at the Yakima Municipal Airport: carried, Barber., Bostic, Larson, Lemon, Maxwell, Morrissey and Robinson voting aye by voice vote. Mr. Velikanji protested this move stating that his client has not been furnished the proper information as to the amount of property needed, etc., with which to netotiate.
