DECEMBER 11, 1961
The City Council met in regular session, Mayor Bostic, Councilmen Barber, Keith, Larson, ]Lemon,
Maxwell and Robinson, City Manager Smith and City Attorney Arntson present on roll call.
The invocation was given by Councilman Larson.
The minutes of the regular meeting of December 4, 1961 were approved as read.
An ordinance appropriating $3,150.00 in the City Garage Fund to Automotive Parts and Repair in the
1961 Budget for the City Garage having been read in its entirety at the regular meeting of the
Councilmon December 4, 1961 and laid on the table for one week, was read by title only at this
meeting. It was then MOVED by Lemon, seconded by Keith that Ordinance No. 304 providing for said
appropriation, be passed as read: .-carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and
Robinson voting aye on roll call.
ORDINANCE NO. 304, AN ORDINANCE appropriating the sum of $3,150.00 from the unappropriated
moneys in the City Garage Fund to Account 7 -40, Automotive, Parts & Repair, of the Maintenance &
Operation classification of the 1961 appropriation for 34 - City Garage, and declring an emergent
A proposed 6 year Improvement Plan for Streets having been handed to members of the Council prior
to this meeting for study, and this being the time fixed by the Council for a public hearing on
said plan, all interested persons present were heard. Mrs. William Gilmore urged the opening of
40th Avenue as soon as possible.._-,City Engineer Mayo, Public Works Director explained that ac-
quisition of rights -of -way and the annexation of certain properties has delayed this action. "Mr.
Mayo introduced Mr. Mackey, State Aid Engineer for the State Highway Department. Mr. Fred Whede,
representative of a Teamsters Local, questioned the Council on letting this work out on bids, in-
timating that City crews are doing too much of the street work. City Attorney Arntson asked Mr.
Whede to formulate his question in a letter in order to pin point matters to be answered. Mr.
Mayo explained that the City crews do only the sealcoa.ting and resurfacing of streets and all new
construction is let on bid. All persons having been heard, it was-MOVED by Robinson, seconded by
Larson that the City Attorney be and is hereby instructed to prepare a resolution adopting the
proposed Six Year Street Improvement Plan: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwel
and Robinson voting aye by voice vote.
This being the time fixed for the hearing on Petition No. 107 as filed by C. E. Marshall request -
ing the vacation of a Utility Easement on property located at 512 North 45th Avenue, it was
MOVED by Barber, seconded by Lemon that Ordinance No. 305 providing for said vacation, be passed
as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll
call.
ORDINANCE NO. 305, AN ORDINANCE providing for the vacation of a certain public utility easement
across the following described property, to -wit: The South 6 feet of the North 334.85 feet of
the East 63.5 feet of the West 127.3 feet of the Northeast (quarter of the Northwest Quarter of
Section -22, Township 13 North, Range 18, E.W.M.
Moved by Maxwell, seconded by-Barber that Ordinance No. 306,amending Ordinance No. 293 adopting
a Uniform Plumbing Code for the City of Yakima, by amending certain fee schedules and providing
for a performance bond in connection,wi.th licensing of plumbing contractors and amending certain
sections of the Yakima Municipal Code, be passed as read: carried, Barber, Bostic, Keith, Larson,
Lemon, Maxwell and Robinson voting aye on roll call.
ORDINANCE NO. 306, AN ORDINANCE amending that portion of the-City of Yakima Municipal Code as
amended by Ordinance No. 293 entitled, "AN ORDINANCE providing for the protection of the public
health and safety, and the qualification and registration of persons engaged in the business of
plumbing, or laboring at the trade of plumbing; requiring a permit and inspection for the instal -
lation or alteration of plumbing and drainage systems; creating an Administration Office and a B
Board of Plumber Examiners and prescribing their duties; defining certain terms; establishing
minimum regulations for the installation, alteration or repair of plumbing and drainage systems
and the inspection thereof; adopting with certain exceptions and amendments the Western Plumbing
Officialst•Uniform Plumbing Code, 1961 Edition; providing penalties for the violation thereof;
repealin.g, Chapters 7.52; 11.44 and 11.48 of the City of Yakima Municipal Code and all other
ordinances or parts of ordinances in conflict herewith;" and providing for surety bonds.
Moved by Keith, seconded by Lemmn that Ordinance No. 307 repealing Ordinance No. B -28 and Chapter
7.26 of the Municipal Code providing for the use of the West Yakima Irrigation System, be passed
as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll
call.
ORDINANCE NO. 307, AN ORDINANCE repealing Chapter 7.26, West Yakima Irrigation System Use, of the
Citv of Yakima Municipal Code.
Moved by °Barber, seconded by Robinson that Resolution No. D -344 expressing appreciation and
commendation for services rendered to the City of Yakima by City Attorney Arntson, be passed as
read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call)
RESOLUTION NO. D -344, A RESOLUTION of appreciation and commendation for the services performed by
W. Anthony Arntson during his tenure as City Attorney of the City of Yakima.
11THEREAS, W. Anthony Arntson has served as City Attorney of the City of
Yakima since August 4, 1958, and as the first full -time City Attorney since that date, and
WHEREAS, during said period he materially assisted the City in preparing
the necessary legal work to complete the transition from the Commission to the Council - Manager
form of government, and
WHEREAS, Mr. Arntson served as City Manager from October 19, 1960 until
November 28, 1960, following the death of Mr. E. J. Allison, and
WHEREAS, during his employment with the City,Mr Arntson has at all times
performed his responsibilities as City Attorney in a highly commendatory manner, now, therefore,,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIT, °A:
That the City Council expresses its sincere appreciation and commends
Anthony Arntson for his faithful and loyal service to the City of Yakima as City Attorney for the
period from August 4, 1958, until December 31, 1961, the date of his resignation.

Moved by Robinson, seconded by Keith that Resolution No. D -345 requesting the Federal Aviation
Agency to reconsider certain Civil Air Regulations relating to the requirement of two -way radios
in aircraft being used for crop dusting and requesting that said provisions be relaxed to allow
agricultural crop dusting aircraft to operate from the Yakima Municipal Airport without such
equipment, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon.,, Maxwell_ and Robinson
voting aye on roll_ call. Discussion of this motion with'_Mr. :W. 0. Wikstrom established that this
request could be granted.
RESOLUTION NO. D -345, A RESOLUTION requesting the Federal Aviation Agency to reconsider portion
of Amendment 60 -24 of the Civil Air Regulations, Part 60.
WHEREAS, the City Council of the City of Yakima understands that Amendment
60 -24 of the Civil Air Regulations, Part 60, will prevent the operation of all aircraft to or froi
an airport with a control tower unless such aircraft are equipped with two -way radios and are in
communication with such control tower.at all times during landing or take -off, and
WHEREAS, the Yakima Municipal Airport, owned and operated by the City of
Yakima, has a control tower manned by personnel from the Federal Aviation Agency, and
WHEREAS, said Yakima Municipal Airport is located in a predominantly
agricultural community, and
WHEREAS, because of said agricultural character of the community, a consid-
erable aviation industry has developed involving the use of commercial aircraft for agricultural
purposes, such as crop dusting, and
WHEREAS, because of the nature, construction and operation of such aircraft
it is impracticable to install, operate and maintain two -way radios and undue economic hardship
would be caused the owners of such aircraft, and
WHEREAS, the said Yakima Municipal Airport is not classified as a high
density airport, and the vast majority of said agricultural -type aircraft are based on said air-
port and maintain their headquarters and operations base on property leased from the City of
Yakima on said airport, and
WHEREAS, the enforcement of said Amendment 69 -24 will operate against the
maintaining of such industry on the Yakima Municipal Airport dr the use of the runways and the
runways and other airport facilities by said aircraft, thus very materially, decreasing the use of
said airport and resulting in financial loss to the City of Yakima, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the City of Yakima, acting by and through its City Council,
hereby recommends to and urges the Federal Aviation Agency to relax the provisions of Amendment
60 -24 of the Civil Air Regulations, Part 60, to such extent as will allow agricultural crop -
dusting aircraft to operate to and from the Yakima Municipal Airport without being equipped with
two -radio communication.
Section 2. The City Manager is hereby directed to transmit copies of this
resolution to the Federal Aviation Agency and its several interested divisions.

The Planning Commission recommending the rezone of certain property at 513 -15 South 3rd Street
from R -3, Multiple Family Residential to B -3, General Business as requested on Petition No. 114
as filed by Virgil L. Ruark, it was MOVED by Robinson, seconded by Barber that the City Attorney
be and is hereby instructed to prepare an ordinance accepting the Planning Commissions recommend
ation and providing for the rezone of said property: carried, Barber, Bostic, Keith, Larson,
Lemon, Maxwell and Robinson voting aye by voice vote.
The Planning Commission also recommending the rezone of certain property at 416 North 2nd Street
from R -3 Multiple Family Residential to B -2, Local Business as requested on Petition No. 115
as filed by Albert Maletta, it was MOVED by Larson, seconded by Robinson that the City Attorney
be and is hereby instructed to prepare an Ordinance accepting the Planning Commissions recommend
ation and providing for the rezone of said property: carried, Barber, Bostic, Keith, Larson,
Lemon, Maxwell and Robinson voting aye by voice vote.
Members of the Council agreeing, to deviate from the agenda, Mr. W. 0. Wikstrom and members of
the Chamber of Commerce Aviation Committee were heard on the matter of a clear zone at the Yakim
Municipal Airport. Mr.. Wikstrom and Mr. Lee Semon, Jr.. urged the acquisition of clear zone
property as quickly as possible in order that our airport will not fall behind in improvements
and participation in federal matching funds. Mr. Wikstrom suggested that administration costs
be cut at the Airport to obtain money for this project. Further discussion disclosed that this
project would cost approximately $60,000.00 to 70,000.00 of which the City would pay one half,
that -it will be necessary to work out an agreement with the State of Washington in connection
with the State Fish Hatchery property and that all obstructions will have to be moved from the
clear zone area upon the direction of the F.A.A. Mr. Sam Christoff, through is attorney, Mr.
Fred Velikanje, protested the expansion of the airport and informed the Council that his propert
is not for sale. All persons having been heard on this matter, it was MOVED by Robinson,
seconded by.Maxwell'that the City Manager be instructed to obtain and up to date appraisals= of
the property involved, to find a method of financing the acquisition of said property and invest
gate the matter of the State Fish Hatchery land: carried, Barber, Bostic, Keith, Larson, Lemon
Maxwell and Robinson voting aye by voice vote. It was also suggested that Manager Smith inform
Mr. Richard Puckey, District Engineer for the Federal Aviation Agency, of this action.
Returning to the agenda the Clerk of the Council read the following investment report as submitt

It was then MOVED by Larson seconded by Maxwell that said report dated November 30, 1961, regard-
ing the investments of the 4ty of Yakima, be accepted and approved: carried, Barber, Bostic, Kei

A bid summary having been submitted to the City Council showing the following bids received for

and the City Manager and City Engineer recommending that the bid be awarded to C. & S. Constructic
as the lowest and best bidder on all schedules-, it was MOVED by Robinson seconded by Barber that
concur with said-recommendation and that the bid,- be awarded to C. & S. Construction Company and
that the City Manager be and is hereby authorized to enter into a contract with said firm on
behalf of the City of Yakima and on the filing of the proper bond by them: carried, Barber,
Bostic, Keith, Larson, Lemon, Keith, Maxwell and Robinson voting aye by voice vote. -
Other matters discussed by Council members were the financial status of,the Municipal Garbage
Department and the success of the benches placed on the streets by the I.O.O.F. Lodge. It was
suggested that such a bench be placed at 11th Avenue and Spruce for the benefit of those persons
using the Medical Center. No formal action was taken on these matters.
There being no further business to come before the Council it was MOVED by Barber, seconded by
Lemon that we do now adjourn at the hour of 4:40 P.M: carried, Barber, Bostic, th, Larson,
Lemon, Maxwell and Robinson voting aye by voice vote.
