Councilman Maxwell absent and excused. City Manager Smith and City Attorney Arntson also present. The invocation was given by Councilman Larson: The minutes of the regular meeting of June 14, 1961 were approved as read. In accordance with action taken by the City Council at their regular meeting of June 14, 1961, the hearing was continued on Resolution No. D -267, being a resolution of intention to improve certain streets by constructing concrete curbs and gutters and the surfacing of said'streets and constructing sidewalks on certain streets. The City Engineers report on the protests filed to date on the proposed Lincoln- Sunset Arterial Improvement,District, shows that 12.2% protest has been filed and that the heaviest protest is, against improving 34th Avenue between Jefferson Avenue and Lincoln Avenue. Mr. P. M. Strickland, Mr. Byron Weber and Mr. Knopff, property owners in this district, being present at this meeting, again discussed their protests with the Council. Mavor Bostic announced that the staff has changed their plans for the sidewalk on Lincoln Avenue and will build same on the South side of the street instead of the North as originally planned. Councilman Robinson stated that the community needs this improvement and that it is a bargjincon- sidering that the State will supply 75% of the money for the Arterial improvemnt and further ex- plained that 34th Avenue needs this improvement and will create certain problems if taken out of the district. All persons having been heard, it was -MOVED by Robinson, seconded by Barber that Ordinance No. 257, providing for said improvements and creating Local Improvement District No. $92, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye on roll call. Maxwell absent. ORDINANCE NO. 257, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs -and gutters, together with necessary drainage features; and constructing sidewalks on certain portions of said improve - ment; establishing,a Local Improvement District, providing for the method of payment thereof, and creating a special fund. In accordance with action taken by the City Council at their re ular meeting of June 14, 1961, it was MOVED by Lemon, seconded by Larson that Ordinance No. 251 accepting the recommendation of . the Planning "ommission and rezoning certain property located between South 6th Avenue and South 7th Avenue between Walnut and Chestnut Streets in accordance with the request made by W. H. Van Keulen on Petition No. 89, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye on roll call. Maxwell absent. ORDINANCE NO. 25$, AN ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property located between South 6th Avenue and South 7th Avenue and between Walnut and Chestnut Streets in the City of Yakima, Washington. The City Council together with the City Manager having continued their study of the operation of the Municipal Garbage Collection Service and having taken action to continue this service as a part of city operation at their regular meeting on May 24, 1961, an ordinance amending certain sections and increasing certain rates as set forth in Ordinance No. B -1523 providing for the regulating, collection and disposal of garbage in the City of Yakima and fixi ng,the charges for said services, was read by the Clerk of the Council. All persons present and interested in this matter were heard. MOVED by Larson, seconded by Barber that said ordinance, being Ordinance No. 259, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye on roll call. ORDINANCE NO. 259, AN ORDINANCE amending Sections 10, 11, 13, 14 and 18 of Ordinance No. B -1523 entitled, "AN ORDINANCE relating to public health and sanitation; providing for and regulating the,collection and disposal of garbage, refuse and dead animals in the City of Yakima; regulating the operation of the City Dump and collection service; creating a special fund and providing for the payment of monies into said fund; providing penalties for the violation hereof; and repealing Ordinance No. B -1511 and all other ordinances and parts of ordinances in conflict herewith;" as amended by Ordinance Nos. B -1876 and B -2028 (Sections 4. 16.140; -150,- 170;.1$0; and .220 of City of Yakima Municipal Code), and declaring an emergency. Book Publishing Company having completed codifying the ordinances of the City of Yakima as author. -ized by the City Council at their regular meeting of May 25, 1960, City Attorney Arntson reviewed the statue concerning the approval and acceptance of said code. In accordance with said statue a copy of said Code was filed with the City Clerk on this date and the title of said Code, and thl title of the ordinance adopting this codification of the charter and the ordinances as' the offici< Code of the City of Yakima, was read by the Clerk of the Council. Moved by Larson, seconded by Lemon that Resolution No. D -276 directing the publication of notice of hearing on said codifica- tion and fixing the date of said hearing at the hour of 3:00 P.M on Wednesday, the 5th day of July, 1961, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye on roll call. Maxwell absent. RESOLUTION'NO. D -276, A-RESOLUTION directing the publication of notice on hearing on codificatio: of ordinances of the City of Yakima. WHEREAS,,at a regular meeting of the City Council of the City of Yakima on June 21, 1961, the title of an ordinance providing for the codification of the charter and general ordinances of'the City of Yakima and the title of the Code to be adopted thereby were read in open meeting, and WHEREAS, Chapter 97, Laws of 1957, provide that the City Council shall Schedule a public hearing upon such codification and adoption of such.Code,,and that notic e thereof shall be published once not more than 15 nor less than 10 days prior to such a hearing,*. and WHEREAS, the charter and all ordinances of the City of Yakima of a general public, or permanent nature or imposing a fine, penalty, or forfeiture have been codified, and a copy of said codification has been.filed with the City Clerk of the City of Yakima, now, there- fore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. D -2772 A RESOLUTION transferring funds within the 1961 appropriations for 15 - Statutory & General, 24 - Engineering Department, and 52.6 - Sewer Maintenance Department. WHEREAS, surpluses exist in Account 7 -31, Publication and Printing, of the Maintenance & Operation classification of the 1961 appropriation for 15 - Statutory & General; Account 7 -05, Other Per Annum,of the Salaries classification of the 1961 appropriation for 24 - Engineering Department; and Account 6 -06 Sanitary Sewer, of the Capital or Betterment classifi- cation of the 1961.appropriation for 52.6.- Sewer Maintenance Department, and WHEREAS, additional moneys are required in Account 7 -13, Industrial Insurance & Medical Aid, of the Maintenance & Operation classification of the 1961 appropriation for 15 - Statutory & General, to pay Industrial Insurance and Medical Aid payments in accordance with the 1960 audit instructions of the Department of.Labor and Industries of the State of Washington, which payments could not reasonably have been anticipated at the time of the adoption of the 1961 Budget, and WHEREAS, due to the increase in work load caused by pending street improve- ments, combined with the resignation of the former Assistant City Engineer, it is necessary that additional help be hired for the summer construction season, and that insufficient moneys were appropriated in Account 7 -08, Extra Help, of.the Salaries Classification of the 1961 appropriation for 24 - Engineering Department to pay for such additional help, which could not have reasonably been anticipated at the time of the adoption of the 1961 Budget, and WHEREAS, at the time of the adoption of the 1961 Budget, it could not have been reasonably foreseen that additional moneys would be required in Account 6 -05, Storm Sewer Construction, of the Capital or Betterment classification of the 1961 appropriation for 52.6, Sewer Maintenance Department, to allow participation with Cascade Lumber Company in the costs of providing drainage facilities due to Cascade Lumber Company obstructing the natural drainage in in the area of East "E" Street and the Cascade Lumber Company Mill Pond, and WHEREAS, the City-Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now,therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. RESOLUTION NO. 279, BE'IT RESOLVED BY'THE CITY COUNCIL OF THE CITY OF YAKIMA: That it'is its intention to improve the following streets by grading, ballast] ing, surfacing with asphaltic concrete and constructing concrete curbs and gutter, together with necessary drainage features: m 1. Westover Drive from Chisholm Trail to West Walnut Avenue. 2. Walnut Avenue from Westover Drive to 90 feet East of Frances Avenue. 3. Frances Avenue. 4. North 45th Avenue from Englewood Avenue to a point 320 feet more or less South of Englewood Avenue. 5. Hager Avenue. That it is also-its intention to improve the following alleys by grading, ballasting and surfacing with asphaltic concrete: 1. Alley in Block 292, Capitol Addition. 2. Alley in the S2 Block 330, Capitol Addition. 3. Alley in Block 6, Loma Vista Addition and Block 2, Highland Addition. Maxwell absent. RESOLUTION NO. D -2801 A RESOLUTION authorizing the Director of Highways to perform soil analysis and testing work for the City of Yakima Municipal Airport. WHEREAS, in connection with the new project for construction of certain ramps and aprons at the Yakima Municipal Airport with a grant from the Federal Aviation Agency it is necessary that certain soil analysis and tests be performed, and WHEREAS, the Director of Highways of the State of Washington has the charge and direction of certain laboratory facilities suitable for the performance of such work, and the City Council finds that it is in the best interests of the people of the City of Yakima to have such work performed by the Director of Highways, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The Director of Highways of the State of Washington is author- ized and directed to perform soil analysis and testing work, both in the laboratory and at the field level as requested by the City Engineer at the Yakima City Airport, to the amount of Five Hundred Dollars (500.00). Section 2. Authorization is hereby granted for the withholding from the monthly fuel tax allotments to the above specified sum, being an amount not in excess of the money reasonably anticipated to accrue to the credit of the City of Yakima in the Motor Vehicle Fund during the current biennium. Section 3. Upon completion of the aforesaid work, and a statement of cost having been furnished the City of Yakima of the cost of all labor, equipment, material, supplies, and engineering, authorization is made to effect reimbursement to the Department of Highways in the amount of such cost from the funds withheld, however, not to exceed the above specified-sum with any unexpended balance to be released to the City of Yakima and to be included in the next succeeding warrant covering fuel tax allotments, all in accordance with R.C.W.47.08.0S ADOPTED BY THE CITY COUNCIL this 21st day of June, 1961. BOSTIC City Clerk Mayor Manager Smith encouraged members of the Council to read their copies of the 1961 Digest of New Laws Affecting Cities, copies of which were handed to the Council on this date. Manager Smith also reported that he has been contacted by Dr. Stephen Sweeney of Fels Institute of State and Local Government, University of Pennsylvania and asked to consider taking one of the schools top graduates as an assistant for 6 months, with the Institute paying his salary and the city paying his transportation to Yakima. Mr.-James B. Holcomb is the person suggested. to take this position and he will be available on July 1, 1961. Manager Smith requesting the approval of this plan, -it was MOVED by Robinson, seconded by Keith that the City Manager be and it hereby authorized to go ahead with this plan and the cost of transportation for this person be allowed up to $250.00: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye by voice vote.
