Councilman Barber, Keith, Larson, Lemon, Robinson, City Manager Smith and City Attorney Arntson present on roll call Mayor Bostic absent and excused. Councilman Maxwell absent until the hour of 3:40 P.M. The invocation was given by Councilman Lemon. The minutes of the regular meeting of May 24, 1961 were approved as read. This being the time fixed by the City Council for the hearing on the assessment roll for L.I.D. No. 891, being the 29th Avenue and Lincoln Avenue Sanitary Sewer District, and Mr. Garret Anderson, a property owner in said district, being present and protesting the inclusion of his orchard property in this district, stated that the Council had given him reason to believe, at the time of.the hearing on the resolution'of intention to improve this area, being the regular meeting of the City Council held on September 21, 1960, that this property would not be included. In order that this matter may be studied further, it was MOVED by Barber, seconded by Lemon that this hearing be continued to the regular meeting of June 14, 1961: carried, Barber, Keith, Larson, Lemon and Robinson voting aye by voice vote. Bostic and Maxwell absent. A petition, being Petition No. 89, having been filed with the City Clerk on the 25th day of May, 1961 by W. H. and Elizabeth Van Keulen, requesting the rezone of property situated at 106 South 6th Avenue from R -3 Multiple- Family Dwelling to B -3 General Business Zone, it "was MOVED by Barber seconded by Lemon that said petition be referred to the City Manager and the Planning Commission for study and recommendation: carried, Barber, Keith, Larson, Lemon and Robinson voting aye by voice vote. Bostic and Maxwell absent. In accordance with action taken by the City Council at their regular meeting of May 24, 1961 and ,the City Manager recommending the bid of Seattle -First National Bank as the lowest and best bid for the purchase of the $45,000.00 General Obligation Bonds to be issued and sold by the City of Yakima for the purpose of covering certain ditches in said city, all in accordance with Ordinance No.'s 171 and 242, it was MOVED by Barber, seconded by Lemon that Resolution No. D -271 awarding the bid for the purchase of-the $45,000.00 General Obligation Ditch Protection Bonds to the Seattle -First National Bank, be passed as read: carried, Barber, Keith, Larson, Lemon and Robinson voting aye on roll call. Bostic and Maxwell absent., RESOLUTION NO. D -271, A RESOLUTION awarding the bid for the $45,000.00 General Obligation Ditch Protection Bonds to Seattle -First National Bank. WHEREAS, the people of the City of Yakima have heretofore authorized the issuance of $45,000.00 of General Obligation Gonds for ditch protection, and WHEREAS, the City of Yakima duly and regularly called for bids for the purchase of said bonds, and WHEREAS, bids were submitted by Seattle -First National Bank, Seattle, Washington; the National Bank of Commerce, Seattle, Washington; the Bank of Yakima, Yakima, Washington; the National Bank of Washington, Tacoma, Washington; and the State of Washington, Office of the State Finance Committee, and WHEREAS, the said Seattle -First National Bank submitted the low and best bid for the purchase of said bonds, and the City Council finds that it is in the best interests of the people of the City of Yakima to accept.said bid and to award the purchase of said bonds to said Seattle First National Bank; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the purchase of the $45,000.00 General Obligation Ditch'Protection Bonds is hereby awarded. to Seattle -First National Bank of Seattle Washington, in accordance with the bids submitted by it to the City of Yakima on May 24,,191, and the City_Manager and City Clerk are hereby authorized and directed to return all bid deposits to the other said bidd ADOPTED BY THE CITY COUNCIL this 31st day of May, 1961. Moved by Robinson, seconded by Keith that Resolution No. D -272 extending the retirement age of Leon B. Sheeley, Sr., Superintendent of the Municipal Garbage Collection Service for the City of Yakima, for one year or until July 1, 1962, in accordance with the statue for Statewide City Employees Retirement System, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Bostic absent. RESOLUTION NO. D -2729 A RESOLUTION extending the retirement age of Leon B. Sheeley, Sr. WHEREAS, Leon B. Sheeley, Sr., is an employee of the City of Yakima and under the Statewide City Employees Retirement System, and WHEREAS, the said Leon B. Sheeley, Sr., will reach the extended retirement) age of 67 by July 1, 1961, and WHEREAS, the said Leon B. Sheeley, Sr., is satisfactorily performing his duties as a city employee and is in good physical condition and health, and it is deemed in the best interests of the City of Yakima to extend the retirement date of the said Leon B. Sheeley, Sr., for one year, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the retirement date of Leon B. Bostic absent. RESOLUTION NO. D. 273, A RESOLUTION transferring the sum of $250.00 within the Capital or Betterment classification of the 1961 appropriation for 24 - Engineering Department. WHEREAS, there is a surplus of money in Account 6 -61, Furniture & Fixture: of the Capital or Betterment classification of the 1961 appropriation for 24 - Engineering Depart= ment, and WHEREAS, at the time -of the adoption of the 1961 Budget, it could not have reasonably been anticipated that additional money would be required in Account 6 -51, Office Machines & Equipment, of the Capital or Betterment classification, for the replacement of a drafting machine which was formerly available for use by the Engineering Department but which has now been moved to the Planning Department, and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and the action contemplated herein is authorized by R.C.W. 35.33.120. now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the sum of $250.00 is hereby transferred from Account 6 -61, Furniture & Fixtures, to Account 6 -51, Office Machines & Equipment, all within the Capital or Betterment classification of the 1961 appropriation for 24 - Engineering Department, Section 2. LARSON Mayor Pro Tem Moved by Robinson, seconded by Keith that Resolution No. D -274 authorizing the City Manager and City Clerk to execute an agreement with the Washington State Highway Commission for the reloca- tion of domestic water lines and storm sewer lines in conjunction with the Terrace Heights Way Interchange, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Bostic absent. RESOLUTION NO. D -274, A RESOLUTION authorizing the City Manager and the City Clerk to execute an Atreement with the State of Washington, Washington State Highway Commission, for construction re- location and /or adjustment of domestic water lines and storm sewer lines in conjunction with the Terrace Heights Way Interchange. WHEREAS, the State contemplates the improvement of Primary State Highway No-3, Terrace Heights Way Interchange, in Yakima County, and WHEREAS, the proposed improvement requires the construction, relocation and /or adjustment of existing domestic water lines and storm sewer lines owned by the City, and WHEREAS, it is mutually agreed to be in the best public interest for the construction, relocation and /or adjustment of the storm sewer facilities and adjustment of man holes and water valve boxes to grade to be included as items of work in a forthcoming State con- struction contract proposed for the improvements of this section of State Highway with the water line adjustments to be made by the City at State expense, and WHEREAS, it is necessary that an Agreement be entered into with the State of Washington, Washington State Highway Commission, for such construction, relocation and /or adjustment, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the City Clerk of the City of Yakima are hereby authorized and directed to enter into an Agreement with the State of Washington, Washington State Highway Commission, for the construction, relocation and /or adjustment of domestic water lines and storm sewer lines in conjunction with the Terrace Heights Way Interchange, a copy of which said Agreement is hereto attached and by this reference incorporated herein and made a part here- of. Larson Mayor Pro Tem Assistant Mayor Larson reminded all present that there would be no City Council meeting on the 7th day of June as members of the Council will be attending the Convention of the Association of Washington Cities, in Seattle. Councilman Lemon introduced the matter of litter in the city, particularly surrounding the drive - in restaurants and asked if anything could be done about it. City Attorney Arntson cited an ordinance wherein persons throwing refuse on streets and sidewalks are declared to be disorderly. and liable for fine. No formal action was taken on this matter. The matter of uniform street names in the City was discussed and it was suggested that this matter be considered by the Planning Commission on an area by area basis keeping the matter before the public at all times. MOVED by Maxwell, seconded by Robinson that the Planning Commission under- take a study supplementing their report made in February 1961 and include specific recommendation; regarding the lack-of uniformity of street names on several of the east west streets:: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote.
