The City Council met in regular session, Mayor Bostic, Councilmen Barber, Keith, Larson, Lemon,
Maxwell and Robinson, City Manager Smith, and City Attorney Arntson present on roll call.
The invocation was given by Councilman Larson.
The minutes of the regular meeting of March 29, 1961 were approved as read.
This being the time fixed by the City- Council for a hearing on Petition No. 75 as filed by the
Yakima Valley Junior College requesting the vacation of a public utility easement located North
of Prasch Avenue between-13th and 14th Avenue, and there being no protests in writing or other-
wise, it was MOVED by Lemon, seconded by Keith that Ordinance No.. 234 providing for the vacation
of said property, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and
Robinson voting aye on roll call.
ORDINANCE NO. 234, AN ORDINANCE providing for`the vacation of a certain public utility easement
in favor of the City of Yakima, Washington, across the-following described property, to -wit: The
East 10 feet of the West 145 feet of Lot 15; the East 10 feet of the West 145 feet of Lot 14; and
the East 10 feet of the West 145 feet of the South Half of Lot 13, all in Johnson's Orchard Home
Tracts, according to the official plat thereof, now on file and of record in the office of the
Auditor of Yakima County, Washington.
The State Highway having requested that the parking be discontinued on the East side of Yakima
Avenue between 8th and 9th-Street for the purpose of further developing the approach to the By=
Pass Highway and an ordinance amending the traffic code in this respect, having been read by the
Clerk of the Council, it was MOVED by Robinson, seconded by Barber that said ordinance be passed
as read. After discussion, and it having been determined that the property owners in this area
have not been informed of this action, it was MOVED by Maxwell, seconded by Lemon that the motion
to pass the ordinance be tabled for one week and the people in this area be notified of this
action in order that they may appear and be heard for or against said action. carried, Barber,
Bostic, Keith, Larson, Lemon and Robinson voting aye by voice vote.
In accordance with action taken by the City Council at their regular meeting of February 15, 1961
on Petition No. 68, as filed by the Washington Canners Cooperative, requesting the vacation of a
portion of Lenox Avenue, and in connection with a judgment in the second cause of action in Cause
No. 3$$34 in Superior'Court of the State of Washington against the City in favor of the Washingto
Canners Cooperative, it was MOVED by Larson, seconded by Barber that the resolution as read by
the Clerk of the Council, authorizing the execution of an agreement with said Washington Canners
Cooperative, be passed as read. Members of the Council having discussed said agreement with Mr.
Tom Paddison, Manager for the Washington Canners Cooperative and Mr. Douglas Wilson, Attorney for
said firm; who were present at this meeting, and having recommended certain changes in said
agreement, it was MOVED by Robinson, seconded by Maxwell that the motion to pass the resolution
be tabled for one week: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voti
aye by voice vote. Mr. Padd.ison and Mr. Wilson stated that their primary concern was that no
structure be built on the easement for utilities that would prohibit their free operation and
access to the Washington Canners property.
Members of the Council believing that the aforesaid agreement can be completed before the date of
hearing on Petition No. 68, it was MOVED by Maxwell, seconded by Barber that Resolution No. D -248
fixing the date of hearing at the hour of 3:00 P.M: on Wednesday, the 26th day of April, 1961 on
this matter, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and
Robinson voting aye on roll call.
RESOLUTION NO. D -24$,, BEFORE THE CITY COUNCIL OF THE CITY OF YAKIMA, STATE OF WASHINGTON
IN THE MATTER OF THE VACATION OF that
portion of Lenox Avenue situate upon
the following described premises:
The North 30 feet of Lot 52 and the
South 30 feet of Lot 53, all in St.
Paul's Acre Lots, according to the
official plat thereof; and the South
30 feet of the West 308 feet of the
Northeast Quarter pf Section 30, Township
13 North, Range 19, E.W.M.; all situate
in the City of Yakima', Yakima County,
Washington.
RESOLUTION NO. D -248
A RESOLUTION fixing the time for hearing on a petition for the vacation
of that portion of Lenox Avenue situate upon the following described premises in the City of Yaki
Yakima County, Washington, to -wit
and
now, therefore,
The North-30 feet of Lot 52 and the South 30 feet of Lot 53,
all in St. Paul's Acre Lots, according to the official plat
thereof, recorded in the office of the County Auditor of
Yakima County, Washington;
The South.' 30 feet of the West 30$ feet of the Northeast
Quarter of Section 30, Township 13 North, Range 19, E.W.M.,
situated in the City of Yakima, Yakima County, Washington;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That said petition shall be brought on for hearing and determination on
Wednesday, the 26th day of April, 1961, at the hour of 3:00 o'clock in the afternoon of said day,
at the office of the City Council of the, City of Yakima, at the City Hall in Yakima, Yakima County
Washington, or as soon thereafter as the same may be heard, and that notice of such hearing be
given as provided by law.

Moved by Robinson, seconded by Larson that Resolution No. D -249 providing for the transfer of
$400.00 in the 1961 Budget for—the—Finance Department, be passed as read: carried, Barber,
Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call.
RESOLUTION NO. D -249, A RESOLUTION transferring the sum of $400.00 within the Maintenance &
Operation classification of the 1961 appropriation for 12'- Finance Department.
-WHEREAS, a surplus exists in Account 7 -21, Professional & Legal, of.the
Maintenance & Operation classification of the 1961 appropriation for 12 - Finance Department,.and
WHEREAS,.at the time of the adoption of the 1961 Budget it could not have
been reasonably foreseen that additional moneys would be required in Account 7 -36, Uniforms, of
the Maintenance & Operation classification of the 1961 appropriation for 12 - Finance Department,
to place meter maintenance men in uniform and identify them to the general public as the only
authorized persons to open meters-; and
WHEREAS, the City Council finds it is in the best interests of the people
of the City of Yakima to make the aforesaid transfers,.and that.the action contemplated herein
is authorized by R.C.W. 35.33.120, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the -sum of $400.00 is hereby transferred from Account 7-
Professional-& Legal-, to Account 7 -36, Uniforms, within the Maintenance & Operation classifica-
tion of the 1961 appropriation for 12 - Finance Department.
Section 2. The Director of Finance is hereby authorized and directed to
make the aforesaid transfer.

Councilman Larson asked to be excused from the next 5 meetings of the Council. Granted.
City Manager Smith reported that the Animal Control Officer will be starting his duties on Monday
the 10th day of April, 1961, at which time he will be in Seattle for a couple of days for in-
structions. He also asked members of the Council to consider making their reservations for the
Association of.Washington Cities Convention which is to be held June 7 through the 9, 1961 in
Seattle at the Olympic Hotel. He also informed the Council-that there will be two National
Conventions to be held in Seattle this year which will be of interest to Council members, that
of the National Finance Officers Association and the American Municipal Association and he stress-
ed the importance of the Finance Officers convention.
There being no further business to come before the Council,it was MOVED by Keith seconded by
Lemon that we do now adjourn at the hour of 4:40 P.M; carried, Barber, Bostic, Keith, Larson,
Lemon, Maxwell and Robinson voting aye by voice vote.
