The invocation was given by Councilman Larson. Minutes of the regular meeting of March 1, 1961 were approved as read. Mayor Bostic,-deviating' from the prepared" Agenda, made a "st,atement" -for the news media and those persons pr.eseiit�� -with "regard to _the " completion "of - the "rehabilitation -'of the streets, a program which was started- iri_. 1960- - " -He stated' in- part -that --ma'hy ' businesses are- facing financial squeezes and-since­the -City of- YakitA''s- operations -is the'largest business -in Yakima, it should make it's share of'econbmies -'and requested that City- Manager Smith review the 1961'Budget and report to the Council ''where- this- bud bt can -be cut - to -- obtain $150 ",000:00, $100,000.00 of which is to pay a loan which was made fr6m- the 'Current Expense "Fund 'by "the° Street 'Department and used in the 1960 street - habilitation program' -and $50 ",000:00 to 'carry' 'on- this""street program in 1961. ORDINANCE NO. 224 ,AN•ORDINANCE-creating the position of Animal Control Officer within the- Department of Records, providing for the duties thereof, and declaring an emergency. An ordinance appropriating- the'siiin of- $17,983.00 from the unappropriated moneys in the Current Expense Fund to the records department for -the Animal Control Operations, was-read in its en- tirety by the Clerk -'of the- Council'And ordered laid on the table for one week, to be read and considered-at the next regular meeting of the City Council on March 15, 1961. " 225,' " AN "- ORDINANCE' relating to the keeping and control of-animals and fowl; pro- hibiting the running at large; - providing for 'the impounding, redemption, destruction or sale of animals; defining certain nuisances; defining offenses; prescribing penalties; repealing Ordinance -Nos. A� -160; A -459; 'A -x.67; ' A -1029; B;- 205.7, as amended by _ 209; Sub- Section 45 of Section land Section "4 of A -236 as- amended;- Sub - Section 0 -of Section 1 of B -$6; and all other ordinances or parts of ordinances in conflict herewith; saving certain offenses; and declaring an emergency. All persons present wishing to speak concerning the animal control ordinance and dog ordinances were heard. Moved by Larson, seconded by Keith that Ordinance No. 226 providing for the licensing; impounding and redemption of dogs, be- passed as read. After discussion, it was MOVED by Robinson, seconded by Barber that Section 5 bf'said ordinance'be "amended to make the penalty of $2.00 effective 30 days after the effective-date of-this ordinance and 30 days after the 1st day of February of each year "he eafter: carried, Barber, - Bostic, Keith, Larson, Maxwell and Robinson voting aye on roll call. Re original motion to pass- said--ordinance -was then restated and it was MOVED by Larson, seconded by Keith that Ordinance No: 226 providing for the licensing, impounding and redemption of dogs,'be passed as.amended: carried, Barber, Bostic, Keith, Larson, Maxwell and Robinson voting aye on roll call. ORDINANCE NO. 226; AN ORDINANCE providing for the licensing, impounding and redemption of dogs; defining and licensing dog and•cat kennels; providing a penalty for the violation hereof; and repealing'Ordinance Nos-,­A= 268- ��B -327 and " -B -1716 and all other ordinances or parts of ordinances in conflict herewith, saving certain offenses, and declaring an emergency. A resolution.authorizing -the execution "of an agreement with the Yakima County Humane Society being a part of the agenda on this date, it was informally agreed by the Council that this matter be set aside for one week and be given further study. RESOLUTION NO. D -23$, A RESOLUTION - author zing'the City Manager and the City Clerk to execute a Supplemental Agreement with Robert,F. Tormaschy. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: -That the - City-Manager" and- the- City. Clerk{ are -- hereby - authorized and direct- ed to execute on the" behalf -. of the - 'City -a - Supplemental- Agreement ,with Robert F. BOSTIC, Mayor A vacancy on-the City Council having been created by -the death of Mr. George L. Oliver, on Feb ruary 13, 1961, and Mayor'Bostic -now submitting the name of George -M. Lemon in nomination for this position, it was MOVED by Maxwell, seconded by Larson that Mr. Lemon be.and is herby appoint- ed to serve on-the City Council until the next regular municipal election in -1962: carried, Barber, Bostic, Keith, Larson, Maxwell and Robinson voting aye by voice vote. After discussion of various points concerning the collection of garbage with Mr. Reinhold Eichler, a private garbage hauler, who- was­present'at'-this meeting, and the City Council wishing to in- vestigate all phases of this ' operation, -it- was-MOVED by-Robinson,- seconded by Barber that the City Manager be and is hereby-aiuthorited "to call for bids from private haulers on the collection of Garbage in the City of Yakima: carried, Barber, "Bostic, Keith", Larson, Maxwell and Robinson voting aye by voice vote.J Councilmen asked that the specifications -for this project include a statement by the bidder 'as- to- whether or hot -he will - retain the-'employees now employed by the city; for this -work and whether or-not =-they are- interested in purchasing the equipment used by the city, for-this-operation. 'Tliey also.requested from " the`City -Manager, a statement showing the value of the equipment new used.by the city in this operation. Manager Smith reported that he'had met with-the officials -of'the Pacific Power and Light Company and the Old Union Ditch Company on"the.'matter of - "an agreement in'conhection with the Ditch Covering project as authorized 'by'the" vote of the people- in the general election `of November, 1960. He-also reported that.the staff will be calling for bids on this project on Friday of this week. Manager Smith reported that he had-been'invited: -tb -meet with the -Nob Hill Water Company Board, which he had done, and that they - 'are "still interested in buying water from the, City of Yakima to supplement their system during'their" peak- periods-. He further explained that if we were in a position to do this -it would''be- unnecessary -_to acquire -the Gilbert Well,,but that we are inter- ested in ,cooperating'- with - thee- Nob -Hill Water 'Company -in'" developing both systems especially from the standpoint of establishing &'-cross-connection 'between our two systems . for emergency supply. The City Manager recommending that we -do "not supply'water to the Nob Hill W.ater,Coi#pany in their heavy season but that we cooperate with said company it- developing both systems, it was MOVED by Barber, seconded by Robinson that the -City Council concur- with'the -City Manager in this matter and so•advise, the members.of the- .Board -for the- -Nob Hill-Water-Company R carried, Barber, Bostic, Keith, Larson, Maxwell and Robinson voting aye by voice vote. Mayor Bostic read a.letter from the President"of the- United States, John F. Kennedy urging that our cominunity- make - every - "effort to accelerate essential building and expenditure programs that will help reinvigorate our economy. There -being no further business'to come before the Couincil, it was-MOVED.,by Barber seconded by Larson that we do now adjourn - -at the- hour-of -4 :25 P.M,. carried, Barber, Bostic, ieith,-Larson, Maxwell and Robinson voting aye by voice vote.
