HomeMy WebLinkAbout05/01/1961 Business MeetingP 120 FEBRUARY 1, 1961 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Keith, Larson, Oliver and Robinson, City Manager Smith and City Attorney Arntson present on roll call. Councilman Maxwell absent. The invocation was given by Councilman Keith. The minutes of the regular meeting' of January 25, 1961 were approved as corrected. This being the time fixed by th @tRiuncil for the continuation of the consideration of Petition No. 67 as filed by Robert Alderson/praying for-.the annexation of certain property contiguous to the City of Yakima, and Mr. Alderson requesting that this matter be continued for one more week in order that the Liberty Savings & Loan may consider the matter of a 25 foot easement in connection with .his loan, it was MOVED by Barber, seconded by Larson that said request be granted and this matter be continued for one week or until the next regular meeting of the City Council 'on February 8, 1961: carried,, Barber, Bostic,'Keith, Larson, Oliver and Robinson voting aye by voice vote. Maxwell absent. Moved by Larson, seconded by Robinson that Ordinance No. 206 amending Ordinance No. A -236, the Penal Code, with regard to Assault and Battery, Attempted Assault and the use of Forb e', when lawful, be passed as read: carried, Barber, Bostic, Keith, Larson, Oliver and Robinson voting aye on roll call. Maxwell absent. ORDINANCE NO. 206, AN ORDINANCE amending Sub - Sections 3, 4 and 5 of Section 1 of Ordinance No. A -236 entitled, "AN ORDINANCE for preservation of the public peace, safety, morality and good order . in the City of Yakima, defining who are disorderly persons and vagrants; providing penalties for the violation thereof; repealing ordinances numbered 9, 11, 13, 18, 25, 49, 86, 163, 172, 172, 174, 1829 1939 213, 214, 215, 219, 22`3, 227, 241, 271, 286, 295, 433, 498, 521, 618, 634, 652, 720 730, 841, 857, A -19, A -29, A -31, A• -730 A -97, and A -134 and all other ordinances and part's of ordinances in conflict herewith and declaring an emergency. • " • The City Engineer having filed the assessment roll for L.I.D. No. 883, being the North 39th Avenue Paving District, with the City Clerk and having reported the completion of said district, it was MOVED by Oliver, seconded by Robinson that said Engineers report be accepted and the City Clerk be and is hereby authorized to give notice of hearing on said assessment roll by publicatib n and to each property owner as required by statute, for the hour of 3 o'clock P.M. on Wednesday the 1st day of March, 1961: carried, Barber, Bostic, Keith, Larson, Oliver and Robinson voting aye by voice vote. Maxwell absent. The City Engineer having filed the assessment roll for L.I.D. No. 885, being the Edgewood Paving District and now reporting the completion of said distict, it was MOVED by Larson,'seconded by Barber that said report be accepted and the City Clerk be and is hereby authorized to give notice of hearing on said assessment roll by publication and to each property owner as required by statute, for the hour of 3 o'clock P.M. on Wednesday the 1st day of March, 1961: carried, Barber Bostic, Keith, Larson, Oliver and Robinson voting aye by voice vote. Maxwell absent. City Attorney Arntson explained that the alley paving between Lombard Lane and Bonnie Doon Avenue, being a part of the construction work done in L.I.D. No. 885, has been completed as far as said local improvement district is concerned, but that easement for said alley could not be obtained from the owners of Lots 4 and 7 Lombard Quarter Acre Tracts,Unrecorded and therefore there is a section in this alley which�is_ not paved and in order to construct the alley for these two lots it will be necessary to acquire a quiet title to the property for this purpose and requested that the City Council grant authority to proceed with said Quiet Title Action. Members of.the Council feeling -that the majority should be served in this matter, it was MOVED by Robinson, seconded by Keith that the City Manager-and City Attorney be and are hereby authorized to proceed with Quiet Title Action to obtain property necessary to complete a continuous alley between Lombard Land and Bonnie Doone Ave., said property being a portion of Lots 4 and 7 Lombard Quarter Acre Tracts: carried, Barber, Bostic, Keith, Larson, Oliver and Robinson voting aye by voice vote. Maxwell absent. The City Engineer having filed the assessment roll for L.I.D. No. 887, being the Parkview Terrace Paving District, with the City Clerk and having reported the completion of said district, it was MOVED by Oliver, seconded by Barber that said report be accepted and the City Clerk be and is here• by authorized to give notice of hearing on said assessment roll by publication and to each propert; owner as required by statute, for the hour of 3 o'clock P.M. on Wednesday the 1st day of March, 1961: carried, Barber, Bostic, Keith, Larson, Oliver and Robinson voting aye by voice vote. Maxwell absent. The City Engineer having filed the assessment roll for - L.I.D. No. 890, being the Alley Paving in Block 310, with the City Clerk and having reported the completion of said district, it was MOVED by Robinson, seconded by Larson that said report be accepted and the City Clerk be and is hereby authorized to give notice of hearing on said assessment roll by publication and to each property owner as,required by statute, for the hour of 3 o1clock P.M. on Wednesday the lst day of March, 1961: carried, Barber, Bostic, Keith, Larson, Oliver and Robinson voting aye by voice vote. Mayor Bostic and Manager Smith reported on their trip to Olympia and the presentation of H.B.177 to the State Legislature and the efforts being made by cities to obtain 1 /20th of the Sales Tax now collected by the State. City Attorney Arntson reported on his trip to Olympia in connection) with those bills now being considered by the State Legislature having to do with the reorganiza- tion of Justice Court. Mayor Bostic feeling that more pressure must be brought to bear in order to get H.B. 177 passed, appointed Councilmen Robinson and Larson to meet.with the Chamber Board on Monday the 6th day of February, 1961 to solicit help for this purpose. The Electors of the City of Yakima having voted in favor of a $45,000.00 Bond issue for the purpose of covering open ditches in the City of Yakima, Manager Smith reported that he had met with the P.D. & L. and Old Union Ditch Company officials in connection with this matter, that certain agreements will be needed, that the total cost will be approximately $51,000.00, and that the specifications for said project will be ready in a week or ten days. Mayor Bostic asked to be excused from the regular meetings of the City Council on February 8th and 15th. There being no further business to come before the City Council,.it was MOVED by Barber, seconded by Oliver that we do now adjourn: carried, Barber, Bostic, Keith, Larson, Oliver and Robinson voting aye by voice vote.
