HomeMy WebLinkAbout09/21/1960 Business Meeting;8; M SEPTEMBER 21, 1960 The City Council met in regular session, Assistant Mayor Coombs presiding, Mayor Bostic having been excused from the next three regular meetings, at the regular meeting of September 14, 1960. Councilmen Barber, Burns, Larson, Oliver and Robinson, City Manager Allison and City Attorney Arntson present on roll call. The invocation was given by Councilman Barber. The minutes of the regular meeting, of September 14, 1960 were approved as corrected. In accordance with action taken by the City Council at their regular meeting of September 14, 1960 on Petition No. 58 as filed by A. R. Kern and others praying for the annexation of certain property North of Lincoln Avenue and East of Crescent Drive, an order fixing the date of public hearing at the hour of 3 otclock P.M. on. Wednesday,the 12th day of"October, 1960, was read by the Clerk of the Council. MOVED by Larson, seconded by Barber that said order be accepted and the City Clerk be and is hereby authorized to give notice of said hearing as prescribed by statute: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. Bostic absent. This being the time fixed for the hearing on Resolution No. D -170, being a resolution of inten- tion to improve certain property located on North 29th Avenue and Lincoln Avenue by the construe - Lion of pipe sewer in accordance with Petition No. 56, duly filed by Robert L. G-angl and others, and there being persons present wishing to be heard on this matter, Assistant Mayor Coombs called on Mr. Garret Anderson, a property owner in and adjacent to the district to be benefited by said improvement. Mr. Anderson asked that a certain piece of property now included in the district be deleted from said district, explaining that while he had a young peach orchard on the property now, he felt that the W. W. Robertson school would need said property when it expanded. City Attorney Arntson informed the Council that this request could not be granted at this point in the local improvement proceXdure,but that this adjustment could be made before the district is con- firmed and when the City Council sits as a Board of Equalization for the purpose of considering the spreading of assessments. Mr. Chad and Mr. Robert Gangle were also heard on this matter with regard to the cost if this property should be deleted. All persons.having been heard both for and against said resolution and petition, it was MOVED by Burns, seconded by Barber that Ordinance No. 161 providing for the construction of sanitary sewers in the vicinity of North 29th Avenue and Lincoln Avenue and creating L.I.D. No. 891, be passed as read: carried, Barber, Berns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 161 -A, AN ORDINANC =E providing for the improvement of certain property located in the vicinity of 29th Avenue North and Lincoln Avenue in the City of Yakima by constructing a pipe sewer with the necessary wye branches and the manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. An ordinance requiring the keeping of dogs on the premises of the owner or custodian thereof and an ordinance requiring the keeping of dogs within the beck and call of the owner or custodian, both ordinances providing for the submission of this matter to the qualified electors at the general election of November 8, 1960, were read by the Clerk of the 'Council. Manager Allison informing the Council that the beck and call ordinance is hard to administer and that the ordinance keeping dogs on'the premises is the most satisfactory, it was MOVED by Oliver, seconded by Larson that Ordinance .Noe 162 requiring the keeping of dogs on the premises of the owner or custodian thereof, be passed as read: carried, Barber, Coombs, Larson and Oliver voting aye on roll call. Burns and Robinson voting nay. Mr. Garret Anderson -being present,for the considera- tion of other matters on this agenda, was allowed'to register his protest to such action. The Council indicated that they felt that this is a matter for the voters of Yakima to decide. After discussion and it having been decided that said ordinance does not need to be an emergency ordinance, it was MOVED by Larson, seconded by Barber that Ordir_arne No. 162, be reconsidered: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. Bostic absent. MOVED by Robinson, seconded by Oliver that Ordinance No. 162 be amended by striking Section 4, the paragraph declaring said ordinance to be an emergency, and the title of said ordi-,a nce be corrected in accordance with this action: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. MOVED by Oliver, seconded by Larson that Ordinance No. 162 requiring the keeping of dogs on the premises of the owner or custodian thereof,,prescribing a ballot title and providing that this ordinance be submitted to the qualified electors of the City of Yakima at the general election of November 8, 1960, be passed as amended: carried, Barber, Coombs, Larson, Oliver and voting aye on roll call. AN ORDINANCE requiring the keeping of dogs on the premises of the owner or custodian thereof' except when on leash; defininf offenses; authorizing impounding and prescribing penalties, all subject to the referendum at the general election of November 8, 1960; and prescribing a ball Qt title. Moved by Burns, seconded by Larson that Ordinance No. 163 declaring a residence building and out building at 1319 Fairbanks Avenue to be a nuisance, requiring the abatement and removal of same, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on Roll call. Bostic absent. ORDINANCE NO. 163., AN ORDINANCE declaring a residence building, and out buildings at 1319 Fairbanks Avenue within the City of Yakima to be a nuisance, requiring the abatement and removal of the sarw, providing for serving of Ordinance, and directing the City Attorney of the City of Yakima to commence an action for abatement of said nuisance. Moved by Larson, seconded by Oliver that Resolution No. D -171, fixing the ballot titles for a special election of the City of Yakima to be held on November 8,• 1960, in conjunction with County' and State general elections, said titles covering, Street and Sewer Bondq Lenox Avenue Overpass Bonds, Taho.ma Cemetery Improvement Bonds, Fire Department Improvement Bonds, Sanitary Sewer Im- provement Bonds, Municipal Airport Improvement Fonds, `Traffic Signal Improvement Bonds, Ditch Protection Bonds, and City Hall Improvement Bonds, be passed as read: carried, Barber, Burns, Coombs, Larson, Olivier and Robinson voting aye on roll call. Councilman Burns qualified his vote by stating that his vote for the resolution is not an endorsement of the Bond Program. RESOLUTION NO., D- 174, A RESOLUTION of the City Council of the City of Yakima, Washington, fixing the ballot titles for a special election of the City to be called and held on November 8, 1960, in conjunction with County and State general elections to be held on said date. WHEREAS, it is deemed necessary and advisable that the City of Yakima issue and sell its unlimited tax levy general obligation bonds for certain different and specific purposes, and (Roll call recorded in error. Corrected at regular meeting of Sept. 28, 1960) 1 1 1 1 V 5 r C ICJ 1 67 SEPTEMBER 21, 1960 WHEREAS, the Constitution and laws of the State of Washington require that the questions of whether or not such bonds may be issued for such purposes must be submitted to the qualified electors of the City for their ratification or rejection, and WHEREAS, •the - Caunty and- State general elections will be held on November 81 1960, and WHEREAS, it is deemed necessary and advisable that a special election of the City of Yakima be called and held on said date in order to-- submit the questions of whether or not such bonds may be so issued to the qualified electors of the City and the laws of the State of Washington provide that the Auditors of each County have jurisdiction of and are re- quired by law to conduct all special elections for cities within the State that will be held on the same day as the County and State general elections, and WHEREAS, the City of Yakima lies entirely within the boundaries of Yakima County. . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA AS FOLLOWS: Section 1:. . That -a .spec -ia•1 election of the (-ity of Yakima shall be and is hereby called to be held within •sa -id- City .on- November 8, 1960, for the' purpose of submitting the following propositions to the qualified electors thereof: PROPOSITION NO. 1 STREET AND SEWER BONDS, 13'950,00 Shall the City of Yakima, to provide funds to acquire right -of -way for, widening certain streets; to improve certain streets by draining, grading, paving anc constructing curbs, gutters and sidewalks as found necessary by City Council; to install storm sewers; and to acquire construction equipment, issue general obligation bonds in the amount of $1,9.50,000, said bonds to bear interest at a rate of not to exceed 6%, to mature in from two to fifteen years from date, and to be paid, both principal and interest, out of annual tax levies to be made without -limitation as to rate or amount, all as more fully provided in Ordinance-No.- _of the City ? S . . . . . . . . . :'9 PROPOSITION NO. 2 LENOX AVENUE OVERPASS BONDS, $1,140,000 Shall the Qty of Yal�ima, to provide funds to construct a four -lane rail- road overpass on Lenox Avenue, together with approaches extending from South Sixth Street to Broadway Avenue on Lenox Avenue, and on South Sixth Street from Washington Street to Lenox Avenue; to acquire necessary right -of -way; and to ac- quire and-- install "traffic signals at South First Street and Lenox Avenue, issue general obligation bonds-in the amount-of $1,110,000, said bonds to bear interest at a rate of not to exceed 6%,, to- mature in from two to twenty ,years from date, and to be paid, both principal and interest, out of annual tax levies to be made without limitation as to rate or amount, all as more fully provided in Ordinance No. of the City? BONDS, NO . . . . . . . . 0 Z9 PROPOSITION NO. 6 MUNICIPAL AIRPORT IMPROVEMENT BONDS, $157,000 Shall the City of Yakima, to provide funds to acquire land east of Airport to provide a "clear zone" with necessary approach lighting; to relocate 16th Avenue around said "clear zone "; to costruct and equip a second -story on west wing, of Administration Building; and to landscape area between 16th and 24th Avenues on Washington, issue general obligation bonds in the amount of 157,000, said bonds to bear interst at a rate of not to exceed 6%, to mature in from two to .ten years from date, and to be paid, both principal and interst, out of annual tax levies to be made without limitation as to rate or amount, all as more fully provided in Ordinance'.'No. of the C'_ty? PROPOSITION NO. 9 CITY HALL IMPROVEMENT BONDS, $42,000 Shall the City of Yakima, to provide funds to reconstruct portions of City Hall; to acquire and install air - conditioning equipment in City Hall with controls to meet requirements of National Board of Fire Underwriters; and to acquire permanent office machines, issue general obligation bonds in the amount of `42,000, said bonds to -bear interest at a rate of not to exceed 6%, to mature in from two to ten years from date, and to be paid, both }principal and interest, out of annual tax levies to be made without limitati,o n as to rate or amount, all as more fully provided in Ordinance No. of the City? WHEREAS, the Yakima Development Committee has made a thorough study of the facilities of the City of Yakima and has held hearings and prepared reports making recommenda- tions and improvements in the various ffacets,and.activities of the City of Yakima and its bovernment, and WHEREAS, the City Council finds that the committee chairmen and members of said committee have unstintingly given of their time and efforts and have hereby made a. de- finite and valuable contribution to the City of Yakima and its people, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA : That all of the chairmen and the members of the Yakima Development Committe are hereby commended for their unstinting and valuable contributions to the people of the City of Yakima in studying the needs of the city and in preparing and making the recommendations to 1 1 L� fl 1 r 1 SEPTEMBER 21, 1960 the City Council for the improvements of the city. (S E A L) C'Ceal Coombs Mayor pro tem M Assistant Mayor Coombs informed the City Council that the Legislative Committee of the Association of Washington Cities would meet on October 11, 1960.at the hour of 8 P.M. in the City Hall, and that the City of Yakima should have 3 members of the Council on this committee as voting members for the City of Yakima. Councilmen Robinson, Burns and Larson were. nominated for voting members on said Legislative Committee., MOVED by Barber, seconded by Oliver that the nominations be closed and that Councilmen Robinson, Burns and Larson be the voting delegates on the Legislative Committee of the Association of Washington Cities: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by voibe:-vbte. Manager Allison requested members of the City Council to meet with him at the hour of 4 P.M. on Friday the 30th day of September, 1960, to consider the proposed budget for 1961. to members of the Council Clerk of the Council gave written notice /of the special public hearing,to be held at the hour of 3 P.M. on Monday, the 3rd day of October, 1,960 in accordance -with state statute, on the budget for 1961. Assistant Mayor Coombs, announced that the Yakima Development Committee would be reorganized to carry on through the November election and that Mr. E. Ellis Cummings will be the Chairman. She also announced that the Area Beautification Committee for Century 21 is,starting its fall activities. Assistant Mayor Coombs also announced that she would be out of town on Tuesday, September 27, 1960, and reminded the members of the Coucil that it'would be necessary for them to elect a temporary chairman in the absence of the Mayor and Assistant Mayor, in the case of any emergency. There being no further business to come before the Council, it was MOVED by Barber, seconded by Oliver that we do now adjourn at the hour of 1:40 P.M: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote.
