The City Council met in regular session, Mayor Bostic, Councilmen Barber, Burns, Coombs, Larson,
and Robinson, City Manager Allison and City Attorney Arntson present on roll call. Councilman
Oliver absent.
Invocation was given by Councilman Larson.
The minutes of the regular meeting of June 15, 1960 were approved as read.
In accordance with action taken by the City Council at the regular meeting of June 15, 1960, it
was MOVED by Burns, seconded by Coombs that Ordinance No. 129 designating an unnamed street ex-
tending east from North 40th Avenue and lying between Lincoln Avenue and Mavis Avenue as "Cook
Avenue ", be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, and Robinson voting
aye on roll call. Oliver absent..
ORDINANCE NO. 129, AN ORDINANCE designating an unnamed street extending east from North 40th
Avenue and lying between Lincoln Avenue and Mavis Avenue as "Cook Avenue."
This being the time for the hearing on Petition No. 46 as duly filed by Gerald G. Shore and
others,requesting the vacation of certain property located South of Bonnie Doone between 29th
and 30th Avenue and there being no protests in writing or otherwise, it was MOVED by Robinson,
seconded by Barber that Ordinance No. 130 providing for the vacation of said property, be passed
as read: carried, Barber, Bostic, Burns, Coombs, Larson and Robinson voting aye on roll call.
Oliver absent.
ORDINANCE NO. 130, AN ORDINANCE providing for the vacation of a certain public utility easement
across the following described property, to -wit: The East 8 feet of Lots 1, 2 and 3 of
Arlington Park, according to the official plat thereof recorded in Volume "0" of Plats, Page 40,
records of Yakima County, Washington.
A petition, being Petition No. 54, having been duly filed June 20; 1960 by Pat Roche and Aileene
Roche, requesting the vacation of an-alley 122 feet wide adjoining to the south of Lots 1, 2 and
3 of Block E Millview Addition, it was MOVED by Larson, seconded by Coombs that-said petition be
referred to the City Manager for action: carried, Barber, Bostic, Coombs, Larson and-Robinson
voting aye by voice vote. Oliver absent.
Moved by Barber, seconded by Robinson that Ordinance No. 131 transferring 250`::00 within the
Current Expense -City Hall 1960 Budget, said aruount being necessaar.y to take care of extra help
ford...- vacation.replacements for the Janitors, be passed as read: carried, Barber, Bostic,

ORDINANCE NO. 131, AN ORDINANCE transferring the sum of $250.00 within the 1960 appropriation
for 08 - City Hall.
The City of Yakima having entered into a Lease Agreement with Arthur A. Mitzlaff on March 30,
1960, leasing certain city owned property located at the Sewage Disposal Plant and Arthur A.
Mitzlaff now becoming ill and being unable to continue under the terms of said lease and having
.signed a Notice of Reli-r_quishment waiving any right that he miight have to the $90.00 on
deposit as payment for the last two months under said lease, it was MOVED by Burns, seconded by
Larson that Resolution No. D -149 cancelling said Lease Agreement with Arthur A. Mitzlaff, be
passed as read: carried, Barber,.Bostic, Burns, Coombs, Larson and Robinson voting aye on roll
call. Oliver absent.
RESOLUTION NO. D -149, A RESOLUTION cancelliq the Lease Agreement with Arthur A. Mitzlaff.
WHEREAS, on March 30, 1960, the City of Yakima entered into a Lease
Agreement w..th Arthur A. Mitzlaff wherein the City of Yakima leased the following described
premises situated in Yakima County, Washington, to -wit:
That portion of the NW4 of the SW4 of Section 28, Township 13 N.,
Range 19, E.W.M. lying -W of the Yakima River and S. of the Yakima River
Bridge Approach and that portion of the N2 of, \the SW4, of the SW4 of
Section 26, Township 13 N., Range 19, E.W.M. - ..ying W. of the Yakima
River, and Tract 40, S2 Tract 33, E. 250.754fe,et �o,f N2 Tract 33, E.
250.75 feet Tract 32, and the E. 250.75 feet of Tract 25 lying S. of
Yakima River Bridge Approach, of Goodwin's Five Acre Tracts, also the
E2 of the E2 of the N2 of the SE4 of the SE4 of Section 29, Township
13 N., Range 19, E.W.M. and containing approximately 42.7 acres.
for a period of 36 months under certain terms and conditions as therein set forth, said Lease
Agreement being authorized by Resolution No. D -1.18, adopted by the C -1_ty Council on March 30,
1960, and
WHEREAS, the said Arthur A. Mitzlaff has become ill and unable to perform
under the terms of said Lease Agreement and has notified the City of his relinquishment of all
rights under said lease agreement and has requested the City to cancel said lease agreement and
waive any right that he might have to the return to him by the City of the $90.00 retained by the
City as payment for the last two months rent under said lease agreement, and
WHEREAS, the City Council finds it in the best interests of the people of
the City of Yakima to cancel said lease agreement, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That that certain lease agreement entered into on March 30,
1960, for the leasing by the City to Arthur A. Mitzlaff for a term of 36 months, those certain
premises hereinabove described, is hereby cancelled and all rights of the said Arthur A. Mitzlaff
in and to said premises are hereby terminated.
Section 2. That the sum of $90.00 paid to and retained by the City of
Yakima as the payment for the last two months under the terms of said agreement is hereby de -:.
clared forfeited to the City and. shall be retained by the City as liquidated damages.

The Lease Agreement of Arthur A. Mitzlaff dated March 30, 1960 having been duly and properly
cancelled by Resolution No. D -149, and, at the time of taking bids for said lease for certain
property located at the Sewage Disposal Plant, Robert C._ Dunbar being the second highest bidder
and Mr. Dunbar being willing to enter into a lease agreement with the City of Yakima on the
same terms as the agreement with Mr. Mitzlaff, it was MOVED by Larson, seconded by Robinson
that Resolution No. D -150 authorizing the execution of a lease agreement with Robert C. Dunbar
for said property, be passed as read: carrried, Barber, Bostic, Burns, Coombs, Larson and
Robinson voting aye on roll call. Oliver absent
RESOLUTION NO. D -150, A RESOLUTION authorizing the City Manager and City Clerk to enter into a
Lease Agreement with Robert C. Dunbar.
WHEREAS, on March 30, 1960, the City of Yakima entered into a Lease
Agreement with Arthur A. Mitzlaff wherein the City leased the following described premises situ -
ated in Yakima County Washington, to -wit:

WHEREAS, on the 22nd day of June, 1960, said lease agreement was cancelled)

WHEREAS, at the time of taking bids for the lease of said premises,
Robert C. Dunbar was the next bidder and is willing to enter into a lease agreement with the
City upon the same terms as the lease agreement entered into between the City and the said Arth
A. Mitzlaff, but upon the amount submitted in his bid, to -wit: the sum of $37.50 per month,
and for the balance of the term of the lease agreement with the said Arthur A. Mitzlaff, and
WHEREAS, the grass upon said premises is now becoming very long and needs
to be cut, and if not cut.prior to the time that the industrial wastes sewer is put in operation
offensive odors will be erdated by the.spraying of the industrial waste materials upon such
grass, and because of said fact an emergency is declared to exist and the City Council finds it
in the best interests of the people of the City of Yakima to enter into such a lease agreement
with the said Robert C. Dunbar without calling for bids therefor, now, therefore,
BE IT RESOLVED RY THE CITY COUNCIL OF THE CITY OF YAK1-MA:
That the �'ity Manager and City Clerk of the City of Yakima are hereby
authorized and directed to enter into a lease agreement with Robert C. Dunbar for the herein -
above described -real property situated in Yakima County, Washington, a copy of which agreement
is hereto attached and by this reference made a part hereof.

RESOLUTION NO. D -152, A RESOLUTION transferring $810.00 within the 1960 appropriation for 33 -
Airport and the sum of $1400.00 within the 1960 appropriation for 51 - Irrigation Department.
WHEREAS, surplusses exist in Account 7 -27 Service - Other Departments, 7 -3:
Publications and 7 -54 Heat and 'Fuel of the Maintenance and Operations Classification of the 1960
appropriation for 33 - Airport, and
WHEREAS, additional monies are needed in Accounts 7 -32 Janitorial Supplies
7 -43 Building Supplies and Repairs, 7 -55 Light and Power, 7 -57 Telephone- and Telegraph, 7 -12
Social Security and 7 -60 State Tax of the Maintenance and Operations Classification of the 1960
appropriation for 33 - Airport, with which to complete the year, and
WHEREAS, surplusses exist in Account- T -08 Extra Helpcf the Salary Classi-
fication, 7 -43 Building Repairs and 7 -86 Water Assessments of the Maintenance and Operations
Classification, and in Account 6 -71 Non- Operating Equipment of the Capital or Betterment
Accounts Classification, all within the 1960 appropriation for 51 - Irrigation Department, and
WHEREAS, because of the installation of a new concrete irrigation main by
the State Highway Department more inspection was required and.because of the construction and
installation of-the pump at the new pumping station at North 28th Avenue and Lincoln more over-
time was required thath had been anticipated at the time of the adoption of the 1960 Budget for,
51 - Irrigation Department, and
WHEREAS, additional funds are required in Account 7 -27 Other Departments
to pay the Street Department for street repairs occasioned by a new water line installation, and
WHEREAS, more funds are required in Account 6 -31 of the Capital or Better-
ment Accounts Classification of the 1960 appropriation for 51 - Irrigation Department to pay for
equipment needed at the new pumping house at North 28th Avenue and Lincoln because the -cost of
the machinery installed therein exceeded the estimate,.and
WHEREAS, the City Council finds it in the best interests of the people of
the City of Yakima to make the transfers herein provided and the action contemplated is author-
ized by R.C.W.35.33.120, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAK IMA:

Councilman Coombs reminding the City Council that the 25th Annual Institute of Government will
be held at the,University of Washington in Seattle on July 6, 7 and 8, 19U6 it was MOVED by
Robinson, seconded by Burns that Councilman Coombs, City Manager Allison /any staff member chosen
by him, be and are hereby authorized to attend said Institute with their expenses paid: carried,
Barber, Bostic, Burns, Coombs, Larson and Robinson voting aye by voice vote. Oliver absent.
Mrs.
Mayor Bostic reported that he had appointed Mrs. Rudolf Schmidt and /Don Caldwell to the. Area
Beautification Committee for Century 21.
The City Council acknowledged and expressed thanl�s and appreciation for the. 50 star Flag donated
by the Veterans of Foreign Wars.
Manager Allison reported that he was investigating the possibilities of a drive -in arrangement
or a depository of some type, where customers can pay water bi -lls without coming into City Hall.
Manager Allison recommended that Ordinance No. B -2192 which fixes the charges for hooking up to
City Sewers in Lieu of L.I.D "., be amended and the charges for such service be increased. The
City Council indicated, without formal action, that an ordinance should. be-prepared on this matte
There being no further business to come before the Council, it was MOVED by Barber, seconded by
Robinson that we do now adjourn at the hour of 4:20 P.M.'i carried, Barber, Bostic,. Burns,
