The minutes of the regular meeting of Monday, August 22, 1955 were approved as read. r This being the time /for the hearing on the assessment roll covering L.I.D. No. $05 pro- viding for the paying of the alleys in Block 28 Yakima and Block 351 Capitol Addition and there being no objections in writing or otherwise to said assessment roll or any pa thereof; it was MOVED by Huey seconded by Burns that Ordinance No. B -1734, confirming said assessment roll and every part thereof be passed as read: carried, Burns and Huey voting aye on roll call. Huza absent. � ORDINANCE NO. B -1734, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 805 as created and established by Ordinance No. B -1680 of the Ordinances of the City Of Yakima. This being the time for the hearing on the petition of D. R. Carrell and others for the annexation of beginning at the intersection of the center line of South First Street and Mead Avenue; thence east along the center line of Mead Avenue 485 feet; thence south 450 feet; thence west to the center line of South 1st Street; thence north along-the center line of South lst Street to the point of beginning, situate in Yakima County, Washington, and there being no objections in writing or otherwise, to said annexation or any part thereof; it was MOVED by Huey, seconded by Burns that Ordinance No. B- 1735, annexing said territory and every part thereof, be passed as read: carried, Burns and Huey voting aye on roll call. Huza absent. ORDINANCE NO. B -1735, AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima, Washington. Moved by Huey seconded by Burns that Ordinance No. B =1736, providing for the grading, baDasting, surfacing and construction of concrete curbs and gutters on Lots 1 to 16 inclusive, of Block 2, Shannon Homes Addition, and creating L.I.D. No. 819, be passed as read: carried, Burns and Huey voting aye on roll call Huza absent.)/ ORDINANCE NO. B -17369 AN ORDINANCE providing for the improvement of, /certain property by grading, ballasting, surfacing and constructing concrete curbs and butters; establishing • local improvement district, providing for the method of payment therefor, and creating • special fund. Moved by Huey, seconded by Burns that Resolution No. C -1277 providing that the City participate with the State Highway Department in the installation of a signal light at the intersection of North 16th Avenue and Fruitvale Blvd.,together with the provisions of payment thereof, be adopted as read: carried, Burns and Huey voting aye on roll call Huza absent. RESOLUTION NO. C -1277, WHEREAS, it ha -s been deemed necessary and desirable that a traffic control signal light be installed at the intersection of North 16th Avenue and Fruitvale Boulevard in the City of Yakima, and it appearing to the best interest of the City of Yakima to participate with the State Department of Highways in the installation of said signal light; and it further appearing.that Cascade Electric Company has sub- mitted the low bid of $1743.00 for said traffic signal light and, that the installation of said light will be made by said State Department of Highways; that the estimated cost of materials to be furnished by the Department of Highways is the sum of $2500.00 and that an estimated $500.00 will be needed for traffic control and miscellaneous costs incident to said installation, and that the City of Yakima shall participate to the ex- tent of 50% of the overall costs and expenses of said traffic signal light and installa- tion, but not exceeding the sum of $2500.00; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: %" That the bid of Cascade Electric Company in the sum of $1743.00 be accepted for a vehicle activated traffic signal light to be installed by the State Department of Highways at the intersection of North 16th Avenue and Fruitvale Boulevard in the City of Yakima, and that the City of Yakima shall participate in the installation of said traffic control light by paying 50% of the overall costs and expenses of said traffic control light_ _:nd installation to -.the Department of Highways out: of funds which are being provided for said purpose in the.-1956 budget of the City of Yakima, in the sum required but not exceeding 42500.00, upon presentation of proper vouchers therefor, and the appropriate city officials are hereby authorized and directed to do any and all things necessary for carrying out this resolution. C -127$1 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its. intention to improve the property within the following described district, by construction pipe sewers with the necessary Wye branch- es, manholes and flush tank; all of said improvements to be constructed in full accord- ance with the plans and specifications to be prepared by the City Engineer and filed witY the City Clerk. The district to be served by and specially benefited by and assessed for the above - described improvement is situate in the City of Yakima, Yakima County, Washington, and is described as follows: The Southwest quarter of the Northwest quarter of the Northwest quarter of Section 36, Township 13 North, Range 18, E.W.M. 3 r- 6'3 4 AUGUST 29, 195,E All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objection, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock a.m. on Monday, the 19th day of September, 1955, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for dtermining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. All costs and expenses in connection with the construction of said improvement, including the cost of engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against the above described property embraced within said Local Improvement District as provided by law; and the City Engineer is hereby directed to submit to the City Commission at or prior bo the date herein fixed for said hearing, all of the data and other information required by law to be by him submitted. C -1279, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to construct an irrigation system to serve the following described property, situate in the City of Yakima, Yakima County, Washington, to -wit: Lots 1 to 19, inclusive, Glenview Addition to the City of Yakima, according to the official plat thereof recorded in the office of the Auditor of Yakima County, Washington; said improvement to consist of the construction of the necessary main, lateral, service connections, and other appurtenances to deliver water for irrigation purposes, to each lot within the proposed district; and to be constructed in full accordance with the plan: and specifications to be prepared by the City Engineer and filed with the City Clerk. Huza absent. RESOLUTION NO. C -1280, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve 38th Avenue North from Summitview Avenue to the north line of Glenview and Mavis Avenue from 38th Avenue North to the Yakima Valley Canal Cots right -of -way by grading, gallasting, surfacing and con- structing concrete curbs and gutters, together with the necessary drainage features. The district to be served by and assessed for the above described improvement is situate in Yakima County, Washington, and described as follows, to -wit: Lots 1 to 19, inclusive, of Glenview and vacated Knobel Avenue from 38th Avenue North to the Yakima Valley Canal Cots right -of -way, in the City of Yakima, Yakima County, Washington. All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock a.m. on Monday, the 19th day of September, 1955; which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of pay- ment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing, and of the intention to make the aforesaid improvement. BURNS Mayor Moved by Huey, seconded by Burns that the claim of Pacific Gamble Robinson'Company doing business as the Pacific Fruit & Produce Company in the sum of $750.00 for damages alleg- ed to have been sustained by reason of a rain storm on the nib t of July 23, 1955, caus- ing the sewer lines to overflow and damaging merchandise at the place of business of said Company, at 129 South First Street is hereby rejected: carried, Burns and Huey voting aye on roll call. Huza absent. Moved by Huey, seconded by Burns that the City Engineer having reported the completion of the improvement of constructing a domestic water system on Douglas Drive, L.I.D. No. 803, said work is hereby accepted, and the City Engineer is hereby instructed to prepare an assessment roll for said district, and the City Clerk authorized to give notice of hear- ing on said roll for Monday, the 19th of September 1955 at 10 otclock a.m..:. carried, Burns and Huey voting aye on roll call. Huza absent. Moved by Huey, seconded by Burns that the City Clerk is hereby authorized and instructed to give notice to bidders for the construction of curbs and gutters, L.I.D. 819; said bids to be received on Monday, the 12th day of September 1955 at 10 o'clock a.m.: carriec Burns and Huey voting aye on roll call. Huza absent. Moved by Huey seconded seconded by Burns that upon recommendation of the .Planning Commission that Section 15 (g1 of Part IV of the Zoning Ordinance Area District be amended to allow for a set back of 50 feet for parking purposes, be granted and the City Attorney instructed to prepare the necessary ordinance therefor: carried, Burns and Huey voting aye on roll call. Huza absent. This being the time for receiving bids for the purchase of two police cars for that Department, the bid of Bell -Wyman Company in the sum of $2722.40 for both cars being the only bid received, the same was taken under advisement: carried, Burns.and. Huey voting aye on roll call. Huza absent. Moved by Burns, seconded by Huey that we do now adjourn to Wednesday, August 31st, 1955, at 10 o'clock a.m.: carried, Burns and Huey voting aye on roll call. Huza absent. ADJOURNED MEETING, WEDNESDAY, AUGUST 31, 1955, 10 OCLOCK, A.M. The City Commission met pursuant to adjournment, Mayor Burns and Commissioners Huza and Huey present on roll call. Moved by Huza, seconded by Burns that Resolution No. C -1281 providing for the transfer of $100,000.00 from the Water Department to the Current Expense Fund which was passed and approved in the 1955 budget, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -12$11 WHEREAS, an emergency exists by reason of the fact that the Current expense Fund of the City of Yakima is now short of funds; and that on page 9 of the 1955 budget Ordinance No. B -1606, passed and approved on October 8, 1954, provides for a transfer to the current expense fund of the sum of $100,000.00, the same being a portion of the surplus cash funds on hand of the City Water Department; and according to the opinion of the Attorney General and the City Attorney such transfer is lawful; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the said sum of $100,000.00 being a portion of the surplus. cash funds on hand in the City Water Department fund, is hereby transferred to the Current Expense fund of said city; and the expenditure thereof for any;,and all purposes, for any and all purposes for which said Current Expense Fund may be lawfully expended is hereby fully and in all respects authorized and approved; and the appropriate city officials are hereby authorized, empowered and directed to do any and all things necess@y or proper for carrying out this resolution.
