The minutes of the regular meeting of August 8, 19-55, recessed and adjourned meetings th of were approved as read. This being the time for the postponed hearing on the assessment. roll covering L.I.D. No. 785, providing for the construction of curbs and gutters on 9th Avenue North from Willow Street to Fruitvale Boulevard, and there being no further objections from property owners in said district, it was MOVED by Huza, seconded by'Burns that Ordinance No. B -1726, con- firming said assessment roll and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B- 1726;. AN ORDINANCE confirming the assessment roll covering Local Improve ment District No. 785 as created and established by Ordinance No. B -1593 of the Ordinance of the City of Yakima. This being the time for for'the construction of, objections in* writing o: MOVED by Huey, seconded' and every part thereof, roll call. a hearing on the assessment roll covering L.I.D: -No. 792, providi a domestic water system on Westvie�7 Addition, and there'being no otherwise to said assessment roll, or any part thereof, it was by Huza that Ordinance No. B -1727, confirming said assessment rol be passed as read: carried, Burns, Huza and Huey voting aye on ORDINANCE-NO. B- 1727,. AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 7.92 as created and established by Ordinance No. B -1610 of the Ordinances of the City of Yakima. This being the time for the hearing on the assessment roll covering L.I.D. No. 794, pro- viding for the construction of a curb and gutter district on 17th Avenue Soiith,.and there being insufficient protests by property owners in said district to said assessment roll, or any part thereof, it was MOVED by Huza, seconded by•Burns that Ordinance No. B -1728, con- firming said assessment roll and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1728, AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 794 as created and established by Ordinance No. B -1616 of the Ordinances of the City of Yakima.' Moved by Huey, seconded by Huza that Ordinance No. B -1729; providing for the rezoning of Lots 16 and.17.,- Block 414, and the North 180 feet of Block A, Bedker's Second Addition, be changed from 1!B" Residence to "C" Residence, and that Lot 19 and the South 12 feet of Lot 20, of NeilanVs Memorial Heights Addition, be changed -from "All Residence to "B" Residence; also Lot 16', Block 412, Capitol Addition, be changed from "B" Residence to "C" Residence, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. • ORDINANCE'NO. B -1729, AN ORDINANCE rezoning certain specific property situate in the City of Yakima, Yakima County, Washington. Moved, by Huey, seconded by Huza that Resolution hto. C =1272, being a. resolution of intenticn to improve Lots 1 to 13, inclusive of Chestnut Park Addition, by the construction of a s6wer system, and fixing the date of hearing on said resolution as of Tuesday, September 6, 1955, at 10 oo.clock a.m., be adopted as read: carried, Burns, Huza.and Huey voting aye on roll call. RESOLUTION NO. C -12721 BE IT- RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the property within the follow ing described district, by constructing pipe sewers with the necessary wye branches and manholes; all of said improvements to be constructed in full.accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. The district to be served by and specially benefited by and assess• ed for the.'above described improvement is situate in the City of Yakima, Yakima County, Washington, and is described as follows: Lots 1 to 13,inclusive, of Chestnut Park Addition, Yakima, Yakima County, Washington. - All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objection, if any, at a meeting of the City Commission'to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock A.M. on Tuesday, the 6th day of September, 1955; which time and place are hereby fixed for the hearing of all matters relating to said pro- posed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. All costs and expenses in connection with the construction of said improvement, including the engineering, inspection, advertising, publication of notices, cost of acquiring right- of- way.easements and all other expenses incident thereto, shall be levied and assessed against the above described property embraced within said Local Im-' provement District as provided by law; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date herein fixed for said hearing, all of.the data and other information required by law to be by him submitted. RESOLUTION NO. C -12731 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the East side of 26th Avenue South beginning at a point 100 feet South of the South line of Tieton Drive and extending South 2.60.feet by grading, ballasting, surfacing and constructing a concrete curb and gutter. The district to'be served by and assessed for the above described improvement is situate in Yakima County, Washington, and described as follows: Beginning at a point on the North line of Nob Hill Boulevard 140 feet East of the East line of 26th Avenue South; thence northerly and parallel with 26th Avenue South to Tieton Drive; thence west- erly along Tieton Drive a distance of 330 feet; thence southerly and parallel with 26th Avenue South to Nob Hill Boulevard; thence easterly along said Boulevard to the point of beginning. BURNS Mayor Moved by Huza, seconded by Burns that Resolution No. -C -1274 authorizing,.approving and consenting'to Change Order No. 1 and Change Order No. 2 with reference to the Englewood Heights'reservoit, and instructing the City Commission .to execute a contract with Cornell Howland; Hayes and Merryfield and Big Bend, Inc. to that effect, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C- 12743 BE IT RESOLVED-BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the City of Yakima does hereby authorize, approve and consent to Change Order No. 1 dated August 6, 1955, by Cornell, Howland,.Hayes & Merryfield, Con- sulting Engineers, with reference to the Englewood Heights reservoir and pump station construction project and the contract with Big Bend, Inc. for the construction thereof, and that the City shall pay said contractor the sum of $269.00 as additional compensation for the extra work involved in the changes in the reservoir overflow and drain lines ne- cessitated by a change in location of said lines, and also, Change Order No. 2 of said consulting engineers with reference to said project and that the City shall pay to said contractor the sum of $1,878.92 as additional compensation.for extra work involved due to a change.in the location of the.pump station; it appearing that both of said change order are advatageous to the city and will result in a definite saving to it. BURNS Mayor Moved by Huey, seconded by Burns that Resolution No..0 -1275, granting permission to the Medical Center to construct and maintain a covered bench for waiting passengers at the corner of South 11th Avenue and West Spruce Street,be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1275, WHEREAS, Yakima Medical Center, Inc. units No. 1, 2, and 3, have heretofore requested permission "to construct and maintain a covered bench for waiting bus passengers as hereinafter provided and have executed and delivered a suitable indemnity agreement to the City of Yakima; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That said Yakima City Commission does hereby accept and approve said indemnity agreement, and on the basis therein stated does hereby grant permission to said parties to construct and maintain at their expense a covered bench for waiting bus passengers a,t,the corner of South 11th Avenue and Spruce Street in said.City, subject to said indemnity agreement and subject to the right of the City to require removal thereof in the future. Moved by Huey, seconded by Huza that the postponed hearing on Resolution No. C- 1248, being a resolution of intention to improve Thornton Lane from Buwalda Lane to North 4th Street by grading, ballasting., surfacing.and constructing concrete curbs and gutters, be abandoned at the present time: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Engineer- having reported the completion'of the Mead Avenue domestic water. district, L.I.D. No. 796, said work is hereby accepted, and the City Engineer was instructed to prepare.an.assessment roll for said district, ant the City Clerk authorized to give notice of hearing on said assessment roll, for Monday, the 12th day of September, 1955, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Engineer having reported the completion of the Tenth Avenue South curb and gutter district, L.I.D. No. 801, said work is hereby ac- cepted and the City Engineer instructed to- prepare an assessment roll for said district and'the City.Clerk authorized to give notice of hearing on said assessment roll for Mon- day, September 12, 1955, at_10 o'clock a.m.: carried, Burris, Huza and Huey voting aye on roll call. This -being the'time for receiving bids for the construction of a curb and gutter district on Richey Road, L.I.D._No. 816, the following were received:. DeBlasio Bros. Lone Pine Paving Company 8,o26.74 8,862.85- It was MOVED by Huza, seconded by Burns that the bid of DeBlasio Bros. be accepted as the lowest bidder, and the Mayor and City Clerk are hereby authorized to execute a con- tract on behalf of the City of Yakima for doing said.work, upon the filing of the proper bond as required by law: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Burns that the petition of Timber Line Property, Inc. for annexation to the City of Yakima of the southwest corner of 29th Avenue and Nob Hill Boulevard be accepted and the City Attorney was instructed to prepare the'necessary pro- ceedings for Monday, August 22, 1955, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Clerk be instructed to advertise for bids for the purchase of 12 carloads of 3/4 ground K.D. salt to be delivered in 50 pound papE' bags, F.O.B., City Street Yards; said bids to be received on Tuesday, September 6, 1955, at 10 o'clock a.m.:. carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that. the City Clerk be instructed to advertise for bids for the purchase of anti - freeze permanent type in one gallon size,"and also in bulk in approximately 220 gallon lots; said bids to be received on Tuesday, the 6th day of Sept" ember, 1955, at 10 o'clock a.m. :. carried, Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Burns that the City Clerk be instructed to advertise for bids for the purchase of 2 new cars for the Police Department, including trade -ins of two (2) 1953 four door sedans as specified in said notice to bidders; said bids to be received on Monday, ,August : .29., '; 1955, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Burns that the City Attorney is hereby instructed to prepare an ordinance rezoning Lots 1 to 10 and Lot 16, of the Rice- Dibbert Addition, from "All Residence zone to "B" Residence zone, the area and height to remain the same; said'ordi- nance to be presented Monday, August 22, 1955, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. The following bids were received for the - purchase of a Packer -type garbage body installe on truck for the Sanitation Department: Jack Sahlberg Equipment Co. $3;608.21 Rose Manufacturing Co. 3;306.67 Newell Truck Equipment Co. 32950.00 The City Commission took the bids under advisement. The following bids were received on the Pug Mill for the City Street Department: Feenaughty Machine Co. The Columbia Equipment Co. 1. New Littleford Model 700 -V Trail- O- Patcher,'FOB Yakima $4,310.00 2. New Model PM -215, etc., FOB Yakima -plus sales tax ea. 4,830.00 1. Demonstrated Barber -Green Model 804 Mixall -plus sales tax 4,275.00 2. New Barber -Green Model 804 Mixall - plus sales tax . 5,985.00 said bids were taken under advisement by the City Commissioners. Attorneys.representing DeBlasio Bros. appeared in protest to the rejection of the De- Blasio Bros.'s bid for construction of curb and gutter project on 21st Avenue South L.I.D. No. 815. After discussing the matter, it was MOVED by Huza, seconded by Burns that said matter be taken up at -a later date: carried, Burns, Huza and Huey voting aye on roll call. The City Commission met..pursuant to adjournment, Mayor Burns, and Commissioners Huza and Huey present on roll call. The,City Commission met to discuss the rejection of bids heretofore received on Monday, the 8th day of August at 10 o'clock a.m. at which time bids were opened for the.construe- tion of curbs and gutters on 21st Avenue South, L.I.D. -No, 815. Two bids were received as' follows: Lone Pine Paving Company.in the sum of $8,427.10:and DeBlasio Bros. in the sum of $7,977.55. Both bids were rejected by Commissioners Huey and Huza, Mayor Burns being.absent from said meeting (Aug. 8, 1955). DeBlasio Bros. objected to said rejection of bids and through their attorneys asked that a further consideration of their bid be given. It was,therefore, MOVED by Huza, seconded by'Burris that said bids be reconsidered and that the bid of DeBlasio Bros. in the sum of- $7,977.55 be accepted, and the Mayor and City Clerk authorized to execute a contract on behalf of the City of Yakima for doing said work upon the filing of the proper:.bond therefor: carried, Burns, Huza and Huey voting aye on roll call.
