The minutes of the regular meeting of July 25, 1955, recessed and adjourned meetings ther of were approved as read. This being the time for the hearing_on Resolution No. C -1262, providing for the constru tion of curbs and.gutters on..Richey Road, and there being no objections in writing, or otherwise, to said improvement .or_any.part thereof; it was MOVED by Huey - seconded by Hu that Ordinance No. B -1721, creating L.I.D. No. 816, be passed as read: carried, Burns, Huza and Huey voting aye on roll call.._ ORDINANCE NO. B -1721, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacin'g.and constructing concrete curbs and gutters, establishing a local improvement district, providing for the method of payment therefor, and creating a special fund. _ Moved by Huza, seconded by Huey that 0rdinarice No. B -1722, providing for the expenditure of funds not budgeted in the sum of $3,832.73, for the purchase of a Packer -type garbage body for the Sanitation Department, which was introduced and read in full by the City Clerk on Monday, July 25, 1955, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE N0. ,B -1722, AN ORDINANCE providing for the expenditure of funds not budgeted for the Sanitation Department, and declaring an emergency. This being the time for receiving bids on the 16th Avenue North curb and gutter district, the following were received: DeBlas io Bros. $2,477-00 Lone Pine Paving Company- 2,446.50 It was MOVED by Huey, seconded by Huza that the bid of Lone Pine Paving Company being the lowest and best bid, said contract be awarded to said Company, and the Mayor -and City Clerk authorized to enter into a contract on behalf of the City' for doing said work upon the filing of a proper bond as provided by law: carried, - Burns, Huza and Huey voting aye -on roll call. Moved by Huey, seconded by Huza that the -'City Engineer having reported the .completion of the Mead-Avenue curb and gutter district, L.I.D. No. 802, said work is hereby accepted, and the City Engineer instructed to prepare an assessment roll for.said district, and the City Clerk authorized to give notice of hearing'on said assessment roll, by publication as required by law, for Monday, August 22, 1955, at 10 o'clock a.m. -: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza,that'the.City Engineer having reported the completion of the 37th Avenue North curb and gutter district, L.I.D. No. 797, by the contractor, said work ishereby accepted, and the City'Engineer instructed to prepare an assessment roll for said district,' and the City.Clerk authorized to give notice of hearing,on said assess ment roll, by publication as' required by law, for Monday, the 22nd day of August, 1955, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that Resolution No. C -1270, being a resolution of inten- tion to improve the west side of 35th Avenue South from Tieton Drive to a point approxi- mately 32 feet north of Rose Park; the east side of 36th Avenue South from Tieton - Drive to Rose Park; and Webster Avenue from 35th Avenue South to 36th Avenue South-by grading, ballasting, surfacing and constructing concrete curbs and gutters, and fixing Monday, the 22nd day of August, 1955, at -10 o'clock a.m. for the hearing thereon, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1270, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That'it is its intention to improve the west side -of 35th Avenue South, from Tieton Drive to a point approximately 32 feet north of Rose Park; the east side of 36th Avenue South, from Tieton Drive to Rose Park- and Webster Avenue from 35th Avenue South to 36th Avenue South, by grading, ballasting, surfacing and constructing concrete curbs and gutters, together with the necessary drainage features. The district to'be served by and assessed for the above describe improvement is situate in Yakima County, Washington, and described as follows: Lots 1 to 33, inclusive of Westview Addition, according to the plat thereof recorded in the office of the Auditor of Yakima County,'Washington. All persons who may desire to object to said proposed improvemenl are hereby notified to appear and present such objections, if any,,at a meeting'of the City Commission to'be held at its office in the -City Hall in'the City of Yakima, Yakima County, Washington, at the hour of 10 o1clock a.m. -on Monday, the 22nd day of August, 1955; which time and place are hereby fixed for'the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of pay- ment for said improvement;-and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. All costs and_,expenses in connection with the construction of said improvement, including the engineering, inspection., advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the date and other informatior required by law to be by him submitted; all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer anc filed with the City Clerk. BURNS Mayor 627 I AUGUST 1,. 1955 Moved by Huza, seconded.by Huey that Resolution_.No. C- 1271,.authorizing the Mayor and City Clerk to enter into an agreement on behalf of the City of Yakima, with the Oregon - Washington and Navigation Company and Union Pacific Railway Company for the purpose of allowing the City of Yakima the right to construct, maintain and use sewer pipe lines and manholes beneath the tracks of said Company at Lower Ahtanum Road and Lot 2, Section 6, Township 12 North Range 19 EWM, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -12711 BE IT RESOLVED BY THE'CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON That the Mayor and,.City Clerk are hereby authorized to execute on behalf of said city that certain agreement dated. August 1, 1955, betweern Oregon -Wash- ington Railroad & Navigation Company,.,_a corporation of the State of Oregon, and its Lessee, Union Pacific Railroad Company, a corporation of the State'of Utah, and said City of Yakima under the terms of which said.City is given the right,.subject to the terms of said agreement, to construct.,.maintain and use sewer pipe lines and manholes as described and in the location indicated in said agreement beneath the tracks and on the right'of way of said'companie's at Lower Ahtanum Road and Lot 2, Section 6,'Township 12 North, Range 19 East, W. M. Yakima County, a copy of said agreement being attached here- to. Moved by Huey, seconded by Huza that the City Clerk is hereby instructed to advertise for bids for the purchase of a Pug Mill'for mixing plant adaptable to hot or cold _asphalt, for the City-Stre'et Department, said bids to be received on Monday, the 15th day of August, 1955, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the hearing on the rezoning of Lot' ?, Sinclair Plat be tabled pending further advise from the Planning Commission: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that a hearing be called for Monday, August 8, 1955, at 10 o'clock a.m. for the rezoning of Lots 1 to 16, inclusive, of Rice- Dibbert Addition be changed to "B" Residence, but that the area and height remain the same: carried, Burns, Huza and Huey voting aye on roll call.
