Due to a previous engagement of the City Commission the regular meeting of the City Commission was recessed until 2 otclock p.m. RECESSED MEETING, MONDAY, July 18, 1955, 2 otcl ock p.m. The minutes of the regular meeting of July 112 1955, were approved as read. This being the time for the hearing on Resolution No. C -1256, providing for the co nstruc. tion of curbs and gutters on Swan Avenue from 15th Avenue North to 16th Avenue North and there being insufficient protest against said improvement, or any part thereof; it was MOVED by Huey, seconded by Huza, that Ordinance No. B -1713, creating L.I.D. No. 814, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE 'N0. B- 1713,.= AN - ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters; establish• ing a local improvement district, providing for the method of payment therefor, and creating a special fund. Moved by Huey, seconded by Huza that Ordinance No. B- 1711~, specifying and adopting a system or plan of additions to, and betterments and extensions of, the sewerage system of the City, and providing that the existing sewerage plant which has heretofore been combined with and become a part of the waterworks utility of the City, together with the remainder of the existing system of sewerage, including all additions thereto and extensions and betterments thereof, shall be considered as a part of and belonging to the waterworks utility of the City; declaring the extimated cost of said or plan, as nearly as may be; providing for the issuance and sale of "Water and Sewer Revenue Bonds, 1955" in the principal sum of not to exceed $325,000.00, in one or more series, to pro- vide the funds required to pay the cost thereof; creating a special fund to provide for the payment of said bonds; and declaring an emergency, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B- 17142 AN ORDINANCE of the City of Yakima, Washington, specifying and adopting a system or plan of additions to, and betterments and extensions of, the sewer- age system of the City, and providing that the existing sewage disposal plant which has heretofore been combined with and become a part of the waterworks utility of the City, together with the remainder of the existing system of sewerage, including all additions thereto and extensions and betterments thereof, shall be considered as a part of and belonging to the waterworks utility of the City; declaring the estimated cost of said system or plan, as nearly as may be; providing for the issuance and sale of "Water and Sewer Revenue Bonds, 1955," in the principal sum of not to exceed $325,000.00, in one or more series, to provide the funds required to pay the cost thereof; creating a special fund to provide for the payment of said bonds; and declaring an emergency. Moved Huey, seconded by Huza that Ordinance No. B -1715, amending Section $$ of Ordinance No. B -1526, the same being the traffic code of the City of Yakima, relative to two hour parking in the parking meter zones as follows: both sides of South 2nd Street from Walnut to Spruce; both sides of East Walnut Street from Front Street to South 3rd Street; both sides of North 2nd Street from "B" Street to "C" Street; both sides of North 3rd Street from "A" to "B" Street; both sides East "B" Street from 1st Street to 3rd Street; Both sides East "B" Street from 3rd Street to 4th Street; the west side of North 4th Street from "All Street to "B" Street; both sides South 4th- Street from Chestnut Street tc Walnut Street; Both sides of Bast Chestnut Street from 4th Street to Naches Ave., and repealing paragraph (f) of Section 88, of Ordinance No. B -1526 be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1715, AN ORDINANCE amending Section $$ of Ordinance No. B -1526, entitles "AN ORDINANCE relating to and relatint to and regulating traffic, travel and transporta- tion and their incidents upon the streets and other ways open to the public; prescribing the powers.and duties of officers and others in relation thereto; defining offenses; providing penalties, and-repealing Orinance No. B -131 and all amendements thereof and all other ordinances in so far as they are in conflict therewith, and declaring an emergency ", and declaring an emergency. Moved by Huza, seconded by Burns that an ordinance providing for the expenditure of fund: not budgeted for Tahoma Cemetery in the sum of $2,000.00 for materials, be read in full by the City Clerk and laid on the table for one week as provided by law and the City Charter: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that Resolution No. C -1263 being a resolution of inten- tion to improve Lots 1 to 16, inclusive of Block 2 of the Shannon Homes Addition and fixing Monday, the 8th day of August 1955 as the time for hearing on said resolution be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -12631 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIAIA: That it is its intention to construct an irrigation system to serve the following described property, situate in the City of Yakima, Yakima County, Washington, to-wit- Lots 1 to 16 inclusive, Block 2, of the Shannon Homes Addition to the City of Yakima, according to the record plat thereof on file in the office of the Auditor of 'Yakima County, Washington, said improvement to consist of the construction of the necessary main, lateral, service connections, and other appurtenances to deliver water or irrigation purposes, to each lot within the proposed district; and to be constructed in full accordance with the pla and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improveme are hereby notified to appear and present such objection, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10:00 o'clock a.m. on Monday, the 8th day of August, 1 1 L �J 1 1 1 JULY 18, 1955 1955; which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of pay- ment for said improvement; and the city Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. RESOLUTION NO. C -1264, WHEREAS, the budget of the Tahoma Cemetery for 1955 as shown by Ordinance No. B =1606 contains these items: "Hose, Irrigation $400." and "Office Supplies $100.00 ";' and it appearing that subsequent to the adoption of said budget is has been ascertained that only the sum of $365.96 will be necessary for said hose and irrigation item, and that additional sums are needed for office supplies; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the sum of #3W4 is hereby transferred from the said $400.00 item to the said $100.00 item for office supplies for said Tahoma Cemetery; and the ex- penditure thereof for said purpose is hereby fully and in all respects authorized and approved; and the appropriate city officials are hereby authorized, empowered and direct- ed to do any and all things necessary or proper for carrying out this resolution. No. 798, said improvement is hereby accepted, and the City Engineer instructed to prepare an assessment roll for said district, and the City Clerk authorized to give notice of 'hearing on said assessment roll, for Monday, the 8th day of August 1955, at 10 o'clock a.m: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the �'ity Engineer, having reported the completion of the 9th Avenue North curb and gutter district, L.I.D. No. 785, said improvement is here- by accepted, and the City Engineer instructed to prepare an assessment roll for said improvement, and the City Clerk authorized to give notice of hearing on said assessment roll for Monday, August 8th 1955, at 10 o'clock a.m: carried, Burns, Huza and Huey voting aye on roll call... Moved by Huey, seconded by Huza that the City Engineer having reported the completion of the Douglas Drive Curb and Gutter District, said work is hereby accepted, and the City Engineer instructed to prepare an assessment roll for said district and the City Clerk authorized to give notice of hearing on said roll, for Monday, the 8th day of August, 1955, at 10 o'clock a.m: carried, Burns, Huza and Huey voting aye on rol•1 call. Moved by Huey seconded by Huza that the claim of Esther McBee, for damages in the sum of $5000.00, alleged to have been sustained by reason of tripping on an iron bar which pro- truded from the curbing at the northwest intersection of West Walnut Street and 5th 22 1 JULY 1$, 1955 Avenue South on the 4th day of April 1955, is hereby rejected: carried, Burns, Huza and Huey voting aye on roll call. Moved by Burns, seconded by Huza that we do now adjourn to meet Wednesday, July20, 1955, at 10 o'clock a.m: carried, Burns, Huza and Huey voting aye on roll call. ADJOURNED MEETING, WEDNESDAY, JULY 20, 1955, 10:00 A.M. The ''ity Commission 'me pursuant to adjournment, Mayor Burns,.and Commissioners Huza and Huey present on roll call. A delegation representing the local Retail Trade Bureau and others met with the City Commission to discuss the advisability of permitting advertising signs on the parking meters in the business district of the city. Leo Kendrick, attorney, represented the Retail Trade Bureau, who opposed said advertising methods, and the promotors of the advertising firm where represented by their attorney, Robert A. Roberts and Arthur Kirsbhenmann. After both factions had presented their arguments, the meeting was thrown upen for general discussion. The City Commissioners advised the delegation that the matter would be taken under advisement for a short period. Moved by Burns, seconded by Huza that we do now adjourn to meet Friday, July 22nd, 1955, at 10 o'clock a.m: carried, Burns, Huza and �uey voting aye on roll call. ADJOURNED MEETING, FRIDAY, July 22, 1955, 10:00A.M. Moved by Burns, and reluctantly seconded by Huey, that Resolution No. C =1266, granting the Hotel Chinook,.permission to construct and maintain a trellis with not less than 13 feet clearance across and above the alley at the read of said hotel, until such time as said permit is terminated by the City Commission; said Hotel Chinook, on behalf of its officers agreeing to hold the City of Yakima harmless from any liability, loss, cost or expense whatsoever which may arise from any claims for injuries or damages to persons or property by reason thereof, and said Hotel Chinook further agrees to remove said. trellis at its expense if so directed in the future by the City Commission of said City of Yakima, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1266, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the Yakima Community Hotel, Inc. is hereby granted permission to construct and maintain a trellis with not less than thirteen feet clear- ance across and above the alley at the rear of the Chinook Hotel, until and unless such permission is hereafter terminated by action of the Yakima City Commission, subject to the execution by such Yakima Counnunity Hotel, inc. of an indemnity agreement as pre- pared by the city attorney, copy of which is attached hereto. Miller, both employees of the City Fire Department and being dis- qualified to be members of the Firemen's Relief & Pension Fund, are hereby permitted to become members of the Statewide City Employees Retirement System by paying prior con- tributions, and doing all other things pertaining to said System, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -12679 WHEREAS, GERALD LATHAM, is employed by the City Fire Department as Secretary, and JOHN A. MILLER is employed by said Fire Department as Alarm Operator, and they are not qualified as members of the Firemen's Relief and Pension Fund and therE fore pursuant to statute are entitled to be included in the Statewide City Employees Retirement System, but through inadvertence the same has been overlooked and no contri- butions have been made by them or by the City for them, and they have agreed that they now desire to pay their contributions thereto retroactively in monthly installments; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That said Gerald Latham and. John A. Miller are hereby authorized and permitted to become members of the Statewide City Employees Retirement System, retroactively to a date six months after the initial employment of each of them respec- tively by the said Fire Department and entitled to all the rights and privileges which may lawfully accrue to them thereunder, and that they may pay, in addition to their current contributions thereto, their back contributions thereto which have heretofore accrued, the same to be paid up by them in such monthly installments as may be agreed to by the Chief of the Fire Department; and that the City shall match their monthly contri- butions thereto out of the surplus of the City in the-Statewide City Employees Retire- ment System Fund; and the appropriate officials of said city and of said retirement system are hereby authorized and directed to do any and all things necessary to carry out the foregoing resolution.
