The minutes of the, regular meeting of the City Commission of Tuesday, July 5,.1955, were approved as read. This being the time for the hearing on Resolution No. C -1250, providing for the vacation of Knobel Avenue from 39th Avenue to the Yakima Valley Canal Right of Way, and there being no objections in writing, or otherwise to said vacation proceedings, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No B -1709, vacating saic above described property, and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B- 1709,. AN ORDINANCE, providing for the vacation of Knobel Avenue from 38th Avenue North to the Yakima Valley Canal right of way adjacent to Lots 15, 16, 17 and 18 of Glenview Addition to the City of Yakima, Yakima County, Washington. This being the time for the hearing on Resolution No. C -1251, providing for the improve- ment of Lots 1 to 19, inclusive, of Glenview Addition, by the construction of a pipe sewer system, and domestic water system, and there being no objection in writing or otter wise to said improvement, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No. B -1710, creating a Local Improvement for said improvement, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1710, AN ORDINANCE, providing for the improvement of property in the Cit} of Yakima, by the construction of a pipe sewer with the necessary wye branches, manholes, flush tank and water connections therefor, and the construction of the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use; establishing a local improvement district, providing for the method of pay- ment therefor, and creating a special fund. This being the time for the hearing on Resolution No. C -1252, providing for the improve- ment of West Lenox Avenue from 3rd Avenue South to Ledwich Avenue by the construction of concrete curbs and gutters, and there being objections to certain portions of property being included in said project; it was MOVED by Huey, seconded by Huza that the property east of Landon Avenue be eliminated from said district, and Ordinance No. B -1711, creating a Local Improvement district be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1711, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing and constructing concrete curbs and gutters; establishing • local improvement district, providing for the method of payment therefor, and creating • special fund. Moved by Huey, seconded by Huza that Ordinance No. B -1712, amending the traffic code relative to speed limits, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1712, AN ORDINANCE relating to traffic speed limits and towing charges of impounded vehicles, and amending Sections 39 and 95 of the Traffic Code Ordinance No. B -1526, entitled "AN ORDINANCE relating to and regulating traffic, travel and transporta- tion and their incidents upon the streets and other ways open to the public; prescribing the powers and duties of officers and other in relation thereto; defining offenses; pro- viding penalties, and repealing Ordinance No. B -131 and all amendments thereof and all other ordinances in so far as they are in conflict therewith, and declaring an emergency ", as amended by Ordinance No. B- 151 +6, and declaring an'emergency. Moved by Huey, seconded by Huza that Resolution No. C -1260 authorizing and directing the Mayor and City Clerk to execute an agreement with Therm Ward, for certain damages to his property by reason of the construction of the South Interceptor sewer line and the further giving of an easement over said property, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1260, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the Mayor and Uity Clerk are hereby authorized and directed in consideration of an easement across the Therm Ward property, or a portion thereof, for the South Interceptor Sewer line, to execute and deliver to said Therm Ward an agreement to pay certain damages in the event of future contamination of the well on said Ward property by reason of said sewer line and an agreement authorizing said Therm Ward to make connection from his property to said sewer line; a copy of said agreement being attached hereto and incorporated by reference herein. BURNS Mayor Moved by Huey, seconded by Huza that Resolution No. C -1261, providing that the speed limit on Washington Avenue between 24th Avenue to the westerly line of the City limits, or 40th Avenue, shall be 35 miles per hour, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1261, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAK IMA: That pursuant to Ordinance No. B -1712, passed on July 11, 1955, the speed limit on Washington Avenue between 24th Avenue to the westerly city limits (40th Avenue) shall be 35 miles per hour; and the Commissioner of Public Works is hereby directed to post signs on said street in accordance herewith. BURNS, Mayor Moved by Huey, seconded by Huza that Resolution No. C -1262, being a resolution of inten- 1 1 1 1 1 1 1 JULY 11, 1955 to improve Richey Road from Crescent Hill Drive to 44th Avenue North and 42nd Avenue North from: Sunset Avenue to Douglas Drive by the construction of curbs and gutters, to- gether with the necessary drainage features, and fixing the date of hearing on resolution ! as of Monday, the 1st day of August 1955, at 10 o'clock a.m. be adopted as read: carried Burns, Huza and'Huey voting aye on roll call. RESOLUTION NO. C -1262, BE IT RESOLVED BY THE CITY COMMISSION OF THE_CITY OF YAKIMA: That it is its intention to improve Richey Road from Crescent Hil: Drive to 44th Avenue North, and 42nd Avenue North from Sunset Avenue to Douglas Drive, by grading, ballasting, surfacing and constructing concrete curbs and gutters, together with the necessary drainage features. The district to be served by and. assessed for the above described improvement is situate in Yakima County, Washington, and described as follows: Lots 5 to 12 inclusive, of Phipps' Addition; Lots 1 to 20 inclusive, and 24 to 30 inclusive, of Harland Addi- tion; also, the Northwest quarter of the Southeast quarter of the Northeast quarter of the Northwest quarter of Section 22, Townshi 13 North, Range 1$ E.W.M.,*and'the South half of the Northeast quarter of the Southeast quarter of the Northeast quarter of the Northwest quarter of Section 22, Township 13 North, Range 18 E.W-.M. All persons who may, desire to object to�said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of)10 o'clock a.m. on Monday, the 1st day of August, 19�; which time and, place are hereby fixed fo r the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hear= ing afid':of the intention to make the aforesaid improvement. All costs and expenses in connection with the construction of said improvement, including the engineering, inspection, advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all'of the data and other information required by law to be by him submitted;.all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. R. Carrell in the vicinity of 701 South 2nd Street: carried,,Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Clerk is hereby instructed to advertise fo bids for the following Local Improvement districts; The construction of curbs and gutters on West Prasch and ]Lenox Avenue in L.I.D. No. $11. The construction of a sewer system and domestic water system on Lots 1 to 19, inclusive in Glenview Addition, L. I. D. No. 812 The construction of curbs and gutters on Lenox Avenue from 3rd Avenue South to the east line of Landon Avenue in L.I. D. No. $13. bids on all of the above districts to be received on Monday, the 25th day of July, 1955, at 10 O'clock A.M: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Huey that the City Clerk is hereby instructed to advertise,.for bids for the purchase of four additional cars for the City Water department, and to be of the Ford, Chevrolet or Plymouth type, specifications of which are on file in the office of the Superintendent of the City mater Department; said bids to be received on Monday, July 25th, 1955, at 10 o'clock a.m: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Huza that all future hook -up or connections for water or sewer mains located outside of the city limits shall not be allowed without the approval of the City Commissioners having first been obtained in,advance by resolution instead of motion heretofore passed on March 14, 1955, recorded in Minute Book 15, page 582: carried, Burns, Huza and Huey voting aye on roll call.
