APRIL 18, 1955
The City Commission met in regular dession, Mayor Burns and Commissioners Huza and Huey
present on roll call.
The minutes of the regular meeting of Monday the llth.day of April, 1955 and adjourned
meetings were approved as read.
Moved by Huza, seconded by Burns that this..being.the.time for.the hearing on Resolution
No. C -1233, providing for the construct.i.o.n.,of. a. sewer.on;Blocks 1, 2, 31 8 and 9 i# the
"Uplands ", and there being insuffic .i.ent...objection._to...said improvement or any part thereof
it is ordered that Ordinance No.. B- 1681,..c.reat.ing L.I.D. No. 806, be passed as read:
carried,.Burns and Huza voting aye on.roll .call. Huey not voting.
ORDINANCE NO. B -16$1, AN. ORDINANCE providing .for..the...improvement of certain property by
constructing a pipe 'sewer with the necessary wye..branches, manholes and flush tank;
establishing a Local Improvement District, providing for the method of payment thereof,
and creating a special fund.
Moved by Burns, seconded by Huza that the..City.Clerk is hereby authorized to give notice
to contractors for the construction of a sewer.on...Blocks 1, 2, 3, 8 and `9, in the
ItUplands ", said bids to be received.on Monday, May..2, 1955, at 10 o'clock A.M: carried,
Burns, Huza and Huey voting aye on m.11 call.
This being the time for receiving bids for the widening of North Third Street and "B"
Street, the following were received:
De Blasio Bros..in the sum of 1,310.00
Peter Betteley in the sum.of 1,769.50
No decision was reached and the matter was taken under advisement.
Moved by Huey, seconded by Huza that the City Engineer having reported the completion of
the 37th Avenue North Irrigation District, L.I.D. No. 799, by the contractor, said work
is hereby accepted and the City Engineer authorized to prepare an assessment roll for said
district and the City Clerk instructed to give notice of hearing on said roll for Monday
May 9, 1955 at 10 o'clock: carried, Burns, Huza and Huey voting aye on roll call.
The Planning Commission Consultant having heretofore recommended that Ordinance No. B -293
be amended to redefine the words "building" and .'.'structure" in the building code; it was
MOVED by Huey, seconded by Huza that the City Attorney be instructed to prepare an
ordinance complying with said request: carried, Burns, Huza and Huey voting aye on roll
call.
Moved by Huey, seconded by Huza,that Resolution No. C -1237 authorizing the Mayor and City
Clerk to execute a lease on behalf of the City of Yakima Water Department, with Leo R.
Kuntz for 8 acres of ranch property belonging to said City Water department near Scenic
Drive on a basis of 31A% of the gross crop returns, be adopted as read: carried, Burns,
Huza and Huey voting aye on roll call.
RESOLUTION NO. C -1237, BE IT RESOLVED BY TIE CITY COMMISSION OF THE CITY OF YAKIMA:
That the Mayor and City ''lerk are hereby authorized to execute
on behalf of said City that certain lease dated April 18, 1955, between said City of
Yakima and Leo R. Kuntz to lease during the 1955 season approximately 8 acres of the
ranch recently purchased by the city near Scenic Drive for reservoir purposes on the ba
of 31A% of the gross crop returns as therein more fully provided, a copy of said lease
being attached hereto.

Moved by Huza, seconded by Burns that Resolution No. C -1238 authorizing the Mayor and City
Clerk to execute a lease on behalf of the City of Yakima with Wezt Coast Air Lines, Inc.,
for 1087 square feet of space on the main floor of the Administration Building at the
Yakima Municipal Airport for a period of five years commencing April 18th, 1955 and ex-
piring April 18th, 1960, be adopted as read: carried, Burns, Huza and Huey voting aye on
roll call.
RESOLUTION NO. C- 123,82 BE IT RESOLVED BY THE CITY COMMISSION OF'THE CITY OF YAKIMA:
That the Mayor and City Clerk are hereby authorized to execute on
behalf of said City that certain lease agreement dated April 18, 1955, between the said
City of Yakima and West Coast Air Lines, Inc., a corporation, for 1087 square feet of
space on the main floor of the Administration Building at the Yakima Municipal Airport,
together with the non - exclusive right to use the landing facilities at said Yakima
Municipal Airport, as therein more fully provided, for a period of five years commencing
on the date thereof, and expiring April 17, 1960, under the terms and conditions therein
more fully provided, a copy of said lease agreement being attached hereto..

It was MOVED by Huza, seconded by Huey that said bids be tabulated by Mr. Cornell, one
of the Consulting Engineers for the above named project, and reported on at a later date:

to fix a date of a public hearing on a petition heretofore.filed with the City_C,ommission
of property contiguous"to the:.City of Yakima.and Yakima Municipal Airport; which property
is more fully described ' =arid set forth in said. petition,_'and to post said notices as re-
quired by law, and setting'the date.of hearing.on.said..petition for Monday, May 9th 1955,
at 10 o'clock A.M:. carried, Burns, Huza..and.Huey voting aye on roll call.
Moved by Huey, seconded by Huza that Resolution No. C- 1239-,.relative to bids heretofore
received on Monday, April 18th 1955, for widening North Third Street and East ??Alt and
"B" streets, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call.
RESOLUTION NO. C -1239, WHEREAS, the City of Yakima has heretofore advertised for bids
for the project of widening and improving North Third Street in the vicinity of "All and
"Btt Streets and improving and widening East "Btt Street in the vicinity of North Third
Street; and only two'bids have been received for said project and the low bidder has sub-
sequently stated that he will not have time to properly and expeditiously perform said
work, and the other bid is deemed excessive in amount; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That the City Commission does hereby reject both of the said bids
heretofore submitted and does hereby declare that an emergency exists with reference
thereto; and-the �'ity Street Department is hereby directed to perform saidl'vbrrk and com-
plete the said street improvement project hereiriabove mentioned, and it shall not be
necessary to advertise further for bids nor to let any contract for the performance of
said street improvement project.

Moved by Burns, seconded by Huza that Ordinance No' B -1682, licensing the distribution of
stamps, coupons, tickets, cards or other devices which entitle holders thereof to cash,
money, goods, wares or merchandise free, etc., be passed as read: carried, Burns, Huza
and Huey voting aye on roll call.
ORDINANCE NO. B -1682, AN ORDINANCE licensing the distribution or sale of stamps, coupon
tickets, cards or other similar devices which entitle holders thereof to cash, money,
goods, wares, or merchandise free; fixing the amount of such license; defining offenses,
prescribing penalties', repealing Ordinance No. A -102 and declaring an emergency.
Moved by Huza, seconded by Burns that the award of bids received on Monday, April 18th,
1955, relative to the construction of the Englewood Heights Reservoir and Pump Station,
be delayed and the final decision continued to Friday, May 20, 1955, at 10 O'clock A.M:
carried, Burns and Huza voting aye on roll call. Huey not voting.
Moved by Huza, seconded by Huey that the City Clerk is hereby authorized to give notice
to bidders for the purchase of a two'ton truck chassis, for the Sanitation Department;
said bids to be received on Tuesday, May 10th, 1955, at 10 o'clock A.M. A trade -in of a
1939 E.G.Mack must be considered as a part of said bid: carried, Burns, Huza and Huey
voting aye on roll call.
