IThe minutes of the regular meeting of Monday, August 17th 1953, and adjourned meeting thereof be approved as read. Moved by Huey, seconded by Huza, that this being the time for the hearing on'Resolution No.. C -1075, providing for the construction of curbs and gutters on 44th Avenue North, from Summitview Avenue to Snowmountain Road and Snowmountain Road west from 44th Avenue North and certain of the property owners in said district desiring to withdraw their names from the petition of remonstrance; It is ordered that said hearing be continued to Monday, August 31st 1953, at 10 otcloc A.M., carried: Burns, Huza and Huey voting aye on roll cal Moved by Huey, seconded by Huza, that this being the time for the hearing on the assess- ment roll in L.I.D. No. 750, providing for the construction of the Conrad Sewer.District, and there being no objections in writing, or - otherwise to said improvement, or any part thereof; 'It is'ordered that Ordinance No.'B- 1485,'confirming said assessment roll and every part thereof, be.passed as read, carried: B:urns,.Huza and Huey voting aye on roll call. ORDINANCE NO. 3=14$51 AN ORDINANCE confirming the assessment roll covering Local Improve- ment District No. 750 as created and established by Ordinance No. B -1442 of the Ordinances of the City of Yakima. Moved by Huey, seconded by Huza, that Ordinance No. B =14$6, fixing the time of delinquency and prescribing the form of-bond in L.I.D. No. 748, be passed as read, carried: Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -14$6, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 748, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Huza, seconded by Burns, that Ordinance No. B -14$7, repealing Ordinance No. B- -1470, be passed as read,.carried: Burns., Huza and Huey voting aye on roll call. ORDINANCE NO. B -1487, AN ORDINANCE repealing Ordinance No..B -1470 approved on July 6, 1953: entitled "AN ORDINANCE providing for the expenditure of funds not yet provided for in the - 1953 budget, for the payment for the services of Homer M. Hadley, consulting engineer, with reference to the Lenox Overpass; and declaring an emergency" and confirming Resolution No. C -1073, approved on July 13, 1953. Moved by Huey, seconded by Huza, that Resolution No. C -1077, providing for the improvement of the alley from East Yakima Avenue to East Chestnut Street between South 6th and 7th Streets by grading and pvaing same, be adopted as read, and hearing on said resolution to be had on Monday, September 21, 1953, at 10 otclock A.M., carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION C -10772 BE IT RESOLVE -D BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the alley from East Yakima Avenue to East Chestnut Street, between South 6th Street and South 7th Street, by grading and paving with asphaltic concrete placed on a gravel base; all of said improvements to be constructer in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. The district to be served by and assessed for the above described improvements is described as follows, to -wit: All lots in Block 131, Yakima and Husonts Addition, according to the official plat thereof as recorded in records of Yakima County Auditor. All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objection, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 otclock a.m., on Monday, the 21st day of September, 1953; which time and place are hereby fixed for the hearing of all matters relating to said proposed improve- ment; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvment. The costs and expenses in connection with the construction of said improvement, including the engineering, inspection, advertising, publication of notices., and all other expenses incident thereto, shall be borne by and assessed against all of the property legally and properly assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. C -1073, WHEREAS, pursuant to Resolution No. C -1073, adopted by the City Commission on July 13, 1953, the City of Yakima is indebted to Homer M. Hadley for an unpaid balance in the sum of $4,500.00 for his services as a consulting engineer with reference to the Lenox Avenue Overpass for the preparation of plans and specification therefor, and other services in connection therewith; and (Continued on page 432) . ti: 432, AUGUST 24th, 1953 (Continued from page 431) WHEREAS, the City of Yakima has incurred and in the immediate future will incur miscellaneous other expnses in connection with the preparation and trial of the condemn- ation proceeding now pending in the Yakima County Superior Court, Cause No'. 3$$34,'brought by said City of Yakima against Washington Canners Cooperative,'a corporation; and WHEREAS, the employment of said consulting engineer and the incurring of said expense in connection.with said condemnation proceeding could not have been reasonably foreseen' at the time of the adoption of the 1953 budget; and an emergency for the payment of said indebtedness is hereby declared to exist for the reason that said indebtedness is now due and owing, but no funds have so far been set aside or received for the payment thereof; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That funds in the total sum of $10,000.00 be borrowed by the Lenox Overpass Construct ion Fund of said City, established by said Resolution No. C01073, from out of any invest- ment fund of said City, and that.City emergency warrants be issued therefor and the same be pruchased by any investment funds of said City, and that the said loan be repaid to said investment fund. or funds on or before six months after the date hereof, together with interest therecn at the rate of 4 per cent per annum from the date of payment until repaid. That the City Treasurer is hereby authorized, empowered, and directed to issue to said Home M. Hadley, an emergency warrant in the sum of $4,500.00 upon the presentation of a proper voucher for the payment thereof for said services, and to issue such other emergency warrants, not exceeding the total sum hereinabove stated, for costs and expenses incurred or to be incurred in connection with the preparation and trial of said Lenox Avenue Overpass condemnation Proceeding, upon the presentaion of proper vouchers for the payment thereof; and that the funds for the payment thereof be obtained in the manner hereinabove stated. No. 744, by the contractor,-said improvement is hereby accepted, and the City Engineer authorized to prepare an assess- ment-roll for said district, and the City'Clerk instructed to give notice of'hearing by publication as required by law; said hearing to be on Monday, the 21st day of September 1953 at 10 o'cloc A.M., carried Burn's, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that the.City Engineer having reported the completion of the Uplands Way Curb and Gutter District, L.I.D. No. 751, by the contractor, said improvement is hereby accepted, and the City Engineer authorized to prepare an assessment roll for said district, and the City Clerk instructed to give notice by publication as required by law for a hearing on said assessment roll; said date to be on Monday, Septemb- er 21st 1953, at 10 o'clock A.M., carried: Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that the City Engineer having reported the completion of the alley paving in Block 311 and 391 Capitol Addition and Block 413 Bedekers Addition, L.I.D. No. 754, said improvement is hereby accepted, and the City Engineer authorized to prepare an assessment roll for said district, the City Clerk'instructed to give notice of hearing on said assessment roll, by publication, as required by law, for Monday, September 21st 1953, at 10 o'clock A.M., carried: Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza, that the City Engineer having reported the completion of the Storm'Sewer on Summitview Avenue east of 44th Avenue North, L.I.D. No. 755, by the contractor, said improvement is hereby accepted, and the City Engineer authorized to prepare an assessment roll for said district, and the City Clerk instructed to give notice of hearing on said assessment roll by publication as required by law for Monday, September 21st 1953, at 10 o'clock A.M., carried: Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Burns, that the employment of E. L. Stamper as meter reader in the City Water Department, be extended to October 1st 1954, carried: Burns, Huza and Huey voting aye on roll call.
