The City Commission met in regular session, Mayor Burns and Commissioners Carpenter
and Huey. present on roll call.
The minutes. of the regular m,eting•of Monday, October 9, 1950, and adjourned meeting
thereof, were approved as read.
RESOLUTION -NO. C-938, BE IT RESOLVED BY THE CITY COMMI,$SION OF THE CITY OF YAKIMA,
WASHINGTON:
That it is its intention to improve Fifth`Avenue South from
Logan Avenue to Mead Avenue; Sixth Avenue South from Viola Avenue to Mead Avenue; :and
Logan Avenue from Fourth Avenue South to Sixth Avenue South, by grading, ballasting,
surfacing and constructing concrete curbs and gutters; all of said improvements to be
constructed in full accordance with 'the plans and specifications to be prepared by the
City Engineer and filed with the City Clerk.
The district to be served by and assessed for the above described
improvement is situate in Yakima County, Washington, and described as follows, to -wit:
Beginning at the intersection of Sixth Avenue South and
Viola Avenue; thence Easterly along Viola Avenue to a
point midway between Fifth Avenue South and Sixth Avenue
South; thence Southerly and parallel "wit h Sixth Avenue
South to a Point midway between Viola'A venue and Logan
Avenue; t�-lence Easterly and parallel with Viola Avenue
to Fourth Avenue South; thence Southerly along Fourth
.,Avenue South to a point midway between Logan Avenue and
'Mead Avenue; thence Westerly and - parallel with Mead Avenue
to a point midway between Fourth Avenue South and Fifth
Avenue South; thence Southerly and parallel with Fifth
Avenue South to Mead Avenue; thence Westerly along Mead
Avenue to a point midway between Sixth Avenue South and
Cornell Avenue; thence Northerly and parallel with Sixth
Avenue South to Viola Avenue; thence Easterly along Viola
Avenue to the point of beginning.
All persons who may desire to object to- -said proposed improve-
ment are hereby notified to appear and present such objections, if any, at a meeting
of the City Commission to be held at its- office in the City Hall in the-City of
Yakima, Yakima County, Washington, at the hour of 10 o'clock A.M,, -on Monday; the
6th day of '�November, 1950; ' which time and place are hereby fixed for-the hearing of
all matters relating to said proposed improvement or objections thereto,• and for de-
termining the method of payment for said improvement; and the City Clerk is hereby
directed to give -due notice of said hearing and of the intention to make the afore-
said improvement.
The cost and'expense of said improvement, including the cost of
acquiring right of way easements, engineering, surveying, advertising, publication of
notices, and all other expenses incident thereto, shall be borne by and assessed
against all of'the property legally and properly a.sses.sable therefore,as provided by
law and as'above described; and -t he Lity Engineer is hereby directed to submit to the
City Commission at or prior to the date fixed herein for said hearing, all of the data
and other information required by law to.be by him submitted.

RESOLUTION 'NO. -C -939, A RESOLUTION providing for the loan of a •sum of money from the
"Current Expense Fund" to a special fund to be designated "Bosko Contract Completion
Fund "; providing for the rate of interest for said loan and the re- payment thereof.
WHEREAS, -on January 30, 1950, a con�ract was entered into
between the City of- Yakima and Bosko Construction Co., Inc., for the construction of
an irrigation system and a sewer system under Local Improvement Districts #664 and
#680; and,
WHEREAS, the Bosko 'Construction Co., Inc., has failed, refused
and neglected to complete -said contract according to the terms thereof and it is for
the best interests of the City of Yakima to complete the work contracted for by,said
Bosko Construction Co., Inc.; and,
WHEREAS, the City of Yakima has no funds available for the com-
pletion of said work, and is holding 15% of the contract price of said work from the
Bosko Construction Co., Inc., until said work is .completed;.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA; That the "Current Expense Fund" of the City transfer and lend to a
special fund to be set up and known as "Bosko Contract Completion Fund ", the sum of
;4,000.00; said loan to draw interest at the rate of 4 per cent per annum, payable
from the retained percentage of the construction contract cost above referred to,
when said retained percentage has been released by Court order or otherwise.
BE IT RESOLVED that the :City Treasurer make the necessary
transfer from the "!Current Expense Fund" to the "Bosko Contract Completion Fund ", as
herein authorized and provided for.

October, 1950.

$4,000.00 from the Current Expense Fund to "Bosko Contract Completion Fund" •be adopted
as read: carried Burns, Carpenter and Huey voting aye on roll call.
ORDINANCE NO. B -1182, fixing the time of delinquency of'installments•of assessments
levied for the payment of the cost 'of the improvement in Local Improvement District
No. 683, and providing for the issuance of bonds with coupons attached for t}:e payment
of the- unpaid portion thereof.
Moved by Burns, seconded by Carpenter,, that Ordinance No. B -1182 fixing the time of
delinquency and prescribing the form:.of• bond in L.I.D. No. 683 be passed as read:
carried Burns, Carpenter and Huey ,voting aye on roll call.
Moved by Huey, seconded by Carpenter, that this being the time for the hearing on
Resolution No. C -934, providing for the construction of a sewer system to cover Lots 1
to 6 of Hunsinger's Addition, and there being no objection in writing or otherwise to
said improvement, or any part thereof: It is ordered that Ordinance No. B -1183
creating L.I.D. No. 709 be passed as read: carried Burns, Carpenter and Huey voting
aye on roll call.
ORDINANCE NO. B -1183, providing for the improvement of property in the City of Yakima,
Washington, by the construction of a sewer; establishing a Local Improvement District,
providing for the method of. payment therefor, and creating a special fund.
Moved by Huey, seconded by Carpenter, that- the City Clerk is hereby instructed to
advertise for bids as required by law for the construction of a sewer system for Lots 1
to 6, Hurisinger's Addition L.I.D. No. 709; said bids to be received on Monday,
October 30, 1950 at 10 o'clock, A.M: carried Burns, 'Carpenter and Huey voting aye on
roll call.
Moved by Huey, seconded by Carpenter, that this being the.time for the hearing on the
assessment roll in L:I.D. No. 6921 and there being no objections to said assessment
roll or any part thereof: It is ordered that Ordinance No. B -1184 confirming said
assessment 'roll or any part thereof be passed as read: carried Burns, Carpenter and
Huey voting aye on roll call.
ORDINANCE NO. B -11841 confirming the assessment roll covering Local Improvement.
District No. 692 as created and established by ,Ordinance No. B -1124 of the Ordinances
of the City-of Yakima.
Moved by Burns, seconded by Huey, that by virtue of the certificate of the County
Commissioners providing for the election heretofore had by property owners bounded
on the. east by South Hillcrest, on the south by 'T'ieton Drive, on the west by the west
line of South Glenn Drive Tracts and on the north by blest Walnut Street for annexation
to the City of Yakima, and said certificate s'r�ovL ng that said election carried by 36
votes; It is 'ordered that Ordinance No. B- 11351 annexing said territory to the C ity
of Yakima be passed as read: carried Burris, ','arpenter and Huey voting aye on roll call.
ORDINANCE NO. B -1185, .providing for the annexation by the City of Yakima, �Vash:ington,
of certain property contiguous to the present boundaries of said city.
ORDINANCE °N0. B -1186, amending Sections 71(a) and (d) and 71 -a and 71 -b of Ordinance
No. B -131, entitled: "AN ORDDINANCE relating to and regulating traffic, travel and
transportation and their incidents upon the streets and other ways open to the public;
prescribing the powers and duties of officers and others in relation thereto; defining
offenses, providing penalties and repealing certain ordinances concerned with or re-
lating to the subject matter of this ordinance, and declaring an emergency "; as amended
by Ordinances No. B -571, B -726, B -956, and B -1068, and declaring an emergency.
Moved by Huey, seconded by Burns, that Ordinance No. B -1186 relating to the regulation
of traffic in the City of Yakima be passed as read: carried Burns, Carpenter and Huey
voting aye on roll call.
Moved by Huey, seconded by Burns, that this being the time for the hearing on the
petition of W. Kenneth Weaver, Leslie C. Rogers and Joseph M. Thomas for annexation
to the City of Yakima of property more particularly described in said petition, and
there being no• objection thereto by any property owner to said annexation or any part
thereof; It is ordered that Ordinance No. B -1187 annexing said described territory
to the, City of Yakima be passed as read: carried Burns, Carpenter and Huey voting aye
on roll call.
ORDINANCE NO. B -1187, providing for the annexation by the City of Yakima, Washington,
of certain property contiguous to the present boundaries of said City.
