The minutes of the regular meeting; of Monday, August 21, 1950, and adjourned meeting thereof were approved as read. Moved by Huey, seconded by Burns that this being the time for receiving bids for curbs and gutters on Viola Avenue, L.I.D. No. 698, the following were received: Columbia Asphalt Paving Co. $11,361.08; Joe Brandt 'All, 479 .37; G. G. Teskey 11, 427.45, J. M. DeBlasio �p12, 832.11. The bid of Columbia Asphalt Paving Co. in the sum of $11,361.08 was accepted and the Mayor and City Clerk authorized to execute a contract on behalf of the City of Yakima for doing said work upon receipt of the proper bond as required by law: carried 3urns and Huey voting aye on roll call. Carpenter absent. Moved. by Huey, seconded by Burns that this being the time for receiving bids for Alley Paving L.I.D. 700, the bid of Columbia Asphalt Paving Co. in the sum of `p8,902.50 was the only one received; It is ordered that said contract be awarded to said company in the above and the Mayor and City Clerk are hereby authorized to execute a contract on behalf of the City of Yakima for doing said work upon filing of the proper bond as required by law: carried Burns and Huey voting aye on roll call. Carpenter absent. ORDINANCE PTO. B -1166, confirming the assessment roll covering Local Improvement District No. 683 as created and established by Ordinance No. B -1048 of the Ordinances of the City of Yakima. Moved by Huey, seconded by Burns that this being the time for the hearing on the assessment roll in L.I.D. No. 6831 and there being no objections in ,.writing or other- wise to said assessment or any part thereof; It is ordered that Ordinance No. B -1166 confirming said assessment roll and every part thereof be passed as read: carried Burns and Huey voting aye on roll call. Carpenter absent. - ORDINANCE NO. B -1167, fixing; the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 682, and providing for the issuance of bonds with coupons attached for the pay- ment of the unpaid portion thereof. Moved by .Burns, seconded by Huey that Ordinance No. B -1167, fixing the time of de- linquency and prescribing; bonds in L.I.D. No. 682 is hereby passed as read: carried Burns and Huey voting aye on roll call. Carpenter absent. O- HDINANCE NO. B- 1168, amending Ordinance No. B -648, entitled "AN ORDINANCE providing for the licensing and regulation of certain mechanical devices commonly known as "juke boxes ", providing penalties for the violation hereof, and fixing the effective date of this Ordinance "; as amended by Ordinances No. B -719, B -723, B -779, and B -1027; and declaring an emergency. Moved by Burns, seconded by Huey that Ordinance No. B -1168 relative to Juke Boxes be passed as read: carried Burns and Huey voting aye on _roll call. Carpenter absent. RESOLUTION NO. C -929, BE IT RESOLVED BY THE CITY 1COv1MISSION OF THE CITY OF YAKITYTA,INN• That it is its intention to improve Sixth Avenue South from Lenox Avenue to Viola Avenue and Fifteenth Avenue South from Lenox Avenue to Prasch Avenue, by grading, ballasting, surfacing and constructing concrete curbs and gutters; all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. The district to be served by and assessed for the above des- cribed improvement is situate in.Yakima County, Washington, and described as follows, to -wit: Beginning at the intersection of Sixth Avenue South and Lenox Avenue; thence easterly along Lenox Avenue to a point midway between Sixth Avenue South and Fifth Avenue South; thence southerly and parallel with Sixth. Avenue South to Viola Avenue; thence westerly along Viola Avenue to, a point midway between Sixth Avenue South and Cornell Avenue; thence northerly and parallel with Sixth Avenue South to Lenox Avenue; thence easterly along Lenox Avenue to the point of beginning; also: Beginning at the intersection of Fifteenth Avenue South with Lenox Avenue; thence easterly along Lenox Avenue to a point midway between Fifteenth Avenue South and Fourteenth Avenue South; thence southerly and parallel with Fifteenth Avenue South to Prasch Avenue; thence westerly along Prasch Avenue to a point midway between Fifteenth Avenue South and Sixteenth Avenue South; thence northerly and parallel with Fifteenth Avenue South to Lenox Avenue; thence easterly along Lenox Avenue to the point of beginning. All persons who may desire to object to said proposed improve- ment are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, AVashington, at the hour of 10 o' clock a.m., on Monday, the 25th day of September, 1950; which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for said. improvement; and the 'City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. . D 1 A ur -us t 28 . 1950 The cost and expense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, publication of notices, and all other expenses incident thereto, shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or, prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. C -930, WHEREAS, certain real property situate within the boundaries of Tahoma Cemetery, is owned by T! HOMA COMMUNITY It4AUSOLEUM ASSOCIATION, a non - profit corporation; and WHEREAS, a mausoleum is situate upon said property, which mausoleum contains crypts and niches belonging to private parties; and Ii IIEREAS, the Tahoma Community Mausoleum Association, a non- profit corporation, has agreed to convey by warranty deed the real property owned by it within the boundaries of said Tahoma Cemetery, to the City of Yakima, a municipal corporation, together with the sum of Four Thousand and no /100 Dollars (:4,000.00) in cash; in consideration of an agreement by the City of Yakima to perpetually maintain and care for the mausoleum building situate on said real property; and WHEREAS, it is for the best interests of the City of Yakima to accept said warranty deed and said sum of ;4,000.00 cash, and to enter into an agree- ment for the maintenance and care of said mausoleum building; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE 'CITY OF YAKIMA: That the Mayor and iCity,Clerk be and they are hereby authorized, empowered and directed to execute for and on behalf of the City of Yakima an agreement with the Tahoriia Community Mausoleum Association, a non- profit corporation, for the perpetual maintenance and care of said mausoleum building, in accordance with the terms and conditions of the agreement to which this resolution is attached. BE IT FURTHER RESOLVED that the City of Yakima accept a warranty deed from the Tahoma Community Mausoleum Association, a non- profit corporation, for the following blocks in Section "E" of Tahoma Cemetery, to -wit: Blocks 23, 247 251 26, 27, 28, 439 44, 53, 54, 69, 70, 75, 761 77, 781 79, 80; 45, 46, 47, 48, 49, 50, 51, 52, 71, 721 73, and 74; TOGETHER with all alleys and cross -walks pertaining thereto; all situate in the,Northwest Quarter of the Northeast Quarter of Section 35, Township 13 North, Range 18, E.W.M.; and BE IT FURTHER RESOLVED that the 'City of Yakima accept from the Tahoma Community Mausoleum Association, a non- profit corporation, the sum of $4,000.00 cash.
