The minutes of the regular meeting of Monday, April 17, 1950 .and adjourned meeting thereof be approved as read. Moved by Clark, seconded by Bishop that this being the time for the hearing on Resolu- tion No.. C-902 providing for the construction of curbs and gutters on South Eighth Avenue from Lenox Avenue to Mead and there being insufficient protest to said improve- ment or any part thereof; It is ordered that Ordinance No. B -1137 creating a Local Improvement District be passed as read: carried Buck, Bishop and Clark voting aye-on roll call. ORDINANCE NO. B -1137, providing for the improvement of certain property by grading, gallasting, surfacing.and constructing concrete curbs and gutters; establishing a Local Improvement District, providing for the method of payment therefor and creating a special fund. Moved by Buck, seconded'by Bishop that Ordinance.No. B -1138, repealing Section 20 (b) of Ordinance No. B -810 relating to and regulating the erection, etc of advertising signs, be passed as read: carried Buck, Bishop and Clark voting aye on roll call. ORDINANCE NO. B -1138, repealing Section 20 (b) of Ordinance No. B -810 entitled "AN ORDINANCE relating to and regulating the erection and maintenance of advertising signs, billboards and banners in the 'City of Yakima; regulating advertising on the streets of the City; requiring a license for bill posting, a.bond and license for sign erectors, a permit for the erection of signs and billboards and the inspection of such signs and billboards; providing for license permit and.inspection fees, fixing penalties for the violation thereof and repealing Ordinance No. A -138, passed and approved by the City Commission November 14, 1913, and any and all ordinances amendatory thereof." RESOLUTION NO. C -9051 WHEREAS, the City of Yakima is the owner of a small triangular shaped property lying within the intersection of West "A" Street and North 7th Avenue; and AUI]EREAS, A. J. Lenz desires to lease said property for business purposes for a period ending April 30, 1960; and WHEREAS, it is considered to be for the best interests of the City of Yakima to enter into a lease with the said A. J. Lenz of said property for such period; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION: That the Mayor and City Clerk be and they hereby are authorized, empowered and directed to enter into and execute for and on behalf of the City of Yakima a lease with the said A.J. Lenz covering the property herein mentioned for a period.ending April 30, 1960, upon a cash rental to be fixed in said lease and upon the further requirement that the said Lessee, his successors or assigns, shall keep and maintain said property in a clean, neat and attractive condition, and for such other and further provisions as are ordinarily included with -in such a lease, ATTEST: PEARL BENJAMIN City Clerk ADOPTED BY THE CITY COM?,1ISSION this 24th day of April, 1950. Bishop voting no. An ordinance providing for an expenditure of $1,000.00 for the Planning Board from the Current Expense fund relative to preliminary work in connection with an overpass crossing at or near Lenox Avenue, was introduced'and laid on the table for one week. Moved by Buck, seconded by Bishop that we do now adjourn to meet Friday, April, 28, 1950, at 10 o'clock a.m: carried Buck, Bishop and Glark voting aye on roll call. ADJOURNED MEETING, FRIDAY, APRIL 28, 1950 The City Commission met pursuant to adjournment'.,- Mayor Buck and Commissioners Bishop and Clark present on roll call. Moved by Buck, seconded by Bishop that the following Resolutions, No'sC-906, C -907, C -908, and C -909, be adopted as read: carried Buck, Bishop and !Clark voting aye on roll call. RESOLUTION NO. C -906, WHEREAS the work required by contract dated January 12, 1949, by John H. Sellen Construction-Co., contractor, and the City of Yakima, Washington, as the owner, has been substantially completed as specified in letter from John W. Maloney,.-Architect; dated April 24, 1950; AND WHEREAS due to certain delays which were unavoidable on the part of the contractor, an extension of time for the completion of the said contract is justifiable and appropriate; NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COMMISSION OF THE 'CITY OF YAKIMA, WASHINGTON: G April 24, 1950 1. That an extension of time under said contract is hereby recognized and granted to April 27, 1950. 2. That the work under said contract is hereby accepted as substantially completed as of April 27, 1950, subject to adjustments being made by the said contractor and the said architect, and the final payment under such contract shall be due and payable 30 days after April 27, 1950, in accordance with the said contract. Gilbert & Co., as contractor, and the City of Yakima, Washington, as the owner, has been substantially completed as specified in letter from John W. Maloney, Architect, dated April 24, 1950; AND WHEREAS due to certain delays which were unavoidable on the part of the contractor, an extension of time for the completion of the said contract is justifiable and appropriate; NOW ',THEREFORE., IT IS HEREBY RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: 1. That an extension of time under said contract is hereby recognized and granted to April 27, 1950. 2. That the work unders aid contract is hereby accepted as substantially completed as of April 27, 1950, subject to adjustments being made by the said contractor and the said architect, and the final payment under such contract shall be due and payable 30 days after April 27, 1950 in accordance with the said contract. Maloney, Architect, dated April 24, 1950; AND WHEREAS due to certain delays.which were unavoidable on-the part of the contractor, an extension of time for the completion of the said contract is justifiable and appropriate; NOW THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKITIIA, WASHINGTON: 1. That an extension of time under said contract is hereby recognized and granted to April 27, 1950. 2. That the work under said contract is hereby accepted as substantially completed as of April 27, 1950, subject to adjustments being made by the said contractor and the said architect, and the final payment under such contract shall be due and payable 30 days after April 27, 1950 in accordance with the said contract. That an extension of time under said contract is hereby recognized and granted to April 27, 1950. 2. That the work under said contract is hereby accepted as substantially completed as of April 27, 1950, subject to adjustments being made by the said contractor and the said architect, and the final payment under such contract shall be due and payable 30 days after April 27, 1950 in accordance with the said contract.
