The minutes of the regular meeting of Monday, February 27, 1950 and adjourned meetings thereof be approved as read. Moved by ,Clark, seconded by Bishop that this being the time for receiving bids for the construction of Irrigation systems in L.I.D. No. 658 and 666, the following were re- ceived: Bosko Construction Co. $31,356.25; Ralph W. Hedges $24,621.11; J. M. DeBlasio $23.,768.75; It is ordered that the bid of J.M. DeBlasio in the sum of $23,76B.75 be awarded-to him and the Mayor and City Clerk authorized to enter into a contract for doing said work as provided by law: carried Buck, Bishop and Clark voting aye on roll call. Moved by Bishop, seconded by Buck that this being the time for the hearing on Resolu- tion No. C -891 for the construction of an irrigation system on North Second Street and other property in said vicinity and a protest being filed by property owners in said district; It was ordered that said hearing be continued to Monday, March 13, 1950, at 10 o'clock a.m: carried Buck, Bishop and Clark voting aye on roll call. RESOLUTION NO.,(C -893, A RESOLUTION submitting Ordinance No. B -1112 of the City of Yakima to the electors of said City for their approval. at the municipal general elec- tion to be held on the 14th day of March, 1950, and specifying the form of ballot to be submitted to the voters at said election® WHEREAS the City .Commission of the City of Yakima has duly passed Ordinance No. B -1112 of the City of Yakima, entitled; "AN ORDINANCE granting a nonexclusive franchise to Pacific Power & Light Company to occupy and use the streets, alleys, and public places within a designated area of the City of Yakima with mains, pipes, and other facilities for supplying steam and steam heat service, subject to the capacity limita- tions of available steam production and transmission facilities; providing for the payment to the City of compensation for the exercise of said franchise; granting the City the right to acquire such mains, pipes, and facilities upon payment of compensation to be, determined as provided in the ordinance, but reserving to the City the power to acquire such property and,facilities by condemnation; providing for the surrender and cancellation of the franchise; and specifying other limita- tions, terms, and conditions governing the obligation to pro- vide service and the exercise of said franchise." AND WHEREAS Section 11 of said ordinance provides that it shall become effective upon its being approved by a majority of the electors of the !City of Yakima voting thereon at the municipal general election to be held on March 14, 1950; NOW, THEREFORE, BE IT RESOLVED, that said Ordinance No. B -1112 be submitted to the electors of the City of Yakima for their approval at the municipal general election to be held in said City on the 14th day of March, 1950, and that the ballot title or proposition to be submitted to the voters at such election shall be in the form of the following question; Shall Ordinance No. B -1112, granting a nonexclusive franchise to Pacific Power & Light Company for use of streets and alleys for a central steam heat system and providing for compensation for use of city streets, giving the City the right to acquire the heating system facilities by agreement or condemnation at the+City's option, and for the termination and cancellation of said franchise upon terms and conditions specified in the ordinance, be approved? and that the form of ballot to be used at such municipal general election shall be substantially in the following form; B A L L O T MUNICIPAL GENERAL ELECTION Held in the City of Yakima, Washington, on Tuesday, March 14, 1950, INSTRUCTIONS TO VOTERS Every voter desiring to vote in favor of the following propo- sition shall mark an X in the square between the word "Yes" and the words "for the ordinance"; and every voter desiring to vote against said proposition shall mark an X in the square between the word "No" and the words "against the ordinance ". PROPOSITION Shall Ordinance No. B -1112, granting a nonexclusive franchise to Pacific Power & Light Company for use of streets and alleys for a central steam heat system and providing for compensation for use of city streets, giving the City the right to acquire the heating system facilities by agreement or condemnation at the City's option, and for the termination and cancellation of said franchise upon terms and conditions specified in the ordinance, be approved? Yes No %-- — / for the ordinance against the ordinance 1 1 1 1 1 1 1 AND BE IT FURTHER RESOLVED that the City Clerk of Yakima be and she is hereby directed to publish a notice in one or more newspapers of general circu- lation within Yakima County, containing the title of each office under the proper, party designation, the names and addresses of all officers who have been nominated for such offices to be voted upon at such election, together with the ballot title hereinabove set,f orth, the hours during which the polls will be open, and that the election will be held in the regular polling places in each precinct, giving the address of each polling place, which notice shall be published not more than ten nor less than three days prior to March 14, 1950; Adopted by the City Commissioners of the (City of Yakima March 6th, 1950. Moved by Clark, seconded by Bishop that Ordinance No. B -1112 providing for the granting of a nonexclusive franchise. to the Pacific Power & Light Co.for the privilege of using the streets, etc. for steam pipes for central heat and that said proposition be placed on the ballot at the General election to be held on March 14, 1950, be passed as read: carried Buck, Bishop and Clark voting aye on.roll call. ORDINANCE NO. RESOLUTION NO. C -894, WHEREAS, the City 'Commission has heretofore by Ordinance No. B- 994, passed and approved March 28,. 1949, created a Local Improvement District within the (City of Yakima for the purpose of constructing an irrigation system to serve the lands described in said Ordinance, said District being known as Local Improvement District No. 658; and WHEREAS, it is necessary to sell the temporary warrants issued or to be issued by said District for cash for the purpose of paying for materials and labor used and to be used in the constructioh thereof, and the Liberty Savings & Loan Association, a corporation, has offered to purchase said warrants for their face value and desires to purchase all of the warrants issued by said District for materials and labor used in the construction of said improvement and desires to exchange the same for the Bonds issued by said District upon the completion of said improvement, and it being for the best interests of said Local Improvement District to approve the sale of warrants as mentioned herein; NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION that the temporary warrants issued and to be issued by and for Local Improvement District No. 658 to the Liberty _Savings & Loan Association of Yakima, Washington, be and the same hereby is authorized and directed, and the City Treasurer is hereby authorized to sell any and all subsequent warrants issued for and on behalf of said Local Improvement District to the said Liberty Savins & Loan Association, and said Company is hereby given the first option to exchange said warrants for the Bonds issued by said Local Improvement District when the same have been issued, for par value plus accrued interest if any. C -8951 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WN: That it is its intention to improve the lots and tracts of land included within the following described district by constructing pipe sewers with the necessary wye branches, drains, manholes, flush tanks and water connections there- for., all of said improvements to be constructed in full accordance with the.plans and specifications to be prepared by the City Engineer and filed with the City Clerk. The district to be served by and specially benefited by and assessed for the above described improvement is situate within the City of Yakima, Yakima County, Washington, and is bounded as follows: Beginning at the southwest corner of the intersection of Englewood Avenue and 27th Avenue North; thence southerly along the West line of 27th Avenue North to the South line of Wally Lane; thence easterly along said South line to a point which is 264.6 feet West of the centerline of 26th Avenue North; thence South 340131 West 41.6 feet; thence South 610451 East 54.feet; thence South 310381 West 132.4 feet to the North line of Powerhouse,Road; thence North- westerly along said North line to the. South line of Englewood Avenue; thence Easterly along said South line to the point of beginning. All persons who may desire to object to said proposed improve- ment are hereby notified to appear and present such objection, if any, at a meeting of AL 5 . P",_ 46 March 6, 1950 the City Commission to be held at its office in the .City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock a.m., on Monday, the 27th day of March, 1950, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, publication 'of notices, and all other expenses incident thereto, shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. Moved by Bishop, seconded by -Buck that an emergency ordinance providing for the expenditure of $100.00 for an explosimeter for the Fire Dept. was introduced and laid on the table for one week: carried Buck, Bishop and {Clark voting aye on roll call. ADJOURNED MEETING, TUESDAY9 MARCH 7, 1950 The ,.City Commission met pursuant to adjournment, Mayor Buck and 'Commissioners Clark and Bishop present on roll call. RESOLUTION NO. _C -897, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WN: Section 1. That the City of Yakima shall enter into a grant agreement for the purpose of obtaining Federal aid in the developement of the Yakima Municipal Airport and that such agreement shall be as set forth herein. Section 2. The Mayor. and City Clerk are hereby authorized, empowered and directed to execute said grant agreement in sextuplicate on behalf of the City of Yakima and the City Clerk is hereby authorized and directed to impress thereon the official seal of the City of Yakima and attest said execution. Section 3. The City of Yakima specifically ratifies and adopts all statements, representations, warranties, covenants and agreements contained in the project application and the sponsor's assurance agreement. Section 4. A copy of the grant agreement referred to herein is attached hereto and by reference mtcde a part hereof as fully as though the same 1 1 1 1 March 7. 1950 were set forth in detail in this resolution.
