The city commission met in regular session, Mayor Buck and Commissioners Bishop and
Clark present on roll call.
The minutes of the regular meeting of Monday, October 10, 1949, and adjourned meeting
thereof, were approved as read.
IVioved by Bishop, seconded by Clark that the claim of David King for damages in the sum
of $1295.00 alleged to have been sustained by reason of having water turned off by the
'City Water Dept., while_ steam cleaning a building at 6 No. 3rd St., was turned over to
the City Attorney for investigation carried Buck, Bishop and Clark voting aye on roll
call.
Moved by (Clark, seconded by Bishop that this being the time for the hearing on Resolu-
tion No. C -862, providing for the construction of cement sidewalks 6 feet in width on
the west side of North 8th St. from East "D" St. to East "E" St. and there being in-
sufficient protest against said improvement,-or any part thereof;. It is ordered that
Ordinance No. B -1060 creating a Local Improvement District be passed as read: carried
Buck, Bishop and -Clark voting aye on roll call.
ORDINANCE NO. B -1060, providing for the improvement of property in the City of Yakima,
Washington, by constructing a Portland - Cement concrete sidewalk six feet in width;
establishing a Local Improvement District, providing for the method of payment therefor
and creating a special fund.
Moved by Clark, seconded by Bishop that the City Clerk is hereby instructed to give
notice to contractors by publication for the construction of cement sidewalks on Adams
Avenue from South 8th St. to South 9th St., and on the west side of North 8th Street
from "D" Street to "E" Street; said bids to be received on Monday, October 31, 1949,
at 10 o1 clock A.M: carried Buck, Bishop and +Clar_�c voting aye on roll call.
Moved by Bishop, seconded by Buck that Ordinance No. 3-1061, providing for $2150.00
for additional labor at Tahoma Cemetery, which was not provided for in the 1949 budget,
be passed as read: carried Buck, Bishop and Clark voting aye on roll call.
ORDINANCE NO. B -1061, authorizing expenditure of funds not budgeted for additional
labor at Tahoma Cemetery, and declaring an emergency.
Moved by Bishop, seconded by Buck that Ordinance No. B -1062, providing for $40.00 for
rent for�Civil Service Secretar_yls office space. which was not provided for in the 1949
budget, be passed as read: carried Buck, Bishop and 'Clark voting aye on roll call.
ORDINANCE NO. B -1062, authorizing the expenditure of funds not included in the budget
for 1949, for the purpose of paying a portion of the rent for offices occupied by the
,Civil Service Commission, and declaring an emergency.
Moved by Clark, seconded by Bishop that Ordinance No. B -1063, providing for issuance
of bonds in L.I.D. No. 646, be passed -as read: carried Buck, Bishop and Clark voting
aye on roll call.
ORDINANCE NO.-B-1063, fixing the time of delinquency of installments of assessments
levied for the payment of the cost of the improvement in Local. Improvement District
No. 646, and providing for the issuance of bonds with coupons attached for the payment
of the unpaid portion thereof.

RESOLUTION NO. C -869
A RESOLUTION fixing the time for hearing on Petition for Vacation of Alley.
WHEREAS, a Petition has been filed with the City Commission of the City
of Yakima, a municipal corporation, praying for the vacation of alley described as
follows, to -wit:
The East -West Alley in Block 91 of the City
of Yakima.. Washington, from its intersection
with Fourth Street Easterly to the West line
of Lot 27, Block 91 as extended Northerly to
the South line of Lot 6 of said Block;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY {COMMISSION OF THE CITY OF YAKIMA:
That said Petition shall be brought on for hearing and determination on
Monday, the 14th day of November, 1949, at the hour of 10 :00 o1clock in the forenoon
on said day at the office of the City !Commission of the City of Yakima, at the 'City
Hall in Yakima, Yakima County, Washington, or as soon thereafter as the same may be
heard, and that notice of such hearing be given as provided by law.
ADOPTED BY THE CITY COMMISSION, signed and approved this 17th day of
October , 1949.

RESOLUTION NO. C -870, BE IT RESOLVED BY THE CITY COMMISSION OF THE 'CITY OF YAKIMA, WN:
That it is its intention to improve the following streets by
grading, ballasting, surfacing and constructing concrete curbs and gutters:
10th Avenue South from Lenox Avenue to Mead Avenue;
Pleasant Avenue from Viola Avenue to Mead Avenue;
Queen Avenue from Viola Avenue to Mead Avenue;
12th Avenue South from Lenox Avenue to Mead Avenue;
Hamm Avenue from Pleasant Avenue to 12th Avenue South;
Viola Avenue from 10th A venue South to 12th Avenue South;
all of said improvement to be constructed in full accordance with the plans and specifi-
cations to be prepared" by the .City Engineer and filed with the 'City 'Clerk.
The district-to be served by and assessed for the a -bove described
improvement is situate in Yakima County,. �`Vashington and described as follows, to -wit:
Beginning at a point on the south line of Lenox A venue
144 feet west of 12th Avenue South; thence easterly along the
south line of Lenox Avenue 309.4 feet; thence southerly and
parallel with 12th Avenue South 148 feet; thence easterly and
parallel with Lenox Avenue to the west line of Pleasant Avenue;
thence southerly along the west line of Pleasant Avenue to a
point 150 feet south of Hamm Avenue; thence westerly and parallel
with Hamm Avenue to a point 136 feet east of 12th Avenue South;
thence southerly and parallel with 12th Avenue South to the north
line of Hatfield'Addition; thence easterly and parallel with
Viola Avenue to a point 141.25 feet west.of 10th Avenue South;
thence northerly and parallel with 10th Avenue South to the South
line of Lenox Avenue; thence easterly along the south line of
Lenox Avenue 321.45 feet; thence southerly and parallel with.10th
Avenue South to the north line of Mead Avenue; thence westerly
along the north line of Mead Avenue 323.3 feet; thence northerly
and parallel with 10th Avenue South to a point 305.55 feet -south
of Viola Avenue; thence westerly and parallel with Viola Avenue
to a point.133.4 feet east of Pleasant Avenue; thence southerly
and parallel with Pleasant Avenue to the north line of Mead
Avenue; thence westerly along the north line of Mead Avenue to a
point midway between 12th Avenue South and 13th Avenue South;
thence northerly along a line midway between 12th Avenue South
and 13th Avenue South to the point of beginning.
All persons who may desire to object to said proposed improve-
ment are hereby notified to appear and present-such objections, if any, at a meeting of
the City Commission to be held at its .office in the City Hall in the City of Yakima,
Yakima County, Washington, at the hour of 10 :00 o.! clock A.M., on Monday, the 14th day
of November, 1949, which time and place are hereby fixed for the hearing of all matters
relating to said proposed improvement or objections thereto-and for determining the
method of payment -for said improvement; and the !City .rClerk.is hereby directed to give
due notice of said hearing and of the intention to make the aforesaid improvement.
The cost and expense of said improvement, including the.cost of
acquiring right of way easements, engineering, surveying, advertising, publication of
notices, and all other expenses incident thereto, shall be borne by and assessed again-
st all of the property legally and properly assessable therefor as provided by law and
as above described; and the City Engineer is hereby directed to submit to the City
Commission at or prior to the date fixed herein for said hearing, all of the data and
other information required by law to be by him submitted.
