Mayor Buck and Commissioner Clark absent on roll call. On account of the absence of Mayor Buck and Commissioner Clark, it was not possible to hold a meeting and Commissioner Bishop adjourned the meeting to Thursday, July 7, 1949, at 1Q. 61 clock A.M. ADJOURNED MEETING, THURSDAY, JULY 7, 1949 The City Commission met pursuant to adjournment, Mayor Buck and Commissioner Bishop present on roll call. Clark absent.. Moved by Bishop, seconded by Buck that this being the time for the hearing on Resolutio No. C -839, which had previously been postponed to this date, and upon recommendation of the City Engineer who reported that the estimated benefits in said district exceeded the assessed valuation; It was ordered that said improvement be definitely postponed: carried Buck and Bishop voting aye on roll call. Clark absent. The following bids were received for the construction of curbs and gutters in L.I.D. Nos 665, 667, 668 and 67Q: Lone Pine Paving Co. 38,254.08 and Columbia Asphalt Paving Co. $44,246.92. Moved by Buck, seconded by Bishop that the bid of the Lone Pine Paving Co. in the sum of $38,254.08 being the lowest and best bid, contract was awarded to them and the Mayor and City !Clerk authorized to execute a contract on behalf of the City for the doing of said work, upon the filing of the proper bond as required by law: carried Buck and Bishop voting aye on roll call. Clark absent. The City Engineer having reported the completion of the Fruitvale Sewer District, it was moved by Buck, seconded by Bishop that said work be accepted and the City Engineer authorized to prepare an assessment roll for said district and the City Clerk instruc- ted to give notice of hearing on said roll as required by law; said hearing to be had on Monday, August 1, 1949, at 10 o'clock A.M: carried Buck and Bishop voting aye on roll call. Clark absent. Moved by Bishop, seconded by Buck, that the City Clerk be instructed to give notice to bidders for 6,000 lineal feet of 3/4 inch, Type "K" copper service pipe for .the Water Dept. in 60 foot coils and 1, 000 lineal feet of one inch feet of said above described pipe; said bids to be received on Monday, July 25, 1949 at 10 o'clock A.M: carried Buck,:and Bishop voting -aye on roll call. Clark.aosent. Moved by Bishop, seconded by Buck that this being the time for the hearing on Resolutioi No. C -841 providing for the construction of curbs and gutters on 23rd Avenue South etc, and there being no objection in writing or otherwise to said improvement or any part thereof; It is ordered that Ordinance No. B -1024, creating a local improvement district be passed as read: carried Buck and Bishop voting aye on roll call. Clark absent. ORDINANCE NO. B -1024, providing for the improvement of certain property by the con- struction of concrete curbs and gutters and by grading, ballasting and surfacing the same; establishing a Local Improvement District, providing for the method of payment therefor and creating a special fund. RESOLUTION NO. C -848, BE IT RESOLVED BY THE CITY {COMMISSION OF THE CITY OF YAKIMA, WN: ..That it is its intention to improve West Spruce Street from Holton Avenue to 12th Avenue South and the alley east of 12th Avenue South extending from West Spruce Street to West Chestnut Street in the City of Yakima by constructing concrete curbs and gutters along same and by grading, ballasting and surfacing the same, all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the 'City Clerk. The district to be served by and assessed for the above des- cribed improvement is situate in Yakima County, Washington, and described as follows, to -wit: Beginning on the east line of 12th Avenue South 232.3 feet south of the south line of West.Spruce Street; thence north along said east line of 12th Avenue South to West Chestnut Street; thence easterly along West Chestnut Street to Eleventh Avenue South; thence southerly along Eleventh Avenue South to a point 20 feet south of y the north line of Lot 1, Block 413, Bedkers Addition; thence westerly -and parallel with the north line of Lot 1, to the east line of Lot ".C" Bedker's Addition; thence southerly along said east line and the east line of Lot "C" of Bedker's Second Addition to West Spruce Street; thence westerly along West Spruce Street to the alley east of 12th Avenue South; thence southerly along said alley to a point 232.3 feet south of the south line of West Spruce Street; thence westerly and parallel with West Spruce Street to the point of beginning. All persons who may desire to object to said proposed improve- ment are hereby notified to appear.and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington,, at the hour of 10 .bt clock a.m., on Monday, the 1st day of August, 1949, which time and place are hereby fixed for the hearing of all matters re- lating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement® The cost and expense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, publication of notices, and all other expenses incident thereto, shall be borne by and assessed again- st all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed therein for said hearing, all of the data and 1 1 L� i 1 July'.7, 1949 other information required by law to b:e by him submitted. BUCK Mayor that Resolution No. -C -848 be adopted as read: on roll call. Clark absent. RESOLUTION NO. C -849, BE IT RESOLVED BY THE CITY COMMISSION OF THE (CITY OF YAKIMA,' WN: Section 1. That the City of Yakima shall enter into a grant agreement for the purpose of obtaining Federal aid in the development of the Yakima Municipal Airport and that such agreement shall be as set forth herein. Section 2. The Mayor and City Clerk 'are hereby authorized, empowered and directed to execute said grant agreement in sextuplicate on behalf of the City of Yakima and the City Clerk is hereby authorized and directed to impress thereon the official seal of the City 6f Yakima and attest said execution.' Section 3. The (City of Yakima specifically ratifies and adopts all statements, representations, warranties, covenants and agreements contained in the project application and the sponsor's assurance agreement. Section 4: A copy of the grant agreement referred to herein is attached hereto and by reference made a part hereof as fully as though the same were set forth in detail in this resolution.
