The °City ,Commission met in regular session, Mayor Buck and Commissioners Bishop and
Clark present on roll call.
The minutes of the regular meeting of Monday, June 13, 1949, were approved as read.
Moved by Buck, seconded by Bishop that the hearing on Resolution No. C -833 be continued
to Monday, June 27, 1949, at 10 o'clock A.M: carried Buck, Bishop and Clark voting aye
on roll call.
Moved by�Buck, seconded by Bishop that upon the recommendation of the Planning - Board,
the petition�of the Nob Hill Evangelical United BretherniChurch for annexation to the
City be granted, and the City Attorney authorized to prepare the necessary papers..there-
for: carried Buck and Bishop voting aye on roll call. .Clark not voting.
Moved by Buck, seconded by Bishop, that upon recommendation of the Planning Commission
the following described property be changed from the "B" Residence District to Limited
Business District, and that the same area, with the exception of the north 20 feet of
same be changed from area District 2 to Area District 4: Beginning at the interse'etion..
of the center line of 14th Avenue South with the center line of West Lenox Avenue; thence
south 145.72 feet; thence,west parallel with Lenox Avenue to a point 154.35 feet west of
the center line of 15th Avenue; thence south parallel with the east line of 16th Avenue
South 188.52 feet; thence west to the center line of 16th Avenue South; thence north
along the center line of 16th Avenue South to a point 226.1 feet south of the center line
of West Lenox Avenue; thence west parallel with Lenox Avenue to the center line of 17th
Avenue South; thence north along said center line to the center line of-West Lenox
Avenue; thence east along the center line of West Lenox Avenue to point of beginnings
carried Buck and•Bishop voting aye on roll call. Clark not voting.
Moved by Clark, seconded by Buck that this being the time for the hearing on Resolution
No.. C -8$6; providing for the construction of curbs and gutters on 11th Avenue South
from Viola to Mead and there being no objections in writing or otherwise to said im-
provement, or any part thereof; It is. ordered that Ordinance No. B -1020 creating a
local improvement district be passed as read: carried Buck, Bishop and Clark voting aye
on roll call.
ORDINANCE NO. B -1020, providing for the improvement of certain property by the construc-
tion of concrete curbs and gutters; establishing a Local Improvement District, providing
for the method-of payment-- therefor and creating a special fund.
ORDINANfCE NO. B -1021, amending Ordinance No.-B-293 entitled "AN ORDINANCE regulating
and restricting the location of trades and industries; regulating and limiting the use
of buildings and premises; and the height and size of buildings; providing for yards,
courts and other open spaces; establishing districts for said purposes, and providing
for a board of adjustment, and repealing.Ordinances Nos. B -22, B -35, B -43, B -51, B -71,
B -126, B -147 and B- 172" .'

RESOLUTION NO. C =8439 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WN.:
Section 1. That pursuant to the provisions of the Act of Congress
entitled "Housing and Rent Act of 1947" and Acts'mandatory thereto, the same being pub-
lic laws 129., 422 and 464 of the 80th Congress, and public law 31 of the 81st 'Congress
of the United States, the {City Commission will hold a public hearing for the purpose
of determining whether a finding should be made that there no longer exists such a
shortage in rental housing accommodations in the City of Yakima as to require rent con-
trol in the City of Yakima. Such hearing shall be held in the Court Room of Department
No. 1 of the Superior Court of the State of Washington, for Yakima County, at the
County Court House, Yakima, Washington, beginning at the hour of 9 :30 o'clock a.m., on
Thursday, the.14th day of July, 1949.
'Section 2. Notice of such hearing shall be given by the City
Clerk by publication of such notice in two (2) successive issues of the official news-
paper of the City of Yakima, the first of such publications to be made not less than
ten (10) days prior to the date herein set for said hearing.

place for a hearing on the proposition of'rent control question in Yakima be adopted as
read: carried Buck and Clark voting aye on roll call'. Buck voting no.
RESOLUTION NO. C -8441 BE IT RESOLVED BY THE CITY 'COMMISSION OF THE CITY OF YAKIMA, WN:
That it-is its intention to improve the alley lying between Hol-
ton Avenue and Twelfth Avenue South and extending from West Spruce Street to Division
Street, by grading, placing crushed rock base and surfacing with asphaltic concrete.,
all of said improvements to be constructed in full accordance with the plans and speci-
fications to be prepared by the City Engineer and filed with the City Clerk.
The district to be served by and assessed for the above described
improvements is described as follows, to -wit:
Beginning at the intersection of the south line of
West Spruce Street with the westerly line of Holton
Avenue; thence southeasterly along said westerly
line to the north line of Division Street; thence
westerly along said north line to the east line of
12th Avenue South; thence northerly along said east line to
the -south line of West Spruce Street; thence easterly

along said south line to the point of beginning.
All persons who may desire to object to said proposed improve-
ment are hereby notified to appear and present such objection, if any, at a meeting of
the City Commission to be held at its office in the City Hall in the City of Yakima,
Yakima County, - -Washington, at the hour of 10 o'clock a.m., on Monday, the 11th day of
July, 1949, which time and place are hereby fixed for the hearing of all matters re-
lating to said proposed improvement or objections thereto, and for determining the
method of payment for said improvement; and the City Clerk is hereby directed to give
due notice of said hearing and of the intention to make the aforesaid improvement.
The costs and expenses of said improvement, including the cost
of acquiring right of way easements, engineering, surveying, advertising, publication
of notices, and all other expenses incident thereto, shall be borne by and assessed
against all-of the property legally and properly assessable therefor as provided by
law and as above described; and the City Engineer is hereby directed to submit to the
City Commission at or prior to the date fixed herein for said hearing, all of the data
and other information required by law to be-by him .submitted.

RESOLUTION NO. C -845, BE IT RESOLVED BY THE CITY ;COMMISSION OF THE •CITY OF YAKIMA, WN:
That it is its intention to construct a domestic water system
to serve all of the lots and tracts of land included within the following described
district situated in- Yakima County, Washington:
Beginning at a point on the east line of 31st
Avenue South 126 feet north of the north line of
Tieton Drive, said point being the southwest
corner of Lot 15, Neilan's Memorial Heights; thence
easterly a,distance of 140 feet to the southeast
corner of said Lot 15; thence northerly along the
east line of Lot 15 to 22, inclusive of said Addition
to the northeast corner of Lot 22; thence westerly
and parallel with Tieton Drive to a point midway
between 31st Avenue South and Grandview Avenue; thence
southerly and parallel with 31st Avenue South to a
point 126 feet north of Tieton Drive; thence easterly
and parallel with Tieton Drive to the point of
beginning, said described district to include Lots 15
to 22 inclusive of Neilants Memorial Heights and the
east half of Lots 3 to 10 of Block 1 of the unrecorded
plat of Seegert's Subdivision.
Said improvement to consist of the installation of the necessa
mains, fire hydrants, valves and other appurtenances for the purpose of supplying
water for domestic use, and to be constructed in full accordance with the plans and
specifications to be prepared by the City Engineer and filed with the City Clerk.
All persons who may desire to object to said proposed improve-
ment are hereby notified to appear and present such objection, if any; at a meeting of
the (City Commission, to be held at its office in the :City Hall in the City of Yakima,.
Yakima County, Washington, at the hour of 10 :00 o'clock a.m., on Monday, the 11th day
of July, 1949, which time and place are hereby fixed for the hearing on all matters
relating to the said proposed improvement, or objections thereto, and for determining
the method of payment therefor; and the City Clerk is hereby directed to give due
notice of said hearing and of the intention to make the aforesaid improvement.
The cost and expense of said improvement, including the cost

publication of notices and all other expenses incident thereto shall be borne by and
assessed against all of the property legally and properly assessable therefor, as

RESOLUTION NO. C-846, WHEREAS, the State of Washington and the Columbia Asphalt Paving
Company has offered to pay to the City of Yakima the sum of
$2113.77 in settlement of all claims for sales taxes paid in error on account of street
improvement contracts performed by the said Columbia Asphalt Paving Company under Local
Improvement Districts No. 627, 638, 647, 652 and 653, upon the execution of a release
of the said Columbia Asphalt Paving Company and the State of Washington for all claims
and demands in connection with the payment in error of sales tax on said contracts,
NOW, THEREFORE BE IT RESOLVED BY THE !CITY COMMISSION OF THE CITY
OF YAKIMA:
That the sum of $2113.77 shall be accepted in full settlement
of all claims and demands against the State of Washington and the Columbia Asphalt
Paving Company on account of sales tax paid in error on contracts performed under the
above named Local Improvement Districts and upon receipt of said sum the Mayor and
City Clerk are hereby authorized and directed-to execute in favor of the rColumbia As-
phalt Paving !Company and the State of Washington a full and complete release of said
claims and demands.

day of June, 1949.
