The .City Commission met in regular session, Mayor Buck, Commissioners Bishop and
Clark present on roll call.
The:minutes of the regular meeting of,- Monday, May 23, 1949 were approved as read:
carried Buck, Bishop and Clark voting aye_: on roll call.
Moved by (Clark, seconded by Buck that this being the time for. receiving bids for the
construction of a sidewalk on South 8th Street in L J.D 0 -� No. 655, and North 9th Street
in L.I.D. Noo-, 660, the following were received: Gallagher & Brandt $926.10 and James
Haller $1063.20. The bid of Gallagher and Brandt was accepted: Buck and Clark voting
aye on roll call. Bishop voting no.
ORDINANCE NO* B- 1013, amending Ordinance No. B -590 entitled "AN ORDINANCE relating to
the licensing and supervision of "Places of Refuge ", defining terms, prescribing,the
duties of officers in connection therewith, fixing.. fees; providing for appeal from
certain decisions, defining of- fenses and providing penalties; and declaring an emergen-
cy"; and declaring an emergency.
Moved by Clark, seconded by Buck that Ordinance No. B -1013 providing for "Places of
Refuge" be passed as read: carried Buck, Bishop and Clark voting aye on roll call.
Moved by Bishop, seconded by Buck that the report of the Investment Committee for-in-
vestments purchased during the month of May 1949, were approved as follows:

Moved by Buck, seconded by Bishop that Ordinance No.-B -1014 providing for adoption of
the Building Code be passed as read: carried Buck and Bishop voting aye on roll call.
Clark not voting.
ORDINANCE NO. B -1014, regulating erection, construction, enlargement, alteration,
repair, moving, removal, conversion, demolition, occupancy, equipment, use, height,
area and maintenance of buildings and /or structures in the City of Yakima; providing
for the issuance of permits and collection of fees therefor; declaring and establishing
fire districts; providing penalties for the violation thereof, and repealing all ordi-
nances and /or parts of ordinances in conflict therewith.
Moved by Clark, seconded by Bishop that this being the time for the continued hearing
on Resolution No.-(C-830 providing for the construction of the Arlington Street irriga-
tion system and there being insufficient protest to said improvement after certain
portions were eliminated; It is ordered that Ordinance No.-B-1015 creating a local
improvement district be passed as read: carried Buck, Bishop and Clark voting aye on
roll call.
ORDINANCE NO. B -1015, providing for the improvement of property in the City of Yakima,
Washington, by constructing an irrigation system to serve various lots and tracts of
land; establishing a local improvement district; providing for the method of payment
therefor, and creating a special fund.
Moved by Bishop, seconded by Buck that this being the time for the hearing on Resolu-
tion No.-C-832, for the construction of concrete curbs and gutters on 14th Avenue South
and other streets and there being insufficient protest to said improvement or any part
thereof; It is ordered that Ordinance No.-B-1016 creating a local improvement district
be passed as read: carried Buck, Bishop and Clark voting aye on roll call.
ORDINANCE NO. B -1016, providing for the improvement of property in the {City of Yakima,
Washington, by the construction of concrete curbs and gutters; establishing a Local
Improvement District, providing for the method of payment therefor and creating a

RESOLUTION NO.. C -836, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF-YAKIMA, WN:
That it is its intention to improve Eleventh Avenue South from
Viola Avenue to Mead Avenue in the City of Yakima by constructing concrete curbs and
gutters along said Avenue and by grading, ballasting and surfacing the same, all of
said improvement to be constructed in full accordance with the plans and specifications
to be prepared by the City Engineer and filed with the City Clerk.
The district to.be served by and assessed for the above describ
improvement is situate in Yakima County, Washington and described as follows, to -wit:
Lots 11 to 20 Block 1, Lots 11 to 20 Block 2,
Lots 1 to 10 Block 3, Lots 1 to 10 Block.4,_
all in Pleasant Avenue Addition to Yakima,
Washington.
. All persons who may desire to object -to said proposed improve-
ment are hereby notified to appear and present such objections# if any, at a meeting
of the City Commission to be held at its office in the City hall in the City of Yakima,
Yakima ,County, Washington, at the hour of 10 o'clock a.m., on Monday, the 20th day of
June, 1949, which time and place are hereby fixed for the hearing of all matters re-
lating to said-proposed improvement or objections thereto, and for determining the
method of payment for said improvement; and the City {Clerk is hereby directed to give
due notice of said hearing and of the intention to make the aforesaid improvement.
The cost and expense of said improvement, including the cost of
acquiring right of way easements, engineering, surveying, advertising, publication of
notices, and all other expenses incident thereto shall be borne by and assessed against
all of the property legally and properly assessable therefor as provided by law and as
above described; and the City Engineer is hereby directed to submit to the City Com-
mission at or prior- to the date fixed herein for said hearing, all of the data and
other information required by law to by by him submitted.

RESOLUTION NO. C- 8371. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WN:
That it is its intention to improve Second Avenue South from
West Pine Street to Division Street and Division Street from Broadway to the east line
of Second Avenue South by grading, ballasting and surfacing and also by constructing
a storm sewer on Second Avenue South in the City of Yakima, all of said improvement to
be constructed in full accordance with the plans and specifications to 'be prepared by
the City Engineer and filed with the City Clerk.
The district to be served by and assessed for the above describ
improvement is situate in Yakima (County, Washington and described as follows, to -wit:
Beginning at the intersection of the east line of
Second Avenue South with the south line of West
Pine Street; thence northeasterly along the south
line of Pine Street a distance of 100 feet; thence
southeasterly and southerly parallel with the
easterly line of Second Avenue South to the north
line of Division Street; thence westerly along said
north line to the east line of Broadway; thence
northerly along said east line a distance of 200
feet; thence easterly and parallel, with the north,
line of .Division Street to a point 100 feet west
of the west line of Second Avenue South; thence
northerly and parallel with the aesterly "line of
Second Avenue South to the south line of West Pine
Street.; thence northeasterly along said south line
to the point of beginning.
All persons who may desire to object to said proposed improve-
ment are hereby notified to appear and present such objections, if.any, at a meeting
of the City Commission to be held at its office in the City Hall in the City of Yakima,
Yakima County, Washington, at the hour of 10 o'clock a.m., on T.4onday, the 27th day of
June, 1y49, which time and place are hereby fixed for the rearing of all matters re-
lating to said proposed improvement or objections thereto, and for determining the
method of payment for said improvement; and the City Clerk is hereby directed to give
due notice of said hearing and of the intention to make the aforesaid improvement.
The cost and expense of .said improvement, including the cost of

The ':City Commission met pursuant to adjournment, Mayor Buck andCommissioners Bishop
and Clark present on roll call.
Moved by Bishop, seconded by Buck that the payrolls for the month of May, 1949, be
allowed and t.he.City Clerk authorized to issue warrants on the following departments:
Various Depts. $7064.32; Engineers $2875.00; Police $14,759.92; Fire $15,907.00;
Library $2419.10; Cemetery $480.00; Irrigation 1190.00;.Street $715.00; F.R. & P.
$2247.30; P.R. & P. $310.00; Retirement System 82651.93 and Water $16,487.58: carried
Buck, Bishop and Clark voting aye on roll call.
RESOLUTION NO.-C-838., WHEREAS, the Washington State'Legislature has enacted a certain
Act known As Chapter 227 of the Laws of 1949, which Act among other things empowers
.two or more public utility districts to acquire entire electric operating systems and
creates a State Power Commission, and appropriates $150,000.00 therefor; and
WHEREAS; said Chapter 227 of the Laws of 1949 appears to be un-
constitutional for the reason that it purports to contain more than-one'subject in
contravention of Section 19 of Article -2-of the Constitution of the State of Washington,
and it is believed in the best interests of the people of the City of Yakima, State of
Washington to determine the constitutionality of said Act prior to the time any of the
150,000.00 appropriated under and by virtue thereof is.expended;
NOW THEREFORE BE IT RESOLVED BY THE 'CITY 'COMMISSION OF THE
CITY.OF YAKIMA, that the Attorney General of the State of Washington be and he hereby
is-requested to institute Court proceedings to determine the constitutionality of said
Chapter 227 of the. Laws of 1949 of the State of Washington, and a certified copy of
this Resolution shall by.the City 'Clerk be forthwith transmitted to the said Attorney
General.
