The minutes of the regular meeting of Monday, April 11, 1949, were approved as read. Moved by Buck, seconded by (Clark that the Mayor and City Clerk are hereby authorized to execute an easement on behalf of the City of Yakima, to Yakima County.on the following described tract of land -- That part of the SW-1 of the NE4 of Sec. 20 -13 -19 E.W.M, lying east of a line parallel to and 50 ft. Westerly of the following described levee center- line: Beginning at levee centerline station L331 13.3 P.C. which is -in the north line of said SWI of NE' approximately 570 feet east of NW corner said SW4 of NE4; thence along a six degree curve to the left from a tangent which bears south 290 10► East through a central angle of 90 001 east for a distance of 150 feet; thence south 380 10t east, 174.8 feet; thence along a..six degree curve to the right through a central angle of 190 151 for a distance of 320.8 feet; thence south 120 331 30" east 80 feet, more or Tess, to the south line of said Swam of the NE4; said parallel line being lengthened or shortened to meet the boundaries of said subdivision: carried Buck, Bishop and Clark voting aye on roll call. Moved by- Bishop, seconded by Clark that this being the time for receiving bids for two cars for the Police Dept., the following were received: Cormier Chevrolet Co., $3433.66 less trade in of 2 cars Q, $1748.00 or a total of $1685.66; Hassett Motor Co., $1983.00 less trade in of 985.00.or a total of $998.00 for one car; Burrows Motor Co. $3340.00 less trade in of 81575.00 or a total of $1765.00; Hahn MotorCo. $1847.82 less trade in of $675.00 or a total of $1172.82. The bid of Cormier Chevrolet Co. was accepted as the lowest and best bid: carried Buck, Bishop andClark voting aye on roll call. ORDINANCE NO. B -1000, granting to the Northern Pacific Railway Company, a corporation of the State of Wisconsin, and to its successors and assigns, the right, privilege and authority to construct, maintain and operate a certain railroad track.in the City of Yakima, Yakima County, Washington. Moved by Clark, seconded by Bishop that Ordinance No. B -1000, granting to the N.P. Railway Co. a franchise to construct a spur track crossing Beech, Maple and Pine Streets, be passed as read: carried Buck, Bishop and,'Clark voting aye'on roll call. ORDINANCE NO. B- 1001,- fixing the time -of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 654, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Clark, seconded by Buck that Ordinance No. B -1001 be passed as read: carried Buck, Bishop and Clark voting aye on roll call. ORDINANCE NO. B -10021 fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 645, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Clark, seconded by .Bishop that Ordinance No. B -1002 be passed as read: carried Buck, Bishop and Clark voting aye on roll call. ORDINANCE NO. B -1003, relating to public health, prescribing regulations for installa- tion of toilet facilities in residential districts, fixing penalties for violation and declaring an- .emergency. Moved by Clark, seconded by Bishop that Ordinance No. B -1003 be passed as read: carried Buck, Bishop and Clark voting aye on roll call. The mayor moved that the City Attorney be instructed to prepare an ordinance abolishing the use of pinball machines in Yakima. The motion failed to carry for want of a second. ORDINANCE NO. B -1004, amending.Ordinance No. B -989 entitled "AN ORDINANCE providing for classifying and licensing, for regulation and revenue, the location, operation and control of amusement devices commonly known as "Pinball machines" and other devices and games for use by the public; providing penalties for the violation thereof; re- pealing ordinance No. B -642 and all other ordinances in conflict herewith, and fixing " the effective date of this ordinance", fixing the effective date of this amendment and declaring an emergency. Moved by Buck, seconded by Bishop that Ordinance No. B -1004 be passed as read: carried Buck, Bishop and Clark voting aye on roll call. RESOLUTION NO. tC -828, BE IT RESOLVED BY THE 'CITY OF YAKIMA., WASHINGTON: That it is its intention to construct a domestic water system to serve all of the lots and tracts of land.included within the following described districl situated in Yakima County,Washington: Beginning at the intersection of Tieton Drive and 26th Avenue South; thence easterly along Tieton Drive to a point midway between 25th Avenue South and 26th Avenue South; thence southerly and parallel with 26th Avenue South to the northerly right of way line of the Naches and Cowiche .Canal; thence westerly along said right of way line to a point midway between 26th Avenue South and 27th-Avenue South; thence northerly and parallel with 27th Avenue South to a point 140 feet south of the south line of Tieton Drive; thence east and parallel with Tieton Drive to 26th Avenue South; thence north along 26th Avenue South to point of beginning. Said improvement to consist of the installation of the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying J— water for domestic use, and to be constructed in full accordance with the plans and I_ 66 April 18, 1949 specifications to be prepared by the ,City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improve- ment are hereby notified to appear and present such objection, if any, at.a meeting of the !City Commission, to be held at its office in the City Hall in the City of Yakima, Yakima (County, Washington, at the hour of 10 :00 o'clock A.M., on Monday, the 9th day of May., 1949, which time and place .are hereby fixed for the hearing on all matters relating.to the said proposed improvement, or objections thereto, and for determining the method of payment therefor; and the City Clerk.is hereby directed to give due notice of said hearing and of.the intention to make the aforesaid improvement. The cost and expense of said improvement, including the cost of acquiring right of way easements, engineering, surveying, advertising, inspection, publication of notices and all other expenses incident thereto shall be.borne by and assessed against all of the property legally and properly assessable therefor,- as pro- vided by law and as above described; and'the City Engineer is hereby directed to.sub- mit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted.
