The minutes of the regular meeting of Monday, March 7, 1949 were approved as read. Moved by Clark, seconded by Buck that this being the time for the hearing on .Resolution No's C -815 and -C -816, providing for the vacation of a portion of E. Spruce Street for loading purposes for the Yakima Hardware Co. and after considerable discussion on the part of said owners on behalf of said proceedings, it was ordered that said meeting be adjourned to Wednesday, March 16, 1949 at 9 :30 A.M: carried Buck, Bishop and Clark voting aye on roll call. ORDINANCE NO. B -990, rezoning the following property in the City of Yakima The South 115 feet of Lots 6, 7, 8, 9 and 10 of Fruitvale Addition No 2, .the South 100 feet of Lot 1 of the-Subdivision of the East half of Lot 25 of J. H. Hathaway's Five Acre. Tracts, and the South 100 feet of the North 130 feet of the West one half of Lot 25, J. H. Hath- away's Five Acre Tracts. Moved by Buck, seconded by Bishop that Ordinance No. B -990 rezoning property in J. H. Hathaway's Five Acre Tracts etc., be passed as read: carried Buck, Bishop and Clark voting aye on roll call. ORDINANCE NO. B -991, providing for the improvement of property in the City of Yakima, Washington by the construction of a domestic water system; establishing a Local Improve- ment District; providing for the method of payment therefor and creating a special fund. Moved by Clark, seconded by Bishop that Ordinance No. B -991 providing for the creation of L.I.D. No. 657, be passed as read: carried Buck, Bishop and Clark voting aye; on roll call. RESOLUTION NO. C -8219 WHEREAS, an option was heretofore granted by W.M. COLEMAN and MARIE T. COLEMAN, his wife, for the purchase of certain real estate which is a part of the -real estate hereinafter described, AND WHEREAS, the City of Yakima has found it necessary to secure land in addition to that above mentioned for the purpose of installation of a well for an auxiliary source of domestic water, AND WHEREAS, the sum of One Hundred Dollars was heretofore paid to the said 'Coleman and wife under the option first above mentioned, and they have offered to sell to the City of Yakima that certain real estate described as follows, to -wit The North 264 feet of the West 200 feet of the Southwest quarter of the Southwest quarter of Section 12, Township 13 North, Range 18, E.W.M. AND WHEREAS, it is agreed that the purchase price for the above described land shall be SEVEN HUNDRED AND.NO/100 DOLLARS ($700.00) and that the amount heretofore paid upon said option shall be deducted from said purchase price, NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA.: That it is for the best interests of the City of Yakima to pur- chase from the said Coleman and wife the real estate above described for the price of SEVEN HUNDRED AND 110 /100 DOLLARS (700.00) less the amount heretofore paid, leaving a balance to be paid hereunder of Six Hundred Dollars: That the primary purpose for the purchase herein authorized is for the construction and operation thereon of a well and the necessary appurtenances thereto for an auxiliary source of domestic water for the City of Yakima; and the City Treasurer is hereby authorized, empowered and directed to issue a warrant upon the proper fund of the City of Yakima in payment of the purchase price of said property as herein specified upon the delivery to the City of a good and sufficient warranty deed to said described premises, together with a policy of title insurance; that said title insurance shall show marketable title to all the above described property except the West 16.5 feet of the South 194.2 feet of the West 448.7 feet of the above mentioned tract of land, it being understood that the City will waive its requirement as to marketable title as to the property last described herein and as to the.interest of one Belle Rogers in said property. C -822, WHEREAS, in constructing a portion of the main distribution line of the City Water System it is necessary to cross the ditch of the Yakima Valley Canal Company with a sixteen inch cast iron main at two places; and WHEREAS, said Yakima Valley Canal Company has proposed a contract granting easement rights for the purpose of such crossing and the description of the premises and the rights and crossings are contained in said contract and it is for the best interests of the City of Yakima to enter into said contract, NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA : That the Mayor and City Clerk be and they hereby are authorized to execute that certain contract proposed by the Yakima Valley Canal Company giving and granting unto the City a right of way and easement for the purpose of crossing the Canal of said Yakima Valley Canal Company with a sixteen inch main, the same being part r� II 1 1 e w • PJI a y o r March 14, 1949 of the 'Cityts water distribution system, at the places described in detail in said con - tract.
