Barber and Robinson absent part of this meeting. City Manager Allison absent and attending a meeting the North- west Managers at Salem Oregon in accordance with action taken by the Council on January 20, 1960. The invocation was given by George Oliver. Minutes of the - regular meeting of February 17, 1960 were approved as read. This being the time fixed for the hearing on the assessment roll for L.I.D. No. 879, being the Kern Addition Curb, Gutter and.Pavirg District, and there being no protests in writing or otherwise, it.was MOVED by Burns, seconded by Larson that Ordinance No. 90 confirming said assessment roll and every part thereof, be passed as read: carried, Bostic, Burns, Coombs, Larson and Oliver voting aye on roll call. Barber and Robinson ab: ORDINATCE NO. 90, AN ORDINANCE confirming the assessment roll -covering Local :Improvement District No. 879 as created and established by Ordinance No. 27 of the Ordinances of the City of Yakima. A petition,being petition No. 31, having been duly filed by Lester 0. Beaver and others praying for the annexation of certain property located south of Englewood'Avehue and west of Minnesota Avenue,-it was MOVED by Coombs,.secorded by Larson that said petition be referred to the Planning- Commission for recommendation: carried, Bostic, Burns, Coombs, Larson and Oliver voting aye by voice vote. Barber and Robinson absent.1 . An ordinance appropriating the sum of $16,171.21, being an emergency ordinance appropriating saic.,.sum._.:: for payment to the County of Yakima for a drainage improvement assessment in Drainage Improvement District No. 48, located in the Uplands, having been read by the Clerk of the Council, was ordered laid on the table for one week, -to be considered at the next regular meeting of the City Council. Moved by Oliver, seconded by Coombs that Ordinance No. 91 fixing the time of delinquency and prescribing the form of bonds for L.I.D. No. 870,.be-ing the Kenny.Drive and Various Streets Paving District, be passed as read: carried, Bostic, Burns, Coombs, Larson and Oliver voting aye on roll call. Barber and Robinson absent. AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 8'70, and providing for the issuance of bonds with coupons attached for the payment of the un- paid portion thereof. In accordance with action taken by the City Council on January 13, 19602 it was MOVED by Larson, seconded by Oliver that Resolution No. D -102 authorizing the purchase of a water pipe line on Franklin Avenue between the River Road and Fruitvale Boulevard from the First National Theaters Inc., for the sum of $5,110.00, be passed as read: carried, Bostic, Burns, Coombs, Larson and.Oliver,voting aye on roll call. Barber and Robinson absent . RESOLUTION NO. D -102, A RESOLUTION authorizing the City Manager and City Clerk to purchase a water pipe line on.Franklin Avenue between River Road and Fruitvale Blvd. from First Nati:�nal Theaters, Inc. for the sum of $5,110.00. WHEREAS, the .City has for a number of years been operating and maintaining a 6" wood stave water pipe line on Franklin Avenue between Raver Road and Fruitvale Blvd, and WHEREAS, said 611 wood stave pipe line is in bad condition and would'-require replacement in the very near future, and WHEREAS, in April,1953, First rational Theaters, Inc. constructed a new 6" M.J.water pipe line on said Franklin Avenue between. River.Road and Fruitvale Blvd. ark WHEREAS, said 6" M.J. pipe line has never been used and is in new condition and has'been offered to the City by said First National Theaters, Inc. for the sum of $5,110.00, which represents the cost of new construction of said line less a reasonable depreciation, and WHEREAS, it is deemed in the best interests of the people of the City of Yakima to purchase said water pipe line as a replacement for said old 6" wood stave water pipe lire, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and City Clerk of the City of Yakima are hereby authorized and directed to enter into an agreement with First National Theaters, Inc. for the purchase of that certain 6" M:J. water pipe line on Franklin Avenue be- tween River Road and Fruitvale Blvd. from said First National Theaters, Inc. for the sum of $5,110.00, a copy of which agreement. is hereto attached and by this. reference _made a part hereof. D -1031 A RESOLUTION transferring the sum of $5,110.00 from the Water Main Materials-Account, to the Water Distribution System Account, all within the Capital nt. 1 1 1 1 1 1 1 FEBRUARY 24,11960 or Betterment Accounts classification of the 1960 appropriation for 52 - Water Depart- ment. WHEREAS, the City Council has heretofore adopted a resolution authorizing the City Manager and City Clerk to purchase a''6" M.J. water pipe line on Franklin Avenue paralleling the existing wooden main from First National Theaters for the sum of $5,110.00, and WHEREAS, at the time of the adoption of the 1960 Budget, it could not have been reasonably foreseen that such purchase would be made and that the funds therefor would be required, and that it is in the best interests of the people of the City of Yakima to make a transfer to the proper fund so such purchase might be.ma.de and the action contemplated herein is authorized by R.C.W.35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF,YAKIMA: That the sum of $5,110.00 is hereby transferred from the Water Main Materials account to the Water Distribution System Account,•all within the'Capital or Betterment'Accou nts classification of the 1960 appropriation for 52 1 Water Departr ment, and the Acting Director of Finance is authorized and directed to make the afore- said transfer of funds. BOSTIC Mayor Moved by Burns, seconded by Larson that Resolution No. D -104 authorizing the execution of a contract with Sealite, Inc. for treatment of sewer lines for the prevention of infiltration, be passed as read: carried, Bostic, Burns, Coombs, Larson and Oliver voting aye on.roll call. Barber and Robinson absent. RESOLUTION NO. D -1041 A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to enter into a contract with Sealite, Inc. for treatment' of sewer lines for the prevention of infiltration. WHEREAS, the City of Yakima has for a number of years had a prob= lem with infiltration of ground waters into sewer lines and has previously had the larg- er lines sealed to prevent such infiltration, and WHEREAS, the smaller sewer lines are badly in need of such treatment and Sealite, Inc, has a process for the sealing of such pipes and is the only concern performing such a service, and WHEREAS, an emergency exists due to the fact that there is only a three week period between March 1 and March 20 khenesuch work can be done, due to the state of the ground water level and because of said facts, the taking of bids is im- practicable, now, therefore, BE IT RESOLVED BY THE.: CITY COUNCIL.OF THE CITY OF YAKIMA: Section 1. That the City Manager and. City Clerk of the City of Yakima are hereby authorized and directed to enter.into a contract, a copy of which is hereto attached and by this reference made a part hereof, with Sealite, Inc., for the sealing of certain sewer pipes within the City of Yakima.. Section 2. That the City Manager is authorized to spend for such work in the performance of said contract a sum not to exceed $10,000.00. ATTEST: J. A. BOSTIC Mayor A resolution authorizing the execution of an'agreement with the Boise- Cascade Lumber Company for the construction of a water line, having been read by the Clerk of the Council, and discussed by the Council, and all information not being available, it was MOVED by Coombs, seconded by Larson that said resolution be delayed until the next regular meeting when the City Manager will be present; carried, Bostic, Burns, Coombs, Larsom and Oliver voting aye by voice vote. Barber and Robinson absent. A resolution authorizing the purchase of a neon welcome sign for the Yakima Municipal Airport and the execution of a maintenance contract with Valley Neon Company, having been read by the Clerk of the Council and discussed by the City Council and all informa- tion not being available, it was MOVED by Coombs, seconded by Burns that action on said resolution be postponed until the next .regular meeting of the Council: carried, Bostic, Burns, Coombs, Larson and Oliver voting aye by voitecvote. Barber and Robinson absent. Councilman Barber present for the balance of this meeting. A petition, being petition No. 26, requesting the rezoning of property situated on Lincd Avenue between 37th Avenue and Price Acre Avenue, having been duly filed by Russell 0. Price and others, and the Planning Commission now recommending that said property be rezoned, it was MOVED by'Burns, seconded by Barber' that the City Attorney be and is hereby instructed to prepare the ordinance accepting the recommendation of the Planning Commission: carried, Barber,Bostic, Burns, Coombs, Larson and Oliver voting aye by voice vote. Robinson absent. A vacancy on the Civil Service Commission for Fire and Police having been created by the death of Frank H. Jenne, and after due. consideration by the City Council, it was MOVED.by Coombs, seconded. by Barber that G. Edward Williams be and is hereby appointed to fill the unexpired term of Mr. Jenne-on the Civil Service Commission for Fire and Pol'ide: carried, Barber, Bostic, Burns,-Coombs, Larson and Oliver voting aye by voice vote. 631 �,6�32 r FEBRUARYi24, 1960 Councilman Robinson present for the balance of this meeting. Resolution No. C -1622 being a.resolution which provides that the City of Yakima, upon determination of defective sidewalk conditions, and the abutting property owners having been duly notified of their responsibility of maintaining same, may furnish all labor and equipmentInecessary to repair said sidewalk at no charge to the abutting property owner and further providing that the abutting property owner shall pay for all material; used in such repair, and the City Manager having informed the Council in a written repo: that a complete survey of the sidewalks has been completed and asking that this policy be reaffirmed or a policy established for the repair of sidewalks, it was MOVED by Robinson, seconded by Coombs that the Council hereby reaffirm the sidewalk policy as set forth in Resolution No. C- 1622:. carried, Barber, Bostic, Burns, Coombs, :Larson Oliver and Robinson voting aye by voice vote. Moved by Barber, seconded by Oliver that Ordinance No. 92 transferring $900.00 with- in the 1960 Current Expense Finance Department Budget for the payment of professional accounting help to carry on the work of that department, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 92, AN ORDINANCE transferring the sum of $900.00 from Account 12 -7 -02, Salaries to Account 12 -7 -21, Professional - Legal and - ,Accounting, and declaring an emergency.
