HomeMy WebLinkAbout04/22/1959 Business MeetingAPRIL 22, 1959 The City Commission met in regular session, Mayor Alderson, Commissioner Wine and.City Attorney Arntson present on roll call. Commissioner Mathews absent. The minutes of the regular meeting of April 15, 1959 and adjourned meetings thereof, were approved as read. This being the time for the hearing on resolution No. C -1671 providing for the improve- ment of certain property by the construction of a domestic water system and other appurtenances and there being person present to protest said improvement and protests having been filed in writing with the City Engineer, an ordinance creating a Local Improvement District was read-by the City Clerk and those protesting were heard. Mayor Alderson asked that this matter be set aside until he could make a personal inspection of the area on this same date. It was so ordered. Moved by Wine, seconded by Alderson that Resolution No. C -1683 terminating the lease now held by Yakima Medical Service Association, on city owned property at 10 East Walnut, upon the acceptance by the City of Yakima of a new tennant willing to lease the premises for a minimum period of three years and on such other conditions as may be agreed upon by the City of Yakima, be passed as read: carried, Alderson and Wine voting aye on roll call. Mathews absent. RESOLUTION N.O. C -1683, A RESOLUTION with respect to the cancellation and termination of the lease between the City of Yakima and the Yakima Medical Service Association, Ipc. WHEREAS, on September 26, 1955 the City of Yakima entered into a lease agreement with the Yakima Medical Service Association, Inc., a corporation, for the leasing of the following described real property situated in Yakima, Yakima County,. Washington owned by the City of Yakima to -wit: The West 50 feet of Lots 1, 2, 3 and 4 of Block 13, City of North Yakima (now Yakima, Washington); according to the official plat thereof on file and of record in the office of the County Auditor, - Yakima County, Washington for a term of five years commencing August 1, 1955 and ending at midnight on July 31, 1960, and WHEREAS, the said Yakima Medical Service Association, Inc. is desirous of terminating said lease and of surrendering the said premises and has signified its intent and willingness to obtain a new tenant for said premises acceptable to the City of Yakima, now therefore, BE IT RESOLVED BY THE CITY COMMISSION OF TIC CITY OF YAKIMA: Section 1. That upon the acceptance by the City of Yakima of a new tenant willing to lease the above described premises for a minimum period of three years upon such terms and conditions and in such monthly rentals as may be agreed upon by the City of Yakima will terminate the lease executed on September 26,.1955 between the City of Yakima and the Yakima Medical Service Association, Inc. ALDERSON Mayor Moved by Wine'.-seconded by':Alderson that the Authentication of Charter Amendments as prepared by the City Attorney and read by the City Clerk, said amendment adding Article XVI providing civil service status for certain employees of the City of Yakima and creating a'Civil Service Commission to administer same, said amendment having been voted on by the electors of the City of Yakima on the 10th day of March, 1959 and the majority of the votes cast being "For" said amendment, be accepted and the City Clerk be and is hereby instructed to record both the amendment and authentication of Charter Amendmets in the original Charter Book: carried, Alderson and Wine voting aye on roll call. The following bids having been received and considered April.-120, 1959 by a Bid Board comprised of the Purchasing Agent, City Clerk and Chief of the Fire Department for the purchase of a Station Wagon for the Fire - Department: Wagner Chevrolet Bell Wyman Company Valley Ford Sales $2,270.12 2,372.20 .2,374•02 B and the Purchasing Agent recommending the bid of Wagoner Chevrolet Company as the lowest and best bid and also recommending the suggestion of this company to substitute an 8 cylinder motor instead of a 6 as advertised since the substitution will not raise this bid above the next highest bid received, it was MOVED by Wine, seconded by Alderson that the recommendation of the Purchasing Agent be accepted and the bid be awarded to Wagner Chevrolet Company with instructions to substitute an 8 cylinder motor in this Station Wagon: carried, Alderson and Wine voting aye on roll call. Mathews absent. The Planning. Director requesting a copy of the City Code Book for the purpose of submit- ting it with a workable program for urban development to the Housing & Home Financing Agency of the Federal Government, it was MOVED by Wine seconded by Alderson that the City Clerk be and is hereby authorized to give said Code Book to the Planning Director for this purpose: carried, Alderson and Wine voting aye on roll call. Mathews absent. An ordinance appropriating $19250.00 from the unappropriated funds of the Irrigation Fund to the Water Stock Assessments and Storage item of the 1959 Irrigation Department Budget, was read in its entirety and ordered laid on the table -for one week. The Purchasing Agent reporting that the City of Yakima and the City of Ellensburg can both enjoy a cheaper price on the purchase of Chlorine by' calling for bids jointly, it was MOVED by Wine, seconded by Alderson that Resolution No. C- 1684 authorizing the Pur- chasing Agent of the City of Yakima to enter into a joint call for bids for this city 1 1 1 1 1 APRIL 22, 1959 and the City of Ellensburg for the purchase of chlorine, be passed as read: 'carried, Alderson and Wine voting aye on roll call. Mathews absent. RESOLUTION NO. C -1684, A RESOLUTION.authorizing the Purchasing Agent of the, City of Yakima to enter into a joint call for bids with the City of Ellensburg for the purchase of chlorine. WHEREAS, chlorine fortae by the City of Yakima may be purchased in multi -unit car loads of fifteen tons each at a more advantageous price, and WHEREAS, the requirements of the City of Yakima are not suf- ficient to obtain the benefit of ' such price, and WHEREAS, the City of Ellenshirg requires the same type of chlorine for its use, and WHEREAS, it would be advantageous to both the City of Yakima and the City of Ellensburg to issue a joint call for bids for such chlorine, now, therefore BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That the Purchasing Agent of the City-of-Yakima be and he hereby is authorized and directed to issue a call for bids for the purchase of chlorine jointly with the City of Ellensburg. ALDERSON City Clerk Mayor "The City Commission having moved to retire George Capps, an employee of the Water Department, on the 11th day of March, 1959, and the Superintendent of Public Works now asking for reconsideration of this matter, stating that he can use this man at the Sewage Treatment Plant and asking that his employment be extended for one year in order -that he may complete his Social Security coverage, it was MOVED by Wine, seconded by Alderson that the employment of George Capps be extended for one year from the lst day of June, 1959: carried, Alderson and Wine voting aye on roll call. A petition having been duly filed by the Washington Canners Cooperative praying for the annexation of property described as Lots 51 and 52 of St. Paul Acre Lots, it was MOVED by Wine, seconded by Alderson that the City Clerk give notice of hearing on said peti- tion for the hour of 10 o'clock a.m. on Wednesday the 20th day of May, 1959 by publica- tion and posting in accordance with the law for annexations: carried, Alderson and Wine voting aye on roll call. In accordance with Resolution No. C -1603 and C -1604 which authoritzed the sale of a specific portion of Cemetery orchard property-for the sum of $10,000.00 to the United States Government for a Naval Reserve Center, it was MOVED by Wine, seconded by Alderson that Resolution No. C -1685 authorizing the Mayor and City Clerk to enter a stipulation with respect to the sale of said property in Civil Cause No. 1368 in the United States District Court for the Eastern District of Washington, Southern:.Division and authorizing the City Attorney to approve a judgment conveying fee simple title of said real property to the United States Government, be passed as read: carried, Alderson and Wine voting aye on roll call. RESOLUTIONT NO. C -1685, A RESOLUTION authorizing stipulation with respect to the sale of the East of the NE, of Section 35, t 13N, R 18, E.W.M. ALDERSON City Clerk Mayor A hearing having been held April 15, 1959 for considering the recommendation of the Traffic Board as to the raising of the over -head ice conveyor located on "C" Street and owned and operated by J. M. Perry Ice & Storage Company, it was,MOVED by Wine, seconded by Alderson that Ordinance No. B -2281 amending Ordinance No. B -677 granting J. M. Perry & company the right to construct operate and maintain a conveyor belt over and across "C" Street and changing the height of said conveyor to fifteen (15� feet to accomodate the increased height of motor vehicles allowable by State law, be passed as read, carried, Alderson and Wine voting aye on roll call. Mathews absent. ORDINANCE NO. B -2281, AN ORDINANCE amending Ordinance No. B -677 entitled "AN ORDINANCE . granting J. M. Perry & Company the right to construct,. operate and maintain a conveyor belt over and across "C" Street between the Northern Pacific Railway tracks and First Avenue North in the City of Yakima, Washington." The-following letter left by Commissioner Mathews was read by the City Clerk: April 22, 1959 TO: City Commission FROM: Larry Mathews - Public Works Commissioner ATTENTION: City Clerk FOR: City Commission Meeting - Include in minutes Among the legislative matters which the City Commission will consider today are two items about which I feel I must state my position as I will be unable to be present. I know the City Commission will give due consideration to all the facts and render a decision which they feel is in the best interest of the community and will serve the needs of all the people. It has been my feeling that sonsideration of any matter which reasonably can be posponed until the new council takes over, should be postponed. This opinion has been expressed by many people, including the press on various occasions, and I feel that the City Commission should avoid making any long term commitments if they can possibly do SO* The proposal to lease the Sherwood and Roberts building could well be left to the new council, It is my personal opinion that the City's obligation to the people we serve makes it mandatory that we do everything in our power to provide adequate off - street parking for the convenience of the patrons of City Hall. This requirement is mandatory upon many business of the City and the government certainly should attempt to follow the rules they require of others. The other matter which concerns many people is the sale of cemetery land to the U. S. Government as the City Commission well knows the cemetery does not have adequate funds to properly maintain the premises. At the time the decision was made to release five acres to the U.S. Government for construction of a building it was my understanding that the sale was for $10,000.00 and that the money was to be used for improvement of irrigation facilities at the cemetery. It_now appears that the City will receive approx- imately $9,000.00 for the land and $1,000.00 for the utility improvements and that the money is to be alloted to the current expense fund for benefit of the general government operations. I do not believe this was the intent of the City Commission at the time the deal was arranged. I know the City Commission will decide for the best interest of the City and that due consideration will be given to the feelings of those people who have a personal and heart felt interest in the well being and future of Tahoma Cemetery. A claim for damages in the amount of $2,600.00, having been duly filed by Gertie M. Gordon, said damages arising from injuries sustained by the claimant stumbling and fall- ing over a crack in the sidewalk located in front of 504 West Peach Street on August 30, 1958, it was MOVED by Wine, seconded by Alderson that Resolution No. C -1686 allowing and approving $200.00 in payment of said claim and authorizing the Chief City Accountant to issue a warrant on the Current Expense fund for same, be passed as read: carried, Alderson and Wine voting aye on roll call. RESOLUTION NO. C -1686, WHEREAS, a claim for damages has been timely filed against th� City of Yakima by Gertie M. Gordon, a widow, in the sum of $2,600.00 arising from damage: and injuries sustained by the said Gertie M. Gordon has signified her willingness to accept the sum of $200.00 in settlement of said claim, and it is deemed in the best interest of the City of Yakima to settle and allow said claim in the sum of $200.00, now therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: Section 1. That the claim of Gertie M. Gordon, a widow, in the sum of $200.00 be and the same is hereby allowed and approved in said amount, and the Chief City Accountant of the City of Yakima is hereby authorized and directed to -issue a warrant in payment of said claim of $200.00 chargeable against the Current Expense General Government, 7 -90 Fund, provided, however, that said warrant shall not be de- livered to said Gertie M. Gordon until a release is executed and filed with the City Clerk of the City of Yakima by the said Gertie M.
