Moved by Huza, seconded by Huey that as no official business was transacted at the regular meeting of Monday, April 16, 1956 with the exception of opening bids as ordered by Mayor Burns; all business to be transacted at that time will.be taken up at the present-meeting: carried. - Burns, Huza and Huey voting.aye on roll call. This being the time for the hearing on Resolution No. C -1355, providing for the vacation of that certain roadway approximately 20 feet wide, running along the west line of the east half of the NE- of the NW! of Section 27 -13 -18 EWM, and there being no one present to represent School District No. 7 at said hearing; it was MOVED by Huey, seconoed by Burns, that said hearing being postponed for one week: carried; Burns, Huza and Huey voting aye on roll call. This being the time for the hearing on Resolution No. C -1358, providing for the con- struction of a sewer system on Lots 1 to 27 Liebert Addition, and there being-no objec- tions in writing or otherwise to said improvement or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No. B -1869, creating L.I.D. No. 839, be,-.passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -18691 AN ORDINANCE providing for the improvement of certain property constructing a pipe sewer with the necessary wye branches, manholes, flush tanks with water connections therefor; establishing a Local Improvement District, providing for the method of payment therefor; and creating a special fund. This being the time for the hearing on the annexation of the SE corner of the SE4 of the SE4 of the NW4 of Section 35 -13 -18 EWM; thence West along the south linerof said subdivision 400 feet; thence north parallel with the east line of said subdivision 230 feet; thence west 55 feet; thence north 241 feet; thence east 110 feet; thence south 22.5 feet; thence east 345 feet; thence south 250.5 feet; to the point of be- ginning, and there being no objections in writing or otherwise to said annexation pro- ceedings, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No. B -1870, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1870, AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima, Washington. This being the time for the hearing on the annexation of the West 180 feet of the north 320 feet of the SW4 of Section 36 -13 -18 EWM, and there being no objections in writing or otherwise to said annexation proceedings, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No. B -1871 annexing said property be passed as read carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -18711 AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima, Washington. This being the time for the hearing on Resolution No. C -1357, providing for the con- struction of curbs and gutters on Swan Avenue,and there being insufficient protest against said improvement or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No. B -1872, creating L.I.D. No. 840, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO.B -18721 AN ORDINANCE providing for the improvemnt of certain property by grading, ballasting, surfacing and constructing° concrete curbs and gutters; establish- ing a Local Improvemnt District, providing for the method of payment therefor, and creating a special fund. . Moved by Huza, seconded by Huey that Resolution No. C -1366 providing for the improve- ment of Belgold Drive -in Chestnut Park and the east side of 39th avenue adjacent to Chestnut Park by grading, ballasting, surfacing and constructing concrete curbs and gutters, and fixing the date of hearing on said resolution as of Monday, the 14th day of May, 1956, at 10 otclock a.m. be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -13662 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve Begold Drive in Chestnut Park and the east side of 39th Avenue adjacent to Chestnut Park by grading, ballasting, surfacing and constructing concrete curbs and gutters, together with the necessary drainage features. The district to be served by and assessed for the above des- cribed improvement is situate in Yakima County, Washington, and described as follows: Lots 1 to 13, inclusive, of Chestnut Park in the oity of Yaktna, Yakima County, Washington, All persons who may desire to object to said proposed improve- ment are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the-City of Yakima, Yakima County, Washington, at the hour of 10 o ►clock a.m. on Monday, the 14th day of May, 1956; which time and place are hereby fixed for the hearing of all matters re- lating to said proposed improvement or objections thereto, and for determining the payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. All costs and expenses in connection with the construction of said improvement, including the engineering, inspection, advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City En --ineer is hereby directed to submit to the City Commission at or prior to the date fixed hereinfbr said-hearing, all of the data and other information required by law to be by him submitted; all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by 87 AP RIL 2,3, 1956 the City Engineer and filed with the City Clerk. BURNS, Mayor Moved by Huza, seconded by Huey that Resolution No. C -1367, relative to the payment of $1200.,00 to the City of Yakima for. inspection services in regard to work being done on the city streets by the Cascade Natural Gas Corporation and other stipulations more fully set forth in said resolution, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1367, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That subject to payment by it to the City of Yaki[Tia of the sum of $1200.00 within ten days from the date hereof in order to reimburse the city for part of the expense of inspection, policing, etc. relative to the installation of gas dis- tribution linens in said city, the said City of Yakima does hereby grant a permit to the Cascade Natural Gas Corporation to lay, install and construct natural gas distribu- tion pipe lines in and. under the streets of said city in accordance with the map filed by said gas company with the city and pursuant to the gas franchise and gas ordinances heretofore adopted in said city; and in connection therewith said city does hereby grant to said gas company a permit to conduct a survey of the residents of said city and ascertain which of said residents desire to obtain natural gas service and at what addresses said gas service is desired and in such instances to obtain signatures on their form of service pipe contract heretofore filed by the gas company with the city; it being understood that this permit therefor is being granted notwithstanding any pro- visions of ordinances No. B -875 and B -1668 of said city, and the same shall not be deemed applicable to the said prospective customer survey by said gas company. Moved by Huey, seconded by Huza that the City Clerk is hereby instructed to give notice to bidders for the purchase of a 6 cylinder, 2 -door Station Wagon for the City Engineering Department; bids to be received on Monday, the 30th day of April 1956, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Clerk is hereby instructed to give notice to bidders for the purchase of 2 Truck Chassis for the Sanitation Department; bids to be received on Monday, the 7th day of May.1956, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. This being the time for receiving bids for the construction of a sewer for the new Senior and Junior High School the following were received: N" °L. Kimball, f or T & G $11,718.20 ' ., for Tylox $12,519.65 &Blasio Bros., for T & G 10,8,33.60 for Tylox 10,573.40 Carroll & Sanislo for T & G $10,319.62 for Tylox V11,158.06 The bid of Carroll & Sanislo being the lowest and best bid, it was MOVED by Huey, seconded by Huza that said bid be accepted, and the Mayor and the City Clerk authorized to execute a contract on behalf of the vity of Yakima for" doing said work upon receipt of the proper bond therefore carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the following bids were received for the construc- tion of the Plath Avenue Sewer System, L.I.D. No. 836: Paul R. Henley $13,550.68 Carroll & Sanislo 12,6o9.59 Buck & Edinger Trucking Co. 911,499-55 The bid of Buck & Edinger Trucking Company being the lowest and best bid, it was MOVED by Huey, seconded by Huza that said bid be accepted and the Mayor and City Clerk author- ized to execute a contract on behalf of the 6ity of Yakima for doing said work upon filing of the proper bond therefor: carried, Burns, Huza and Huey voting .aye on roll call. Moved by Huey, seconded by Huza that the application of the City Planning Commission that Section 15, Subsection (h) No. 5, be amended to read as follows: "5. Definition of a parking space: for the purpose of this subsection, 200 square feet of lot or floor area shall be deemed a parking space for 1 automobile. Parking facilities shall be arranged so as not to necessitate the use of any part of adjoining public sidewalks, park- ways, roadways, boulevards or thoroughfares in conducting parking or unparking operations " is hereby granted: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the petition 0. G. Chisholm and wife for the annexa- tion of the Westover Terrace Addition and also the property owned by Dick Maddox, which extends to Tieton Drive, be accepted and Monday the 7th day of May 1956, at the hour of 10 o'clock a.m. set for the date of hearing: carried, Burns, Huza and Huey voting aye on roll call. us 1 D L 1 1 1 APRIL 23, 1956 Moved by Huey, seconded by Huza that the rezoning of Lots 4, 5 and a fraction of Lot 6, Block 57 Black's Addition, from "C" Residence District to Business District, Area District remaining the same, is hereby disapproved: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the rezoning of the property situated at 310 and 312 Holton Avenue, which is the South 140 feet of the North 315 feet of Tract A of Bedker's Second Addition from "B" Residence District and Area District 2, to "C" Resi- dence District and Area District 4 be approved: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the rezoning of Lots 1 to 8 and Lots 15 and 16 of Hillacre Addition from "A" Residence District to "B" Residence District, the Area dis- trict to remain the same, is hereby disapproved: carried, Burns, Huey and Huza voting aye on roll call. Moved by Huey, seconded by Huza that the rezoning of the Liebert Addition be placed in the "B" Residence District and second Area district, be disapproved: carried, Burns, Huza and Huey voting aye on roll call-. Moved by Huey, seconded by Huza that Lots 1 to 18 Petzel Addition, remain in "A" Residence, Area 2, and not changed to "B "' Residence Area 1, as recommended by the Planning Commission: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the rezoning of the property lying south of Nob Hill Boulevard from 20th Avenue to 22nd Avenue from "B" Residence to Business District, Area 4, be approved: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the rezoning of Lot 6, Block 1, Johnson's Corner Subdivision, from "B" Residence to Limited Business district, Area 2, be continued to Monday, April 30;:,1956 at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the rezoning of the property located at 204 and 206 North 10th Avenue (Custer Avenue) is hereby disapproved: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Clerk is hereby instructed to advertise for bids for the construction of curbs and gutters on Swan Avenue L.I.D. NO, 840 said bids to be received on Monday, the 7th day of May, 1956 at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Clerk is hereby instructed to advertise for bids for the construction of a sewer system on Lots 1 to 27, Liebert Addition, L.I.D.
